Terms and Conditions
1. Information on how to enter and the prizes forms part of these Terms and Conditions. Submission
of an entry is deemed acceptance of these Terms and Conditions.
2. The Promoter is SUEZ Recycling & Recovery Pty Ltd of Level 3, 3 Rider Boulevard, Rhodes, NSW
2138 (ABN 70 002 902 650) contactable by email at suezconnect@suez-env.com.au
(“Promoter”).
3. The Promotion commences at 10:00am (AEDT) Monday 04 September 2017 and closes at
05:00pm (AEDT) Wednesday 01 December 2017 (“Promotion Period”).
4. Entry is open to Australian residents aged 18 years or over who have access to a SUEZ Connect
account on the SUEZ customer portal, accessible at www.suezconnect.com.au (“Eligible
Entrant”). Employees of the Promoter and their immediate families, and agencies associated with
this Promotion, are ineligible to enter.
5. To receive a chance to win a prize an Eligible Entrant must, during the Promotion Period:
a) Complete:
i. Online payment of any of their SUEZ invoices at www.suezconnect.com.au; or
ii. An order of additional pickup online at www.suezconnect.com.au using the additional
pickup online form; and
b) Complete the entry form available at www.suezconnect.com.au/promo where the Eligible
Entrant must:
i. Complete their contact details, i.e. full name, phone number and email address; and
ii. Tick the box confirming the Eligible Entrant agrees to these Terms and Conditions after
having read them if the Eligible Entrant so agrees,
(“Eligible Entry”).
6. An Eligible Entrant may only enter in their own details to the Eligible Entry. Eligible Entrants who
provide incorrect, misleading or fraudulent information are ineligible to participate in the Promotion
and all entries of an Eligible Entrant who is reasonably deemed by the Promoter to have provided
incorrect, misleading or fraudulent information may, at the reasonable discretion of the Promoter,
be deemed invalid.
7. Incomplete, indecipherable, illegible entries or entries that don’t comply with the Entry
Requirements will be invalid. Any incorrect Eligible Entrant details submitted may render the
corresponding entry invalid.
8. Should an Eligible Entrant’s details change during the Promotion Period, it is the Eligible Entrant’s
responsibility to notify the Promoter. A request to access or modify any information for the purposes
of this Promotion should be directed to the Promoter by email at suezconnect@suez-env.com.au
or 13 13 35.
9. An Eligible Entrant may enter the Promotion as many times as an Eligible Entry is completed.
Where a business has multiple users for www.suezconect.com.au, each user is entitled to enter
the Promotion if the criteria for an Eligible Entrant and Eligible Entry is met. In the event of multiple
Eligible Entries, the Eligible Entrant is only eligible to win one (1) prize.
10. Entry into the Promotion is free except for any internet connection or charges related to the access
of www.suezconnect.com.au.
11. An Eligible Entry is deemed to be received at the time of its receipt by the Promoter and not at the
time of transmission. A determination of whether the criteria as stated in Clause 5 are met will be
at the reasonable discretion of the Promotor.
12. There are three (3) prizes types as described below (each a “Prize”):
a) First Prize: 1 x HP ProBook 450 G3 Notebook (valued at $1,199 as of 24 August 2017) (“First
Prize”). There is one (1) x First Prize to be won;
b) Second Prize: 1 x Lenovo™ Yoga Book Tablet 2-in-1 (valued at $699 as of 24 August 2017)
(“Second Prize”). There are three (3) x Second Prize to be won; and
c) Third Prize: 1 x Qi Wireless Charger Dock and Desk Stand (Triple Coil) for Mobile Phones
(valued at $54.95 each as of 24 August.2017) (“Third Prize”). There are ten (10) x Third Prize
to be won.
The Promoter confirms it has no sponsorship, endorsement or approval by, the above companies
of the Promoter’s products and/or services; and notes Lenovo™, HP and Qi are trademarks in the
United States, other countries, or both.
