Terms and Conditions
Who is running the competition?
The Promoter is Accolade Wines Australia Limited (ABN 86 008 273 907), Reynell Road, Reynella SA 5161. Phone: (08) 8392 2222.

When will the competition start and end?
The competition starts at 12:00am AEDT on 04/01/17 and ends at 11.59pm (AEDT) on 17/01/17 (the Competition Period).

Who can enter?
Only Australian residents aged 18 or over who can take the prize at a time and date mutually agreed with the Promoter between 1st April 2017 and 1st April 2018 (inclusive)can enter.

Who can't enter?
Directors, officers, management and employees of:

(a) the Promoter; or
(b) the agencies or companies or participating outlets associated with this competition,
and their immediate families, can't enter.
Where will the competition run?
The competition will run in participating BWS liquor outlets (Outlets) in all Australian states and territories.

Do I need to buy anything to enter?
Yes. During the Competition Period, spend $30 or more on any participating Hardys wines in one transaction (Qualifying Purchase) for off premise consumption from an Outlet (excludes online purchases).

Entry instructions
After you have made a Qualifying Purchase, you must during the Competition Period, visit bws.com.au (Website), follow the links to the BWS 100 Days of Summer Hardys Cricket Promotion and fill out and submit the online entry form, including by uploading the Qualifying Purchase receipt and providing the unique code printed on the receipt and all other requested information.

How many winners will there be and how will they be chosen?
There will be a total of 3 winners determined in respect of this competition.

The draw will be held at 2pm (AEDT) on 27/01/17 at Level 25, 600 Bourke Street, Melbourne, Victoria 3000.

The first 3 valid entries drawn randomly from the entries received during the Competition Period will each win a prize

The Promoter may draw additional reserve entries and record them in order, in case the winning entry/entrant is deemed invalid, or a prize is unclaimed (Reserve Entrants).

What can I win?
There are in total 3 prizes available.

Each prize is a trip for two adults to Sydney, NSW, including facing an Australian Cricketer in the nets, and a gourmet lunch paired with Hardys wines, valued at up to $5,000 each depending on the winner’s point of departure.

See paragraph 3 for further prize details.

There is a limit of one prize per household (except for SA residents).


Total prize pool
The total prize pool is up to $15,000.

How many times can I enter?
You can enter multiple times, provided you only enter once per Qualifying Purchase per Qualifying Purchase transaction and per unique code. Each entry must be submitted separately in accordance with these Terms and Conditions.

How and when will the winners be informed?
If you are a winner, you will be informed by phone and by email within two days of the draw and your name and state/territory of residence will be published in on the Website on 30/01/17 for a period of 28 days.

Must I keep anything to verify my entry?
You must keep the original itemised purchase receipt(s) for all entries as proof of purchase. If you don't produce the proof of purchase for all entries when asked the Promoter may disqualify all of your entries and you will lose any right to a prize.

Purchase receipt(s) must be identical to the image uploaded by you with your entry, and must clearly identify the Outlet of purchase (which must be a participating Outlet), the product/s purchased (which must be a Qualifying Purchase), and the date of purchase (which must be during the Competition Period before you submitted your entry). If, in the Promoter's opinion, you have shared any receipt/s/unique codes with another person, your entries will be invalid and you will lose any right to a prize.

If I win, when must I claim my prize?
You must claim your prize by 11:59pm (AEDT) on 28/02/17.

What if I don't claim my prize on time?
If a prize has not been accepted or claimed by 11:59pm (AEDT) on 28/02/17 or if, after making all reasonable attempts, the Promoter can't contact the drawn winner (or the drawn winner does not contact the Promoter) by this time and date, the relevant entry will be discarded and the Promoter will re-award the relevant prize/s to Reserve Entrant/s and/or carry out an unclaimed prize draw at 2pm (AEDT) on 10/03/17 (Unclaimed Prize Draw) at the same location as the original draw to distribute the relevant prize. All entries received during the Competition Period will be combined for the purposes of this draw.

If you are a winner in the Unclaimed Prize Draw you will be informed by phone and by email within two days of the Unclaimed Prize Draw and your name and state/territory of residence will be published on the Website on 13/03/17 for a period of 28 days.

These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.
Entry
Your entry must be received during the Competition Period. Your entry is deemed to be received only when received by the Promoter’s database. If you return a Qualifying Purchase your entry may be deemed invalid at the Promoter's discretion (unless product is defective). You will receive a return online message confirming your entry. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple aliases you may be disqualified.
Prizes
If you win, your prize will be a trip for you and 1 adult companion to Sydney, NSW and includes:
(a) return economy airfares (including airfare taxes) for you and your companion from your nearest Australian capital city to Sydney, NSW (flights are not included if the winner lives in New South Wales and if so, the winner and their companion must make their own way to and from Sydney at their own cost);

(b) 2 nights' accommodation (twin share) in a minimum three star hotel (as determined by the Promoter);

(c) return transfers between the hotel and Sydney airport (not included for NSW residents);

(d) opportunity to face an Australian Cricketer (to be determined by the Promoter) in the nets at the Sydney Cricket Ground at a time and date to be determined by the Promoter (Net Session) for you and your companion;

(e) gourmet lunch paired with Hardys wines at a time, date and location to be determined by the Promoter, for you and your companion; and

(f) 3 x cab charges for travel between the hotel and Sydney Cricket Ground, Sydney Cricket Ground to lunch and from lunch to the hotel.

