Terms and Conditions:

1. Background

These terms and conditions apply to your subscription for, access to and use of the SuperCoach Gold for NRL service ("SuperCoach Gold for NRL").

SuperCoach Gold for NRL is provided by Vapormedia Virtual Sports, a business unit of Vapormedia Pty Limited ACN 140 989 368 ("Vapormedia"), for News Limited ACN 007 871 178 in association with News Limited companies publishing newspapers in Victoria, Queensland, Tasmania, South Australia, New South Wales, Western Australia and Northern Territory By accessing and using SuperCoach Gold for NRL, you agree with us to be bound by these terms and conditions.

SuperCoach Gold for NRL is available to registered participants of the SuperCoach for NRL 2015 game ("Game"). You do not need to subscribe to SuperCoach Gold for NRL to play, or win prizes in, the Game.

For the avoidance of doubt, these terms and conditions only apply to your subscription for, access to and use of SuperCoach Gold for NRL. Your participation in the Game will continue to be governed by the SuperCoach Official terms and conditions which are available on the Website.

SuperCoach Gold for NRL contains information, analysis and prediction tools and other services and content intended to increase your enjoyment of the Game.

2. Definitions

In these terms and conditions:

ACL means the Australian Consumer Law set out in Schedule Two of the Competition and Consumer Act 2010 (Cth).

Additional Amount means an amount equal to a price or other sum payable in connection with a supply under these terms and conditions multiplied by the applicable GST rate plus any penalties or interest or both imposed under any applicable GST laws.

Content includes information, data, pictures, text, graphics, multi-media presentations, fonts, layouts and hyperlinks.

Game Expiry Date means the date the Game Period ends.

Game Page means the section of the Website accessible by you when you enter your Game user name and password.

Game Period means between 12:01am AEDT on 29/01/2016 and 11:59pm AEST on 4/09/2016.

Permitted Purpose means you viewing and analysing the SuperCoach Gold for NRL Content and using any tools forming part of SuperCoach Gold for NRL to assist you in playing the Game and making decisions regarding the Game, such as decisions regarding team line-up, player selection and player trading.

Subscriber means a digital subscriber of The Courier-Mail, who has purchased the $4.99 per week subscription package.

Subscription Date means the date your application for subscription to SuperCoach Gold for NRL is accepted by us, or in the case of Subscribers the later of: a) the date that you register to participate in the Game; and b) the date you become a Subscriber.

Subscription Pages means the pages on the Website required to be viewed and completed by you to submit an application to subscribe to SuperCoach Gold for NRL.

SuperCoach Gold for NRL Content means any Content relevant to the Game which, in providing the SuperCoach Gold for NRL Services to you, we decide to make available to you via your Game Page from time to time.

We, us, our, means News Limited.

Website means any of the following web sites from which participants must register to play the Game: supercoach.dailytelegraph.com.au, supercoach.couriermail.com.au or supercoach.foxsports.com.au

3. SuperCoach Gold for NRL Services

In order to access SuperCoach Gold for NRL you must be a registered participant in the Game and you must either:
complete and submit the subscription application located on the Subscription Pages; or
be a Subscriber.

You acknowledge that your subscription application may be rejected for any reason.

If your subscription application is accepted, or you are a Subscriber, then (subject to these terms and conditions) we will provide you with access to SuperCoach Gold for NRL. SuperCoach Gold for NRL will comprise of making available to you via your Game Page, for the Permitted Purpose, the SuperCoach Gold for NRL Content including:
player and team statistical information;
player and team performance, prediction and analysis tools;
news, analysis, match previews and other similar content; and
team selection and trading tools.

4. Use of SuperCoach Gold for NRL Content

You may access and use SuperCoach Gold for NRL for the Permitted Purpose and not for any other purpose. Without limiting the above, you must not:
make copies, electronic or otherwise of the SuperCoach Gold for NRL Content for any other purpose;
provide any of the SuperCoach Gold for NRL Content by electronic or other means to any person or otherwise communicate any of the SuperCoach Gold for NRL Content to others;
&pdistribute or display any SuperCoach Gold for NRL Content on any electronic network or otherwise, including (without limitation) the internet;
alter or change any part of the SuperCoach Gold for NRL Content; or
create any derivative works based on the SuperCoach Gold for NRL Content.

