Entry into the Competition constitutes acceptance of these Terms. All entry instructions and prize information published by the Promoter form part of these Terms. Promotional Period 3. Competition opens at 17:00 AEST on 23rd August 2016 and closes at 17:00 AEDST on 7th October 2016 ("Promotional Period"). All times are stated using the 24 hour clock. 00:01 hrs is the start of a day and 24:00 hrs is the end of the day. Eligibility to Enter 4. This Competition is only open to “Eligible Entrants”. An Eligible Entrant is an individual who is an Australian resident aged 21 years or older. 5. Employees and their immediate families of the Promoter and its agencies associated with this Competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. How to Enter 6. To enter, Eligible Entrants must, during the Promotional Period: a. Visit the Competition entry page at www.finishsimplybrilliant.com ("Competition Website") and input the all requested information including the Eligible Entrant's full name, email address, date of birth, gender and postcode; b. Confirm agreement to these Terms; and c. Submit the fully completed entry form. 7. Each Eligible Entrant may only submit a maximum of one (1) entry during the Promotional Period. 8. Incomplete or indecipherable entries will be deemed invalid. The Prize 9. There will be one (1) prize winner who will win a trip for two (2) adults to the Barossa Valley, South Australia, valued at up to $5,300 depending on date and point of departure. The prize includes: • return economy airfares from winner's nearest Australian capital city to Adelaide, South Australia (only provided if winner resides outside of South Australia). If the winner is from South Australia, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash; • five (5) day car hire with unlimited kilometres. The driver must have a full, current and valid driver’s licence issued in an Australian State or Territory and be aged 21 years or over; • two (2) nights twin share accommodation in a minimum 4-star hotel in Adelaide for two (2) adults (exact hotel determined by Promoter); • two (2) nights twin share accommodation in a minimum 4-star hotel in the Barossa Valley for two (2) adults (exact hotel determined by Promoter); • daily hotel breakfast on a set menu for two (2) adults; • a Jacob’s Creek hands-on cooking class for two (2) adults, including the opportunity to forage for fresh produce from the kitchen garden, a lunch matched with Jacob’s Creek wine, and a Jacob’s Creek take-home apron; and • a 2-hour Murray River Riverboat Cruise for two (2) adults, including morning tea, a buffet lunch, and a visit to Melba’s Chocolate Factory (Prize). Prize Conditions 10. Spending money, additional meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 31/12/2017 and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or other peak periods. Car hire part of the Prize is subject to standard rental conditions. Petrol and insurance is not included. The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the Prize. Prize is subject to the standard terms and conditions of individual Prize and service providers. The winner may be required to present their credit card at time of accommodation check in. Prize Draw and Winner Notification 11. The draw will take place at the end of the Competition. The winner will be drawn at 12:00pm (noon) AEDST on 12th October 2016 at Handling Matters, 1/3 Green Street, Brookvale, NSW 2100 ("Major Prize Draw"). The first valid entry drawn in the Major Prize Draw will win the Prize. 20. The Competition is a game of chance. 21. The decision of the Promoter in relation to the conduct of the Competition, including the selection of the winner, is binding and conclusive and no correspondence will be entered into. 22. The winner will be announced on 14th October 2016. The winner of the Major Prize Draw will be notified via telephone and email within two (2) business days of the draw and his or her name, suburb and State/Territory will be published on www.finishsimplybrilliant.com for a period of 28 days from 14th October 2016. 23. In the event that for any reason whatsoever a winner is found to be ineligible, or does not take the Prize (or an element of the Prize) at/by the time stipulated then the Prize (or that element of the Prize) will be forfeited by the winner and cash will not be awarded in lieu of the Prize (or that element of the Prize). The Promoter may then award the Prize to an alternative winner in accordance with clause 24. 24. If required, an unclaimed prize draw may take place on 12th January 2017 at the same time and place as the original draw, subject to any directions from a regulatory authority. The new winner will be notified via email and telephone within two (2) business days of the draw and his or her name, suburb and State/Territory will be published on www.finishsimplybrilliant.com for a period of 28 days from 16th January 2017. General Conditions 25. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant. 26. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, incomplete, incomprehensible, forged, manipulated or tampered with in any way. 27. If the Prize (or part of the Prize) becomes unavailable for reasons beyond the Promoter’s control, the Promoter, in its discretion may substitute the Prize (or that part of the Prize) with a prize of equal or greater value, subject to any written directions from a regulatory authority. 28. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 29. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash, unless specified otherwise. 30. Any cost associated with accessing the Competition Website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. 31. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Terms would contravene any statute or cause any part of these Terms to be void (Non-Excludable Guarantees). Subject to the limitations in the preceding sentence, the Promoter excludes from these Terms all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) subject to any permit conditions, any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry, Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms; (e) any tax implications; and/or (f) taking/use of and/or participation in the Prize. 32. Personal information including Eligible Entrants’ full name, email address, date of birth, gender and postcode will be collected and used for the purpose of conducting this Competition (which may require disclosure to third parties, including local regulatory authorities and the Promoter’s agents and third party service providers, for the purpose of processing Prize claims and conducting the Competition) and for promotional and marketing purposes including for direct marketing (Purpose). By entering this Competition, Eligible Entrants consent to the use of their personal information and agree that the Promoter may use this information, or disclose it to other organisations or persons including overseas service providers located in New Zealand that may use it, in any media for the Purpose. Should an Eligible Entrant’s contact details change during the Promotional Period, it is the Eligible Entrant's responsibility to notify the Promoter. 35. To the maximum extent permitted by law, the Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this Competition. 36. As a condition of accepting the Prize, the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 37. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these Terms, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, unless to do so would be prohibited by law and subject to approval by the relevant regulatory authorities. 38. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