Accommodation, Net Sessions, lunch and flights are subject to booking and availability. The prize must be taken on dates mutually agreed with the Promoter between 1st April 2017 and 1st April 2018. Travel must be booked and completed in the time frame specified by the travel supplier. The prize cannot be taken during any block out/major event/peak/public holiday periods or any other exclusion periods as specified by the Promoter or the travel supplier/s. You and your companion are responsible for all other costs related to the prize, including any additional meals, additional transfer costs, insurance (including excesses), in-room charges and additional taxes. All persons taking the prize must depart and return at the same time. The prize is subject to any additional conditions of the travel supplier/s including any conditions of entry into the SCG (including behaviour requirements and applicable dress codes). Any failure by you or your companion to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s). Costs for changes made by you (or your companion) to the prize after it has been booked must be paid by you and your companion as applicable. You may be required to present your credit card when checking in to the accommodation.

If a winner and companion cannot attend the SCG on the date and time mutually agreed with Promoter, the Promoter will not be liable.
If the value of the lunch consumed as part of the prize is less than the value specified by the Promoter, the balance will not be provided to you and no cash or other prize will be provided in its place. Any costs incurred over the specified value must be paid by you and your companion.
If an event or activity included in the prize is abandoned, called off or postponed for any reason, you and your companion forfeit your entitlement to that prize element and you will not be given any cash or alternative tickets as a substitute for attending the event or activity. The Promoter accepts no responsibility if a Net Session is abandoned, called off or postponed for any reason and you and your companion will not be given any cash or alternative tickets as a substitute for attending the event. The winners will still receive all other components of the prize as long as they are still taken between 1st April 2017 and 1st April 2018.
The Promoter has no liability if for any reason the selected Australian Cricketer does not attend the Net Session on the date mutually agreed with the Promoter.
General
If you are a winner, you (and your companion) must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You (and your companion) consent to the Promoter using your names and images in any promotional or advertising activity.
Those participating in the Net Sessions must follow the Promoter’s instructions and full rules (which will be provided to the participants before or upon arrival at SCG). Participants must not engage in unsportsmanlike conduct or interfere with other participants (e.g. by making any contact with or distracting another participant or acting in any manner which the Promoter considers reckless or inappropriate). Participants must not consume any alcohol at a Net Session, before or after competing, and must not use any performance enhancing device or drug. The Promoter may disqualify any participant who fails to comply with the Promoter’s instructions, the event rules or these Terms and Conditions.
You and your companion accept that some aspects of the prize are inherently risky and that the prize involves dangerous activities.
In order to participate in the activities awarded as part of the prize, you and your companion must comply with any applicable conditions (e.g. height, weight, health and fitness requirements). You must ensure that you and your companion are healthy and fit enough to take the prize. You and your companion must follow all requirements of the people responsible for managing the relevant activities.
You and your companion must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the prize. If you or your nominated companion does not sign, your entry will be deemed invalid and you will lose any entitlement to a prize.
If you or your entry are deemed by the Promoter to breach these Terms and Conditions including if you are unable to take the prize between 1st April 2017 and 1st April 2018, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
You must not:
(a) tamper with the entry process;

(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;

(c) act in a disruptive, annoying, threatening, abusive or harassing manner;

(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;

(e) breach any law; or

(f) behave in a way that is otherwise inappropriate.

You are responsible for your companion/s and the Promoter may disqualify all entries from, and prohibit further participation in this competition by, you or your companion if they breach these conditions, whether or not legally bound by them.
If you (or your companion, if applicable), in the opinion of the Promoter, are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you (and your companion) from participating in any elements of the prize, at its discretion.
The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
The Promoter’s decision in connection with all aspects of this competition is final.
Prizes cannot be transferred or exchanged nor redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
By entering, you request that your full address not be published.
By accepting or participating in any prize, your companion accepts these Terms and Conditions.
If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.
The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

Liability
Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
The Promoter may communicate or advertise this competition using Facebook or Instagram. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You completely release Facebook and Instagram from any and all liability.
Collection and use of your personal information
The information you provide will be used by the Promoter for the purpose of conducting this competition. The information your companions provide will be used by the Promoter for the purpose of fulfilling the prize and otherwise administering this competition. The Promoter may collect your or your companions’ personal information (including through its contractors or agents) or disclose your or your companions' personal information to its contractors and agents to assist in conducting this competition or communicating with you or your companions. You consent to the storage of your personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products including contacting you via electronic messaging (and you consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility). You or your companions’ can update your personal information or request access to the personal information the Promoter holds about you by contacting the Promoter. All correspondence should be to the attention of the Privacy Officer. A copy of the Promoter’s privacy policy can be obtained from the Promoter or from the Promoter’s website at www.accolade-wines.com and contains information about:
a) how you or your companions can seek access to the personal information the Promoter holds about you/them and seek the correction of such information;

b) how you or your companions can complain about a privacy breach and how the Promoter will deal with such a complaint; and

c) whether your or your companions’ personal information the Promoter holds will be provided to overseas companies, and if so, in which countries those companies are located.

If you have selected the option to receive information and offers from Australian Cricket, you understand and agree that Cricket Australia also collects your personal information, including on behalf of State or Territory cricket associations, including the Big Bash League teams (together, Australian Cricket) to communicate with you, and for any of the purposes set out in Australian Cricket's Privacy Policy (available at www.cricket.com.au/privacy or by emailing privacy@cricket.com.au), and that the personal information you provide will be disclosed to and used by Australian Cricket under the terms of Australian Cricket's Privacy Policy, which contains information about how you may access and seek to correct your personal information or complain about a breach of your privacy, and how Australian Cricket will deal with that complaint. Australian Cricket may disclose your personal information to other parties, including Australian Cricket's third party service providers. From time to time, these third parties may be located (and so your personal information may be disclosed) overseas, including in India, the USA and the UK, and other countries from time to time. Australian Cricket may use and disclose your personal information for direct marketing purposes, unless you opt out (which you can do at any time in accordance with Australian Cricket's Privacy Policy), and for facilitating further offers directly from third parties if you opt in to receive those offers.
