TERMS & CONDITIONS OF ENTRY

1. By participating in the Mentos Strawberry Give Away (Promotion) you agree to be bound by these terms and conditions.
2. Entry is open to Australian residents aged 13 years or over. Entrants under the age of 18 must have parent/guardian consent. The entrant’s social media profile security settings must permit the Promoter to see the entry.
3. Employees of Stuart Alexander & Co Pty Ltd (ABN 43 000 058 677) of Level 3, 1 Smail Street, Ultimo, NSW 2007 (Promoter) are ineligible to enter.
4. The Promotion commences at 5:00pm (AEST) on 26 June 2017 and entries close at 11:59pm (AEST) on 30 June 2017 (Promotion Period).
5. This is a game of skill. Chance plays no part in determining the winner.
Entry, Judging and Prizes
6. To enter, you must during the Promotion Period, comment on the Mentos Australia Facebook promotional post (Facebook Post) answering the question “tell us why they’re creamy, original or sour”.
7. 40 most creative entries (as determined by our judges) will each win a Mentos prize pack consisting of 3 x Strawberry mix rolls.
8. Judging will take place at the offices of the Promoter on 4 July 2017 at 12:00pm.
9. Winners will be notified initially by return Facebook comment on the Facebook Post, requesting that the winner directly messages the Promoter to claim their prize.
10. If there is any dispute as to the identity of the poster, the prize will be awarded to the owner of the account that posted the winning comment.
11. Prize will be dispatched by 14 July 2017 via Australia Post.
12. Total prize value is approximately $156.
General
13. The Promoter’s decision is final and no correspondence will be entered into.
14. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
15. If a prize (or an element of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the prize) with another prize of equal value and/or specification, subject to any written directions from a regulatory authority.
16. If the entrant submits a photo or image (Image) within their comment on the Facebook Post, the entrant:
(a) warrants that they own all rights in the Image, or that they have been licensed the right to use the Image for the purposes of entering this competition and to grant the licence set out in clause 16(c);
(b) warrants that the Image does not depict any material which is likely to be considered obscene, defamatory or contrary to societal standards;
(c) grants the Promoter a non-exclusive, irrevocable and royalty-free licence to exercise throughout the world all rights in the Image and all other material provided by the entrant to the Promoter pursuant to this Promotion at any time, for any reason, including for future promotional, marketing or publicity purposes;
(d) unconditionally and irrevocably, consents to any act or omission which may constitute a breach or infringement of the entrant’s moral rights (as defined in the Copyright Act 1968 (Cth)) in respect of their entry (or entries) and, to the extent permitted by applicable law, waives all moral rights the entrant may have in their entry (or entries); and
(e) warrants that the entrant has complied with the Facebook terms of use.
17. Except for any liability that cannot by law be excluded, including the non-excludable guarantees under the Competition and Consumer Act 2010 (Cth), the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Promotion.
18. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these terms and conditions. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