5. Duration

Unless provided otherwise in these terms and conditions, your access to SuperCoach Gold for NRL will commence on the Subscription Date and will expire upon the earlier of:
the date your cancellation of your subscription pursuant to clause 10 is effective;
the date of us cancelling your subscription pursuant to clause 11 is effective; or
in the case of Subscribers, the date of cancelation or expiry of your digital subscription; or
the expiry of the Game Period.

6. Free Trials

From time to time we may offer free trials of SuperCoach Gold for NRL. If you subscribe for a free trial, we will make SuperCoach Gold for NRL available to you during the free trial period (as specified in the Subscription Pages). Once the free trial period expires, we will cease providing SuperCoach Gold for NRL to you and you will no longer be able to access the SuperCoach Gold for NRL Content (unless you become a paid subscriber).

7. Subscription fees and payment

The subscription fees payable by you for access to SuperCoach Gold for NRL are set out in the Subscription Pages. Subject to the provisions below, you may subscribe to SuperCoach Gold for NRL on a monthly or Season Pass basis.

Subscribers will be provided with free access to SuperCoach Gold for NRL as part of their digital subscription.

8. Monthly subscriptions

Monthly subscriptions will be charged to your credit card every four weeks in advance (according to the rates specified in the Subscription Pages) starting on the Subscription Date and continuing for the duration of the Game Period (unless you cancel your subscription pursuant to clause 10 or we cancel your subscription pursuant to clause 11).

If any repeat payment of the monthly subscription fees is rejected by the issuer of your credit card or is otherwise not paid, we may (without prejudice to our other rights) suspend your access to SuperCoach Gold for NRL until such time as the relevant subscription fees are paid by you in full.

9. Season Pass Subscriptions

If you subscribe for a Season Pass, we will charge a one off subscription fee (as specified in the Subscription Pages) to your credit card on the Subscription Date, which will entitle you to obtain access to SuperCoach Gold for NRL for the entire period between the Subscription Date and the Game Expiry Date.

Season Pass subscriptions may only be available for a limited period of time during the Game Period (as specified in the Subscription Pages).

10. Cancellation by you and refunds

If you are a monthly subscriber, you may cancel your subscription by logging into your Subscriber account and submitting to us the cancellation request.

If you send us a cancellation request, the cancellation of your monthly subscription will be effective on and from the date when the cancellation request is processed by us. Within 10 business days of receiving the notice of cancellation we will refund to you the pro rata balance of any prepaid monthly subscription fees paid by you, calculated from the date we process your cancellation.

All of the above is subject to the fact that it may take us several days to process a cancellation request.

You acknowledge that you may not cancel a Season Pass subscription.

11. Cancellation by us

We may cancel your access to SuperCoach Gold for NRL effective immediately upon us providing written notice (which may include notice by email) of cancellation to you if:
you cease to be a registered participant in the Game due to a breach of the Game rules or terms and conditions by you;
you breach any material provision of these terms and conditions;
the Game is cancelled or otherwise ceases to operate; or
your SuperCoach Gold for NRL access has been provided as a result of you being a Subscriber and your digital subscription expires or is terminated for any reason.

If we cancel your access to SuperCoach Gold for NRL pursuant to clauses 11(a) or (b) we will not have any obligation to refund subscription fees paid by you. If we cancel your access to SuperCoach Gold for NRL pursuant to clause 11(c), we will refund to you all subscription fees paid by you in respect of your access to SuperCoach Gold for NRL (this does not include your subscription fees in relation to your Subscriber subscription).

We reserve the right, in our sole discretion, to cancel or suspend SuperCoach Gold for NRL, should virus, bugs, unauthorized human intervention, or other causes beyond our control, in our sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of SuperCoach Gold for NRL or to cease providing access (in our sole discretion) to any individual who tampers with the operation of SuperCoach Gold for NRL or the Game.

