“DORITOS WIN A GALACTIC ADVENTURE” PROMOTION

    Information on how to enter the “Doritos Win a Galactic Adventure” promotion (“Promotion”) and the prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
    The promoter is The Smiths Snackfood Company Pty Ltd (ABN 31 057 976 940) of Tower A, Level 2, 799 Pacific Highway, Chatswood, NSW 2067, telephone (02) 9951 1799 (Australia) and Bluebird Foods Limited, 124 Wiri Station Road, Manukau, Auckland 2104, telephone 09 262 8800 (New Zealand) (collectively the “Promoter”).
    Entry is only open to residents of Australia and New Zealand aged 18 years or over.
    Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    This Promotion commences at 00:01am AEST on 03/04/2017 and final entries close at 11:59pm AEST on 31/05/2017 (“Promotional Period”).
    To enter, individuals must complete the following steps during the Promotional Period:
        purchase any Eligible Product (as listed in Schedule 1) from any store in Australia or New Zealand that sells Eligible Products during the Promotional Period (“Qualifying Purchase”); and thenn
        visit www.doritos.com.au and follow the prompts to input the requested details on the entry page (including their full name, a valid email address, mobile number, date of birth, country, postcode, their full purchase receipt number and the last 6 digits of the product barcode number of the Eligible Product purchased), and submit the fully completed entry form.
    Incomplete or indecipherable entries will be deemed invalid.
    Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Eligible Product purchased; (b) each entry must be submitted separately and in accordance with entry requirements; (c) a maximum of two (2) entries permitted per person per day; and (d) a maximum of one (1) Daily Prize per person (excluding SA residents).
    Entrants must retain their purchase receipt(s) (either the original or a copy) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to any prize. Purchase receipt(s) must clearly specify the store of purchase, that an Eligible Product was purchased, and that the purchase was made during the Promotional Period but prior to entry.
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    There will be one (1) daily draw conducted for the entries received each day of the Promotional Period (each a “Daily Draw”), for a total of fifty-nine (59) Daily Draws. There will also be one (1) major draw conducted for ALL entries received during the Promotional Period (“Major Draw”). Entries into each Daily Draw will open and close each day based on NSW local time. Entries in each Daily Draw will NOT be entered into any subsequent Daily Draw(s), but all entries will be entered into the Major Draw.
    All draws will take place at Greeneagle Distribution & Fulfilment, Unit 10, 20-28 Ricketty St, Mascot, NSW 2020 at 11:00am AEST/AEDST (as applicable). Each Daily Draw will take place on the next day after entries close for that Daily Draw, with the first Daily Draw taking place on 04/04/2017 and the last Daily Draw taking place on 01/06/2017. The Major Draw will take place on 06/06/2017. The Promoter may draw additional reserve entries in each draw and record them in order in case an invalid entry or ineligible entrant is drawn.
    In the event there are no entries received for a particular Daily Draw, the prize corresponding to that Daily Draw will roll over into the next occurring Daily Draw. For example, if there are no entries received for Daily Draw 1, the prize for Daily Draw 1 will roll over into Daily Draw 2 and two (2) prizes will then be awarded in Daily Draw 2 – one (1) prize each to the first two (2) valid entries drawn in Daily Draw 2. In the event there are no entries received into Daily Draw 2 either, the prizes for Daily Draw 1 and Daily Draw 2 will both roll over into Daily Draw 3 and three (3) prizes will then be awarded in Daily Draw 3 - one (1) prize each to the first three (3) valid entries drawn in Daily Draw 3, etc.
    Winners will be notified by email within two (2) business days of the relevant draw, and their names will be published online at www.doritos.com.au from 12/06/2017 subject to validation.
    The Promoter’s decision is final and no correspondence will be entered into.
    Subject to clause 14, the first valid entry drawn in each Daily Draw will each win $500, awarded in the winner’s local currency (i.e. either AUD or NZD) and via an electronic funds transfer into an account in the winner’s name (“Daily Prize”). For the sake of clarity, Australian winners will receive AUD$500 and New Zealand winners will receive NZD$500.
    The first valid entry drawn in the Major Draw will win a trip for two (2) adults (aged 18 years or over) to Las Vegas, Nevada, USA valued at up to AU$15,000 depending on date and point of departure (“Major Prize”). The Major Prize includes:
        return economy airfares from winner's nearest capital city (if winner resides in Australia) or from the nearest of Auckland, Christchurch and Wellington (if winner resides in New Zealand) to Las Vegas, Nevada for two (2) adults;
        return airport transfers from the Las Vegas airport to the accommodation for two (2) adults;
        four (4) nights twin share accommodation in a minimum 4-star hotel in Las Vegas for two (2) adults (exact hotel determined by the Promtoer);
        select activities in as Vegas for two (2) adults (exact activities determined by the Promoter in its absolute discretion);
        travel insurance for two (2) adults;
        $1,000 spending money for the winner, awarded in the winner’s local currency (i.e. either AUD or NZD) and via an electronic funds transfer into an account in the winner’s name.
    The following conditions apply to the Major Prize: Major Prize must be taken by 31/12/2017 on exact dates determined by the winner in consultation with the Promoter, and is subject to booking and flight availability. Black out periods may apply. In the event that agreement cannot be reached between the winner and the Promoter as to the exact dates the prize is to be taken, the Promoter reserves the right to determine the travel dates. Winner must give at least 60 days’ notice prior to requested departure date. Spending money, meals, taxes (excluding airline and airport taxes), additional insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The winner and his/her companion are responsible for ensuring that they have valid passports (with a minimum 90 days validity for the duration of the trip), and any requisite visas, vaccinations and travel documentation. The winner and his/her companion must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in and winner is responsible for all incidentals. It is the responsibility of the winner and his/her companion to obtain their own travel insurance, and the Promoter will not be liable if the winner decides not to obtain travel insurance.
    The Major Prize winner and his/her companion will each be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the winner and/or companion, the winner forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter’s nominated travel insurer, including but not limited to any limitations on the covered amount.
    Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or part of a prize) at/by the time stipulated by the Promoter, then the prize (or that part of the prize) will be forfeited.
    If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
    Total prize pool value is up to AU$44,500.
    Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless specified otherwise.
    If any prize(s) remain unclaimed by 10:00am AEST on 07/09/2017, a re-draw for any such prizes will take place at 11:00am AEST on 07/09/2017 at the same place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and telephone within two (2) business days of the unclaimed prize draw and their names will be published online at www.doritos.com.au from 14/09/2017.
    Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
    Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
    The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) and its prize suppliers are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize.
    As a condition of accepting the Major Prize, the winner (and his/her companion) will be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
    The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian or New Zealand regulatory authorities. Entry is conditional on providing this PI. In addition to any use that may be outlined in their Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrants. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (see the Promoter’s Privacy Policy for details).
    The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
