Conditions of entry
Information on how to enter and details of prizes form part of these Terms and Conditions.
Participation in the Competition constitutes acceptance of these Terms and Conditions. Only entries
that are submitted and comply with these Terms and Conditions will be accepted. A person may
enter the competition as many times as they are eligible, but once per receipt.
How to enter
Entrants must purchase products to the value of $25.00 (at a minimum) in store at Simply Fresh
Fruiterers and either:
a) Complete an entry form in store, or
b) Enter via the competition webpage on Simply Fresh’s website
www.simplyfreshfruiterers.com.au/win
Proof of purchase in the form of a receipt number and date must be provided for all entries.
Incomplete entries and entries which are received after the concluding time of 5.00pm ACST Sunday
15th May 2016 will be ineligible.
No responsibility will be accepted for entries not received, for whatever reason.
Who may enter
Entry is open to South Australian residents excluding:
(a) employees of Simply Fresh Fruiterers;
(b) the spouse, de facto spouse, parent, natural or adopted child, or siblings of such employees
and contractors (whether or not they live in the same household);
(c) contractors of Simply Fresh Fruiterers; and
(d) employees of any third parties involved with the promotion.
Entries can only be made in an individual’s own name, and no entry can be made for or on behalf of
any other person.
In the event that the winner is under 18 years of age, they must have consent from a parent or legal
guardian to accept the prize.
Draw and winner notification
The competition is a game of Chance. Skill plays no part in determining who will be the winner. The
winner is determined by chance and luck. The prize winner will be drawn at Simply Fresh Fruiterers,
361 Kensington Road, Kensington Gardens, Adelaide SA 5068 on Wednesday 18th May 2016. The
prize winner will be notified by telephone or email within 7 days of the draw.
The winner will be asked to collect their prize in store at a specified date to be determined by Simply
Fresh Fruiterers and the competition winner. Photo identification must be supplied by the winner for
prize collection.
The prize must be collected within 30 days of winner notification. Should the winner not claim the
prize, or if Simply Fresh Fruiterers are unable to contact the winner of a prize within 30 days, the
prize will be forfeited by the winner and Simply Fresh Fruiterers shall hold no liability towards the
prize winner.
The drawing of the competition winner is final and no correspondence will be entered into.
The prize
Clementi Smile Outdoor Wood Fired Oven, total prize value is $3,000AUD.
Prizes cannot be transferred, exchanged or redeemed for cash.
Simply Fresh Fruiterers reserve the right to substitute any prize with another of equivalent value
without giving notice.
Publicity and promotion
All personal details supplied will not be shared with any outside parties, including Facebook, unless
Simply Fresh Fruiterers is required by law to do so. The winner and their name/image will be shared
through marketing initiatives. Simply Fresh Fruiterers reserve the right to use entrants’ supplied
email for future marketing initiatives. Entrants are able to unsubscribe from email marketing at any
time by following the instructions contained in any marketing email.
Other conditions of entry
If any act or omission, event or circumstance occurs which is beyond the reasonable control of
Simply Fresh Fruiterers which prevents Simply Fresh Fruiterers from complying with these Terms and
Conditions (including awarding any part of the prizes), Simply Fresh Fruiterers will not be liable for
any failure to perform or delay in performing its obligations. Simply Fresh Fruiterers reserves the
right (subject to any applicable law) to cancel, terminate, modify or suspend the Competition.
Except for any liability that cannot be excluded by law, Simply Fresh Fruiterers (including its officers,
employees and agents) excludes all liability (including negligence), for any personal injury; or any
loss or damage (including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of the Competition, including, but not limited to, where arising out of the
following:
(a) any act or omission by Simply Fresh Fruiterers or its employees or agents in connection with
the arrangement of the supply or the supply of goods by any person to the prize winner;
(b) any theft, unauthorised access or third party interference;
(c) any variation in prize value to that stated in these terms and conditions;
(d) any tax liability incurred by the prize winner or entrant; or
(e) injury of damage to entrants or other persons relating to or resulting from participation in
the competition.
This clause does not affect, and is not intended to affect, any rights a consumer might have, which
are not able to be excluded under applicable Australian consumer protection laws.
By submitting an entry to this Competition, the entrant acknowledges and agrees that they have
read, understood and agrees to be bound by these Terms and Conditions of entry.
The Agency and Promoter reserve the right, at their discretion, to change these Terms and
Conditions at any time. Participants agree to abide by the most recent version of this document
when entering the competition in store or online. Participants are accordingly advised to consult the
Terms and Conditions each time they enter.