12. Credit card details

Any credit card, debit card or other similar details you provide to us will be stored and used by us for the purpose of processing your payments of the subscription fees. You acknowledge that we may provide your credit card, debit card and other similar details to Australia and New Zealand Banking Group Limited or any other party we appoint to process credit card payments for us. We will use our best endeavours to keep such details secure.

13. Intellectual property

You acknowledge that you obtain no intellectual property rights, ownership or other rights in respect of the SuperCoach Gold for NRL Content (apart from the limited right of use granted under clause 4).

14. Commissions

You acknowledge that we may pay commissions or share amounts of your subscription fees with third parties including Vapormedia.

15. Consumer guarantees

Nothing in these terms and conditions (including, without limitation, clauses 16 or 17) should be interpreted as attempting to exclude, restrict or modify the application of any applicable provisions of the ACL, any liability of us for failing to comply with any provisions of the ACL or the right of you to make a claim in respect of any guarantees, or under any other provision, stated in the ACL. To the fullest extent permitted by law, any liability of News Limited, any participating News Limited company, Vapormedia or their servants or agents for breach of any rights you might have which are not able to be excluded under the ACL will be limited to the supplying of the relevant goods or services again.

16. Other guarantees and warranties

You acknowledge that:
as SuperCoach Gold for NRL contains information and analysis services that largely relate to the attempted prediction of future events or performances we, any participating News Limited company and Vapormedia do not provide any guarantees or warranties that:
the SuperCoach Gold for NRL Content will be entirely correct, accurate, reliable or fit for any particular purpose; or
any scores, results, performances or other similar events applicable to the Game predicted as a result of your use of SuperCoach Gold for NRL will occur or that any such predictions will be accurate;
as access to SuperCoach Gold for NRL is provided using the internet, we, any participating News Limited company and Vapormedia do not provide any warranties or guarantees that:
your access to SuperCoach Gold for NRL will be free of outages, interruptions or other similar issues; or
SuperCoach Gold for NRL will be compatible with any internet browser, other computer software, computer hardware or other technology;
except and only to the extent that the above guarantees or warranties are inconsistent with any applicable consumer guarantees under the ACL;
due to the unpredictable nature of the Game and the numerous variables involved in the Game, you cannot rely on the accuracy, relevance or completeness of SuperCoach Gold for NRL and must make your own enquiries and conduct your own research and analysis before making decisions in respect of the Game or otherwise playing the Game; and
SuperCoach Gold for NRL is not designed to, and does not, increase your chances of winning the Game, but it simply provides you with centralised Content that may enhance your experience in participating in the Game or assist you playing the Game.

You warrant and represent to us that: all information submitted by you to us (including the information in your application to become a Subscriber) is complete, true and accurate; and any credit card or debit card details you provide to us are in respect of a card issued to you or that you are authorised to charge the subscription fees to.

17. Liability

To the extent permitted by law, News Limited, any participating News Limited company and Vapormedia are not liable for any loss suffered or sustained to person or property and including, but not limited to, consequential (including economic) loss, by reason of any act or omission, deliberate or negligent, by News Limited, any participating News Limited company, Vapormedia or their servants or agents, in connection with the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to you (including, without limitation, the unavailability of any websites).

Except as these terms and conditions otherwise expressly provide, we give no condition, warranty, undertaking or representation in relation to the condition, accuracy, suitability or quality of SuperCoach Gold for NRL, and all implied conditions and warranties are excluded to the fullest extent permitted by law.

News Limited, its employees, officers, agents, and its parent companies and subsidiaries, and any participating News Limited company, are not responsible for and shall not be liable for: (i) any condition caused by events beyond the control of News Limited that may cause the Game or SuperCoach Gold for NRL to be disrupted or corrupted; (ii) any injuries, losses, or damages of any kind caused by your access to, or use of SuperCoach Gold for NRL, or downloading material from a Website; or (iii) any printing or typographical errors in any materials associated with SuperCoach Gold for NRL. News Limited reserves the right in its sole discretion to amend these terms and conditions, or the operation of the game, at any time as a result of any unforseen events or circumstances, or any causes beyond the control of News Limited.

