The Promoter is Vicinity Centres PM Pty Ltd (ABN 96 101 504 045) as disclosed agent for the owners of Eastlands, Melbourne Corporate Office, Level 4, Chadstone Tower One, 1341 Dandenong Road, Chadstone Vic 3148. Phone: 03 6244 5222. Where will the competition run? The competition will be conducted at Eastlands, 26 Bligh Street, Rosny Park, TAS 7018 (the Centre). When will the competition start and end? The competition will run during the opening hours of the Customer Service Desk at the Centre between 01/12/17 and 12/12/17 (the Competition Period). Who can enter? Only Australian residents who are/become a member of the Centre's mailing list can enter. If persons aged under 18 years are permitted to enter, they must have their parent's/guardian's consent to enter. If a person aged under 18 years is selected as a winner, the Promoter reserves the right to award the relevant prize to the winner’s parent or guardian on the winner’s behalf. By accepting or participating in any prize on behalf of a winner, the winner’s parent or guardian accepts these conditions. Who can't enter? Directors, officers, management and employees of: (a) the Promoter; (b) the agencies or companies associated with this competition or the Promoter; or (c) the retail stores located at the Centre, and the immediate families of those people, can't enter. Entry instructions During the Competition Period, you need to: (a) visit the Customer Service Desk at the Centre and buy one or more Centre gift cards, each valued at $10 or more (Qualifying Purchase); and (b) on the same day as your Qualifying Purchase, follow the instructions specified to confirm your details on, or sign up to, the Centre's mailing list and provide all requested details in order to submit your entry into the competition. For the avoidance of doubt, you must make your Qualifying Purchase and submit your entry at the Customer Service Desk on the same day in order for your entry to be valid. How many winners will there be and how will they be chosen? There will be a total of 12 winner/s determined in respect of this competition; 1 in respect of entries received on each day of the Competition Period. There will be 12 draws in total; 1 in respect of each day of the Competition Period. Each draw will be held at 10am on the next day following each day of the Competition Period (i.e. on each day between 02/12/17 and 13/12/17 (inclusive)) at the Centre Management Office at the Centre. The Promoter may draw additional reserve entries in the draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants). What can I win? There are 12 prizes, as follows: Each prize is a Centre gift card, equivalent to the value of the Centre gift card the winner purchased to enter (or, if a winner purchased multiple Centre gift cards in one transaction to enter, they will win a Centre gift card equivalent to the highest value Centre gift card purchased in that transaction). See Prizes paragraphs below for further details on the prizes. How many times can I enter? You can only enter once per day, regardless of the value of your Qualifying Purchase/s on that day. How and when will the winners be informed? If you are a winner, you will be informed by phone and in writing within two days of determination and your name and state/territory of residence will be published on the Centre website on 20/12/17 for a period of 28 days. Must I keep anything to verify my entry? You must keep the original purchase receipt(s) for all entries as proof of purchase. If you don't produce the proof of purchase for all entries when asked the Promoter may disqualify all of your entries and you will lose any right to a prize. Purchase receipt(s) must clearly identify the retailer of purchase (which must be a Participating Retailer), the product(s) purchased (which must comprise a Qualifying Purchase), and the date of purchase (which must be during the Competition Period on the date you submitted your entry). If, in the Promoter's opinion, you have shared any receipt(s) with another person, your entries will be invalid and you will lose any right to a prize. If I win, when must I claim my prize? You must claim your prize by 5pm on 13/03/18 (Prize Claim Date and Time). What if I don't claim my prize on time? If a prize has not been accepted or claimed by the Prize Claim Date and Time, or if, after making all reasonable attempts, the Promoter can't contact a drawn winner (or a drawn winner does not contact the Promoter) by the Prize Claim Date and Time, the relevant entry will be discarded and the Promoter will re-award the relevant prize/s to Reserve Entrant/s and/or carry out an unclaimed prize draw at 10am on 14/03/18 at the same location as the original draw to distribute the relevant prize/s (in descending order of value). Entry 2 Your entry must be received during the Competition Period. Your entry is deemed to be received only when received by the Promoter’s database. Prizes 3 Prizes are subject to the terms and conditions imposed by the prize supplier, including periods of validity if relevant. 4 If the prize is tickets to an event, the prize must be taken on the event date/s, and at the location, specified. Prize attendees must make their own way to and from that location. Prize attendees are responsible for all other costs related to the prize, including any unspecified meals, transfer costs, insurance (including excesses) and taxes. The prize is subject to any additional conditions specified by the Promoter and/or prize supplier/s including any conditions of entry into the relevant event location (e.g. behaviour requirements and applicable dress codes), any conditions of ticket validity and any restrictions on ticket on-sale or transfer. Any failure by prize attendees to comply with the conditions imposed by the prize supplier/s may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier/s. Tickets can only be used once and will be deemed invalid if copied. The Promoter does not control entry to the relevant event location. If relevant, prize attendees must keep their tickets safe and the Promoter will not replace lost or stolen tickets. If a prize event or activity is abandoned, called off or postponed for any reason, the prize attendees forfeit their entitlement to that prize element and will not be given any cash or alternative tickets as a substitute for attending the event or activity. If a person taking an event prize is under 18 years old at the date of departure they must be accompanied by their parent or guardian at all times. 5 If relevant for the prize you win, you must arrange any desired mobile/data plans, arrange installation, and pay all costs of using the prize. General 6 If you are a winner, you and your companion/s (if applicable) must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You and your companion/s consent to the Promoter using your names and images in any promotional or advertising activity. 7 Winner/s and companion/s (if applicable) accept that some aspects of some prizes may be inherently risky and involve dangerous activities. 8 If relevant, in order to participate in activities awarded as part of a prize, winner/s and companion/s (if applicable) must comply with any applicable conditions as specified (e.g. height, weight, health and fitness requirements). Winner/s must ensure that they and their companion/s are healthy and fit enough to take the prize. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights. 13 You must not: (a) tamper with the entry process; (b) engage in any conduct that may jeopardise the fair and proper conduct of the competition; (c) act in a disruptive, annoying, threatening, abusive or harassing manner; (d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the retailers, agencies or companies associated with this competition; (e) breach any law; or (f) behave in a way that is otherwise inappropriate. 14 The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted. 15 The Promoter’s decision in connection with all aspects of this competition is final. 16 Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities. 17 By entering, you request that your full address not be published. 18 By accepting or participating in any prize, a winner's companion accepts these Terms and Conditions. 19 If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the relevant state/territory gaming authorities. 20 The Promoter is not responsible for any tax implications arising from you winning a prize. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values. Prizes will only be delivered to addresses in Australia. 24 The Promoter may communicate or advertise this competition using Facebook or Instagram. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You completely release Facebook and Instagram from any and all liability. Collection and use of your personal information 25 The information you provide will be used by the Promoter for the purpose of conducting this competition and communicating with you as a member of the Centre's mailing list. By entering this competition and being a member of the Centre's mailing list, you consent to the storage of your personal information on the Promoter’s database and the Promoter may use this information for future competition and marketing purposes regarding the Centre, including contacting you via electronic messaging. By entering this competition and being a member of the Centre's mailing list, you consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility.
