Entry into this Competition is deemed acceptance of these Terms and Conditions. WHO CAN ENTER? 1) The Competition is open to residents of Australia aged 18 years or over except employees of the Promoter, Nine Entertainment Co. Pty Ltd and their immediate families and all companies and agencies associated with this Competition (“Entrants”). HOW TO ENTER 2) The Competition commences on Monday 28 th November 2016 at 09:00 AEDT and concludes on Tuesday 10th January 2017 at 11:59 AEDT (“the Competition Period”). 3) To enter, Entrants must, during the Competition Period: a) go online to https://www.9now.com.au/win (“Competition Website”); b) log in to their Nine account or sign up to become a Nine member and complete the necessary fields to either log in or sign up c) fully and correctly complete the Competition entry form with their details, including their full name, address, state, current and valid email address and contact telephone number; d) agree to the Competition terms and conditions; and e) submit their fully completed Competition entry form 4) Multiple entries permitted, subject to the following: one (1) entry per person per 24 hour period. 5) If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant. 6) All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the Entrant. 7) The Promoter reserves the right to verify the validity of entries at any time during or after the Competition Period, and reserves the right to disqualify any Entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 8) The Promoter and Sponsor take no responsibility should an Entrant not have internet access permitting access to and use of the Competition Website. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken. 12) Spending money will be awarded in the form of a cheque made in favour of the winner, or an EFT transfer. 13) The accommodation will be one (1) room to be shared by the winner and their travel companion. 14) The winner’s travel companion must be over the age of 18. 15) The prize is a single event trip for the winner and their travelling companion(s) (if any) and cannot be separated into separate trips or components. The winner and their traveling companion(s) (if any) must travel together. All flights for each route must be utilized at the same time, for the same travel dates, to and from the same destination. The air tickets are available on regular scheduled services of each airline and subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. All travel is subject to availability at all times. Frequent flyer points are not available from any airline. 16) Entire prize must be redeemed in April 2017, or at a date and time allocated by the Promoter, in their absolute discretion. Additional blackout dates may apply. 17) If any winner chooses not to take their prize (or is unable to) or is unavailable at the designated time for the Event or at the time stipulated by the Promoter for travel, or does not take or claim a prize by the time specified by the Promoter, they forfeit the entire prize and the Promoter is not obliged to substitute the prize. 18) The airline’s Conditions of Carriage apply to all flights. The winner and their travelling companion must travel at the same time and depart from and return to the same airport, and are responsible for transport from their residence to the winner’s nearest capital city airport in Australia. The winner and their travelling companion(s) (if any) will be responsible for making their own way to and from their departing Australian airport. These conditions apply for all flights. 19) Airfare tickets are non-transferable (ie: no name changes allowed). Any alterations to confirmed flights and/or accommodation details will be at the expense of the winner. Once the prize has been arranged, any changes to the travel, flights, accommodation or scheduling arrangements are the expense of the winner and their travelling companion(s) (if any). 20) Airline flight route and dates of travel are subject to the prize supplier’s absolute and final decision. 21) A valid passport and entry Visa of the winner and each of their travelling companion(s) (if any) is required for all international journeys. It the responsibility of the winner and their travel companion(s) (if any) to ensure they have all required travel documentation (including but not limited to passports and visas) as required for travel to the destination. All costs associated with obtaining this travel documentation is the responsibility of the winner and their travelling companion(s) (if any). 22) All components of the prize must be taken together as a package and cannot be separated into separate trips or components. The winner and their traveling companion must travel together. All flights for each route must be utilized at the same time, for the same travel dates, to and from the same destination. The Promoter is not responsible for any costs associated with the winner and/or their travelling companion(s) (if any) missing any of their flights. 24) It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay. 25) Unless specified otherwise, the winner and their travelling companion(s) (if any) are responsible for all expenses including, without limitation, transport to and from departure point including but not limited to additional domestic airfares if required, any meals or beverages, any extra sightseeing or activities, any additional accommodation, any additional transfers, any additional insurance, personal spending money, and all other ancillary costs, as well as obtaining any of these. Prize also excludes medical expenses, items of a personal nature, alcoholic beverages, optional tours not outlined, laundry, telephone calls, additional nights, room or flight upgrades, incidentals, energy surcharges, gratuities, service charges, in-room charges or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner and their travelling companion(s) (if any). Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter. 26) In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal or greater recommended retail value and/or specification. 27) The Promoter is neither responsible nor liable in the event the taping of “Kevin Can Wait” is cancelled, rescheduled or postponed for any reason whatsoever. 28) It is a condition of accepting the prize that the winner and their travelling companion(s) (if any) must comply with all the conditions of use of the prize and the prize supplier’s requirements (as applicable, including but not limited to those of the Sponsor). 29) It is a condition of accepting the prize that the winner and each of their travelling companion(s) (if any) may be required to sign a legal release or releases in a form determined by the Promoter and/or any prize supplier (including but not limited to the Sponsor) in its or their absolute discretion. 30) Individual supplier terms and conditions apply. It is a condition of accepting the prize that the winner and their travelling companion must comply with all the conditions of use of the prize and the prize supplier’s requirements. 31) The winner is advised that tax implications may arise from them winning the prize and they should seek independent financial advice prior to accepting the prize. 32) The prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable, exchangeable and cannot be redeemed as cash (unless otherwise indicated). The prize is not valid in conjunction with any other offer. 33) The Promoter and any prize supplier(s) reserve the right to request the winner and their travel companion to provide proof of age and identity. Identification considered suitable for verification is at the discretion of the Promoter and/or the relevant prize supplier(s). 34) The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. UNCLAIMED PRIZE DRAW 35) As this is an event-based prize, the Promoter may conduct such further draws at the same place as the original draw as are necessary on Monday 20th February 2017 at 10:00 AEDT in order to distribute any prize that remains unclaimed by that date, subject however to all reference to any relevant state and territory regulations. The winner, if any, of such draw will be notified in writing within two (2) business days of the draw and their name and locality will be published at https://www.9now.com.au/win 36) The use of any automated entry software or any other mechanical or electronic means that permits the Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid. 37) The Promoter is not responsible for any incorrect or inaccurate information, either caused by the user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telecommunications, telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 38) If this Competition is not capable of running as planned due to any reason whatsoever, including but not limited to, programming changes, technical failures (either in the administration of the Competition or the broadcast of the television program), unauthorised intervention, fraud or any causes beyond the control of the Promoter which corrupt or affect the conduct, administration, security, fairness or integrity of the Competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions given by a regulatory authority, to: (a) modify, suspend, terminate or cancel the Competition; and/or (b) disqualify any Entrant, as appropriate, including banning an Entrant from participating in future promotions conducted by the Promoter, for any reason including, but not limited to, behaving in any manner that is, as determined by the Promoter in its absolute discretion, deemed to be inappropriate or contrary to any broadcast codes, regulations or any applicable laws including mentioning or promoting any product, service, venture or item or using inappropriate language or saying anything that may in the producer's reasonable opinion be abusive, rude, threatening, offensive, harmful or hurtful to any other third party. 39) The Promoter accepts no responsibility for any entries not received by the Promoter or delays due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from the Entrant. 40) The Promoter reserves the right to request each winner to provide proof of age and identity. Identification considered suitable for verification is at the discretion of the Promoter. 41) If the Promoter determines that the winner has breached clause 5 of these Terms and Conditions, their entry will be deemed invalid and the prize will be forfeited and subject to the unclaimed prize draw. LIABILITY AND RELEASE 42) Except for any liability that cannot be excluded by law, the Promoter, its related entities and the Sponsor and each of their respective officers, employees and agents, exclude all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or an Entrant; (f) participation in the Competition and/or (g) redemption of the prize. 43) The Promoter and its related entities and their respective officers, employees and agents will take no responsibility for defective prizes or prizes damaged or lost in transit, or late, lost or misdirected mail.