13. In the case of each Prize, the Prize is the device only. A Prize does not include making connection
with a service provider, payment of associated access and other charges or any other matter in
relation to a Prize.
14. The total Prize pool as at 24 August 2017 is $3,845.50.
15. Each Eligible Entry will be eligible to be entered into the Prize draws. All draws will take place at
3:00pm Tuesday 05 December 2017 at Level 3, 3 Rider Boulevard, Rhodes NSW 2138 with the
draw to occur by each Eligible Entry being placed within a box from which the Winners will be
drawn as described in clause 16 (the “Draw”).
16. A winner for each Prize will be determined as follows:
a) First Prize: The first Eligible Entry selected at the Draw;
b) Second Prize: The second, third and fourth Eligible Entry selected at the Draw; and
c) Third Prize: The fifth – fifteenth Eligible Entry selected at the Draw,
each a “Winner”.
17. In addition to selecting each of the Winners, the Promoter will select a further ten (10) Eligible
Entries at the time of the Draw numbered sixteenth to twenty-fifth (each a “Substitute Winner”).
Where a Prize has been allocated to a Winner, and the Winner does not claim that Prize in
accordance with these Terms and Conditions, the Promoter will select a Substitute Winner for
receipt of the unclaimed Prize in the order the Substitute Winner was drawn. These Terms and
Conditions will apply to that Substitute Winner as if the Substitute Winner was a Winner. This
process will continue until all Prizes have been allocated to a Winner or Substitute Winner. The
Promoter is under no obligation to award a Prize if all Winners and Substitute Winners have been
exhausted.
18. The Promoter reserves the right to verify each Eligible Entry and the details of each Eligible Entrant
(including an Eligible Entrant’s identity, age and address) through proof or identity and/or proof of
residency. Proof of identification and residency considered suitable for the verification is at the
reasonable discretion of the Promoter. In the event that the Winner cannot provide suitable proof
the Winner will forfeit the Prize in whole and no substitute will be offered.
19. The Promoter reserves the right to disqualify any Eligible Entrant who submits an Eligible Entry
that, in the reasonable opinion of the Promoter:
a) Is not in accordance with these Terms and Conditions; and/or
b) Has involved tampering with the entry process; and/or
c) Is fraudulent, misleading, deceptive, offensive, inappropriate, defamatory, damaging to the
goodwill of the Promotion or the Promoter, or is otherwise not in keeping with the spirit of the
Promotion.
20. Each Winner will be contacted by the Promoter by 5:00pm (AEST) Tuesday 12 December 2017
in writing and by phone via the email and phone number that were provided as set out in Clause
5b).i). At that time the Winner will be requested to provide an address for the Prize to be delivered
to (“Nominated Address”). The Promoter will attempt to contact each Winner a maximum of three
(3) times before 5:00pm (AEST) Tuesday 12 December 2017. Each Winner’s name will also be
published at www.suezconnect.com.au by 5:00pm (AEST) Tuesday 12 December 2017. If the
Promoter is unable to contact the Winner, it is the Winner’s responsibility to contact the Promoter
to claim the Prize. If the Winner does not communicate with the Promoter by 5:00pm (AEST)
Tuesday 13 March 2017 the Prize will be deemed forfeited and will be subject to reallocation.
21. If the Prize is posted to the Eligible Entrant at the Nominated Address and it is returned to the
Promoter the Promoter will hold the Prize for a period of three (3) months after the date of the
Draw. After this time the Promoter can use the Prize for any other purposes.
22. Prizes are not transferrable, and cannot be exchanged or redeemed for cash. Any unused portion
of the Prize is not transferable, non-refundable and non-redeemable for other goods or services
and cannot be taken as cash. Once Prizes have left the Promoter’s premises the Promoter and its
associated agencies take no responsibility for Prizes, whether damaged, delayed or lost in transit
except to the extent any damage, delay or loss if due to the negligence, or wilful misconduct of the
Promoter and/or its associated agencies.
23. The Promoter accepts no responsibility for any tax implications that may arise from the prize
winnings. Independent financial advice should be sought by the Winner.