18. Privacy

News Limited collects information about you, including for example your name and contact details which you provide when registering or using our services as well as information from data houses, social media services, our affiliates and other entities you deal or interact with for example by using their services. We collect and use that information to provide you with our goods and services, to promote and improve our goods and services, to process your competition entries, to provide you with targeted advertising based on your online activities, for the purposes described in our Privacy Policy and for any other purposes that we describe at the time of collection. We may disclose your information to our related companies, including those located outside Australia. We may also share your information with other persons or entities who assist us in providing our services or running competitions (including Vapormedia) or with other companies who provide prizes for competitions or reader offers, including those located outside Australia. We or any of our Australian related companies may, directly or through a contractor, contact you by any means (including by SMS or e-mail) in the future to provide you with information and updates relating to SuperCoach Gold for NRL (which are generally provided on a weekly basis) or to let you know about goods, services or promotions which may be of interest to you.

The policy also explains that if you do not provide us with information we have requested from you, we may not be able to provide you with the goods and services you require. Where you have entered a competition, we may disclose your personal information to authorities if you are a prize winner or otherwise as required by law. Further information about how we handle personal information, how you can complain about a breach of the Australian Privacy Principles, how we will deal with a complaint of that nature, how you can access or seek correction of your personal information and our contact details can be found in our Privacy Policy at http://www.newscorpaustraliaprivacy.com.au

By accessing and using SuperCoach Gold for NRL, you consent to your personal information being used for the purposes set out above.

By marking the "opt-in" boxes on the Website entry form you consent to the storage and use of your personal information by the specified entities for the marketing purposes as set out next to opt-in boxes. Vapormedia's privacy policy is available at http://www.vapormedia.com/?p=privacy. The organisations referred to above may transfer your personal information outside of Australia. If you choose not to provide information, the organisations referred to above may not be able to provide you with services in relation to SuperCoach Gold for NRL. The privacy policies of each of the organisations referred to above contain information regarding how you may access and correct the personal information that they hold about you, and how you can complain about how they collect or use that personal information.

19. GST

If a supply under these terms and conditions is a taxable supply, the recipient of the taxable supply must pay the Additional Amount to the supplier, at the same time and in the same manner as the relevant payment is due and payable, subject to the recipient receiving a valid tax invoice in respect of the supply at or before the time that the relevant payment is due and payable. If the Additional Amount differs from the GST payable by the supplier, the parties must do all things necessary to adjust the Additional Amount, so that the Additional Amount is the same as the GST payable by the supplier and ensure that the relevant party issues an adjustment note.

20. Force Majure

We will not be liable for any delay or failure to perform any obligation under these terms and conditions insofar as the performance of such obligation is prevented by an event beyond our reasonable control, including but not limited to, earthquake, fire, flood or any other natural disaster, labor dispute, riot, revolution, terrorism, acts of restraint of government or regulatory authorities, failure of computer equipment, ongoing internet or telecommunications outage or failure or delay of sources from which data relevant to SuperCoach Gold for NRL is obtained.

21. General Provisions

These terms and conditions constitute the entire understanding between us and you in relation to SuperCoach Gold for NRL and supersede all previous agreements and understandings. These terms and conditions may only be varied by written agreement between the parties. Failure at any time to enforce any of these terms and conditions or to require performance will not be construed as a waiver of such provision or affect the right of either party to enforce the same. If any provision of these terms and conditions is held to be invalid or unenforceable by any tribunal of competent jurisdiction, the remaining provisions will not be affected and will be carried out as closely as possible according to the original intent. These terms and conditions will be governed by the laws in force in the State of New South Wales, Australia, and each party agrees that the courts of the State of New South Wales will have non-exclusive jurisdiction to deal with any disputes arising out of or in connection with these terms and conditions.
