TERMS AND CONDITIONS:

1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is Brisbane Airport Corporation Pty Limited (ABN 54 076 870 650) of 11 The Circuit, Brisbane Airport, Queensland 4008, Australia.
3. Entry is only open to Queensland residents aged 18 years old or over.
4. Employees, contractors, consultants and their immediate families of the Promoter, Cathay Pacific and agencies associated with this promotion, are ineligible to enter.
5. Entry is conditional on providing personal information. The Promoter collects and deals with personal information in accordance with these Terms and Conditions and its privacy policy available at http://www.bne.com.au/privacy-policy.
6. Incomplete, indecipherable or illegible entries will be deemed invalid.
7. All entries become the property of the Promoter.
Duration of promotion
8. The promotion commences at 10:00am AEST on Thursday, 1 September 2016 and closes at 11:59pm AEST on Wednesday, 31 October 2016 (Promotion Period).
How to enter
9. To enter, individuals must, during the Promotion Period, complete the online entry form at http://competitions.bne.com.au (Promotion Page), provide a valid email address and agree to the Terms and Conditions on the Promotion Page.
10. An individual may enter this promotion only once except where that individual qualifies for a Bonus Entry in accordance with clause 11 below, in which case, that individual may have multiple entries.
11. An individual will earn one Bonus Entry into the promotion when they share the promotion on Facebook or by email, in each case using the process on the Promotion Page. Only one Bonus Entry per day can be earned.
Prize details
12. The first valid entry drawn will win 2 x return economy class flights from Brisbane to Amsterdam, flying Cathay Pacific valued at up to AU $5,000 (Prize).
13. Prize tickets are for air tickets only and are not transferable, non-negotiable, non re- saleable and have no cash redemption value.
14. The winner and their companion must depart and return at the same time and from the same location.
15. No additional frequent flyer points, including but not limited to Asia Miles, will be awarded to these promotional fares.
16. Travel must be taken at the time specified by Cathay Pacific. If a winner and travelling companion are, for whatever reason, unable to travel on a nominated date, or do not take an element of the prize within the time stipulated by Cathay Pacific then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.
17. Air tickets are available on the regular scheduled services of Cathay Pacific over the specified routing and in the class of travel stated. Tickets are valid for one year from the point of awarding the prize and bookings must be made with Cathay Pacific within 2 months of the winner claiming their prize.
18. Tickets are subject to seasonal embargos and not valid during peak season including but not limited to Australian school holidays, Easter Holidays, Ruby 7s, Christmas/New Year and Chinese New Year periods.
19. Prizes cannot be used in conjunction with travel discounts or special offers. Any extension or variation of the travel dates requested will be at the cost and responsibility of the winner. Any requests to extend or vary travel arrangements must be made in writing and must be received and approved by Cathay Pacific. Once booked, any changes made to the booking may incur a cancellation or amendment fee, at the cost and responsibility of the winner. Changes to origin and destination is not permissible.
20. Purchase of a preferred seat or upgrade of the economy class prize ticket to the value of a Premium Economy Class or Business Class ticket is not permissible. Stop- overs are not permitted.
21. It is the traveller’s personal responsibility to ensure that they have valid documentation at their own expense, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.
22. Unless expressly stated in these terms and conditions all other expenses including but not limited to, travel to and from the event/departure point, travel insurance, visas and accommodation, become the responsibility of the winner.
23. Cathay Pacific is not responsible for any costs due to delay, cancellation or disruption of service.
24. Denied boarding compensation is not applicable.
25. Prize winners and its event organizers may be held liable to Cathay Pacific for failure to adhere to the restrictions, terms and conditions of travel applicable to their tickets or for any fraudulent use of these ticket.
26. At certain times of the year, Travel may be restricted due to heavy demand on our services. Priority is always given to passengers who have purchased a ticket. If a flight is overbooked, you may be asked to travel on a later flight or on another day. Should this occur, Cathay Pacific Airways does not accept responsibility for any loss or damages resulting from any interruption to your travel plans.
27. Each winner shall submit his/her booking requests through direct communications with Cathay Pacific’s marketing team. All bookings are subject to availability and Cathay Pacific has the final discretion as to the route, dates and suitability of the final booking.
Prize draw and notification of winner
28. The Prize will be drawn at 10.00am AEST on Tuesday, 1 November 2016 at the offices of XCOM Media, situated at Unit 1/15 Lamington Street, New Farm, Queensland 4005.
29. The winner will be drawn at random from all entries submitted.
The Prize winner will be notified by email within 2 business days of the draw and their details will be published in Brisbane Airport’s BNE Magazine.
31. The Promoter will require the winner to provide proof of age, identity and residential address, in order to claim the Prize. Proof of age, identification and residential address considered suitable for verification is at the discretion of the Promoter. If the winner cannot provide suitable proof where the Promoter has made reasonable efforts to obtain it, then in the Promoter’s sole discretion the Prize will be forfeit and no substitute will be offered and the Promoter may conduct an unclaimed prize draw.
Unclaimed prize draw
32. If the Prize remains unclaimed by 9am AEST on 1 December 2016, a re-draw will be conducted at 10.00am AEST on 5 December 2016 at the same place as the original draw subject to any directions from a regulatory authority. The winner will be notified by email within 2 business days of the re-draw and their details will be published in Brisbane Airport’s BNE Magazine.
Liability
33. The Promoter makes no representation or warranty about the fitness for purpose or merchantable quality of the Prize.
34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutoryconsumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising out of the promotion or use of the Prize.
35. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking, use of and/or participation in the Prize.
36. As a condition of accepting the Prize, the winner (and his/her companion or the companion’s parent/legal guardian if they are a minor) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter reserves the right to discontinue the promotion at any time and at its sole discretion may cancel, terminate, suspend or modify the promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as an original Prize. Any change to or cancellation of this promotion, for whatever reason, is subject to any written direction from a regulatory authority.
38. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
39. The Promoter’s decision is final and no correspondence will be entered into.
40. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner in any media for an unlimited period without remuneration for the Promoter’s promotional and publicity purposes.
41. The Promoter collects personal information in order to conduct the promotion and carry out its marketing activities and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to opt out, access, update or correct information to the Promoter.
42. By entering this competition and agreeing to the terms and conditions, entrants are agreeing to receive marketing collateral from Brisbane Airport Corporation and Cathay Pacific
43. The laws of Queensland apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Queensland.