24. All entries become the property of the Promoter.
25. Except for any statutory guarantee or warranty (express or implied) the exclusion of which from
these Terms and Conditions would contravene any statute, or cause any part of these Terms and
Conditions to be void, (“Non Excludable Condition”) the Promoter excludes from these Terms
and Conditions all:
a) Conditions, guarantees, warranties and terms implied by statute, general law or custom; and
b) Liability whether arising in tort (including, without limitation, negligence), contract or
otherwise for any personal injury or any other loss or damage (including without limitation
loss of opportunity or loss or profits) whether direct, indirect, special or consequential, arising
in any way out of the Promotion, including, without limitation, where arising out of the
following (except to the extent caused by the Promoter's breach of these Terms and
Conditions, negligence, or wilful misconduct):
i. Any theft, unauthorised access or third party interference;
ii. Any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not
after receipt by the Promoter) due to any reason beyond the reasonable control of the
Promoter;
iii. Any incorrect or inaccurate information, either caused by the Eligible Entrant or any of the
process associated with, or utilised with, this Promotion;
iv. Any technical error, or combination thereof, that may occur in the course of the
administration of this Promotion (whether or not under the Promoter’s control) including any
omission, interruption, defect, delay in operation or transmission, communications line or
telephone, mobile or satellite failure, theft or destruction or unauthorised access to, or
alteration of, entries or any variation in gift value to that sated in these Terms and Conditions;
v. Any tax implications, including any tax liability incurred by Eligible Entrant;
vi. The broadcast of any program relating to the Promotion or the publication of any material,
including statements made by any compere, staff member, journalist, other entrants or any
other person; and/or
vii. A Prize or use of a Prize.
26. Nothing in these terms affects the statutory rights of any person under The Australian Consumer
Law or any other applicable law.
27. If a Prize (or part of a Prize) is unavailable for any reason which is out of the Promoter’s control
the Promoter, in its reasonable discretion, reserves the right to substitute the Prize (or part of a
Prize) with an alternative prize (or part of a prize) to the equal or greater value unless to do so
would be prohibited by law and subject to any written directions from a regulatory authority.
28. If for any reason whatsoever beyond the reasonable control of the Promoter the Promotion is not
capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its
reasonable discretion, unless to do so would be prohibited by law, to:
a) Disqualify any entrant; and/or
b) Cancel, suspend, modify, terminate or cancel the Promotion.
29. In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any
other circumstance beyond the reasonable control of the Promoter, subject to any written directions
made under applicable State or Territory legislation, the Promoter reserves the right to either
provide an alternative Prize (including an alternative prize at an alternative date as specified by the
Promoter) to the same value as the original Prize or to cancel, terminate, modify or suspend the
Promotion.
30. The Promoter’s decision in relation to any aspects of the Promotion is final and no correspondence
will be entered into, unless it relates to a reasonable complaint by an Eligible Entrant.
31. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of
those rights. The Promoter’s legal rights to recover damages or other compensation from such an
offender are reserved.
32. The Promoter:
a) Collects and manages personal information in accordance with its Privacy Policy which is
available at www.suez.com.au. The Promoter collects personal information for the purposes
of conducting the Promotion (including to determine the Winner and provide the Prizes), to
provide any goods and/or services requested by a person involved in the Promotion and to
improve its products and services. If the Promoter is not permitted to collect such information
as described in its Privacy Policy, a person may not be eligible to engage in this Promotion;
and
b) May disclose personal information:
i) To third parties that assist in providing the Promoter’s services, running promotions
(including administering the promotion or distributing prizes) or with other companies who
provide gifts for promotions or offers; and/or
ii) In accordance with these Terms and Conditions if you are an Eligible Entrant.
Eligible Entrants should direct any request to access, update or correct information, or any
complaint about the Promoter's handling of personal information to the Promoter. Our Privacy
Policy contains further information about how to make these requests and how complaints will be
dealt with.
