Information on how to enter and prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions. Promotion is open to residents of Australia who are 18 years and over. This Promotion is limited to off-premise outlets in Australia, such as a bottle shop or other packaged alcohol retailer, that have been invited by the Promoter to participate ("Participating Outlets"). 4. The following persons are ineligible to participate: a. directors, management and employees (and their respective Immediate Families) of the Promoter; b. retailers, suppliers, associated companies and agencies of the Promoter who are associated with this Promotion, including the Participating Outlets and their directors, management and employees (and their respective Immediate Families). Immediate Family means any one of the following: spouse, ex-spouse, defacto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. 5. The Promotion commences at 10.00 AEDT on 05/02/2018 and closes at 23.59 AEDT on 08/04/2018, or earlier for a particular Participating Outlet, if stocks of Promotional Products, each being a specially marked 24-pack carton of Heineken beer with a unique code, are exhausted at that Participating Outlet ("Promotional Period"). 6. To enter, eligible persons must, during the Promotional Period: a. purchase any Promotional Product from a Participating Outlet (an "Eligible Purchase"); b. locate the unique code (found on the inside of the packaging for each Promotional Product) ("Promotional Code"); and a. visit heineken.com.au/F1 ("Promotional Website") to access the online entry form and: i. fully complete all sections of the entry form, including by entering the entrant's first and last name, postal address (including suburb, State or Territory and postcode), email address, date of birth, mobile number and the Promotional Code; ii. consent to receive marketing communications from Heineken; and iii. electronically submit the entry form. 7. Maximum of one (1) entry per person per day. Each Promotional Code is unique and may only be submitted once. 8. An entry must be received by the Promoter by 23.59 AEDT on 08/04/2018 or it will not be accepted. Entries are deemed to be received at the time of receipt by the Promoter, not at the time of electronic transmission by the entrant. 9. The Promoter takes no responsibility should a person not have the software, hardware or mobile plan that permits access to, and use of, the Promotional Website. Any costs associated with accessing the Internet, downloading data on a mobile device, or using any device to access and use the Promotional Website is the sole responsibility of the entrant and is dependent on the Internet/mobile service provider used. 10. All entrants must retain a clear copy of their original receipt as proof of an Eligible Purchase during the Promotion Period. 11. There will be a maximum of 225,500 Promotional Codes distributed and one (1) Prize to be won. 12. The Prize is one (1) overseas trip to São Paulo – Brazil OR Monza – Italy, at the election of the winner, for the winner and one (1) guest who is an Australian resident aged 18 years or over chosen by the winner ("Travel Guest"), comprising, for the winner and the Travel Guest: a. if the winner elects to go to São Paulo – Brazil: i. return premium economy flights (including a connecting flight between London and São Paulo which is economy only) from the winner's nearest capital city to São Paulo International Airport up to the value of RRP = $10,500.00; ii. airport to accommodation transfers up to the value of RRP = $600.00; iii. accommodation for seven (7) nights, twin share, in a minimum 4 star hotel up to the value of RRP = $6,000.00; iv. $2,000.00 worth of spending money (for the winner only) deposited into the winner's nominated valid Australian bank account; and v. either: • Grandstand tickets to FIA Formula One World Championship in São Paulo on 09/11/2018 to 11/11/2018; or • if travel is taken outside of the dates of the FIA Formula One World Championship in São Paulo (being 09/11/2018 to 11/11/2018), the prize winner may determine one replacement premium experience, up to the value of RRP $4,000.00; (Total maximum RRP $23,100) OR b. if the winner elects to go to Monza – Italy: i. return premium economy flights (including a connecting flight between London and Milan which is economy only) from the winner's nearest capital city to Milan International Airport up to the value of RRP = $13,500.00; ii. airport to accommodation transfers up to the value of RRP = $600.00; iii. accommodation for seven (7) nights, twin share, in a minimum 4 star hotel up to the value of RRP = $6,000.00; iv. $2,000.00 worth of spending money (for the winner only) deposited into the winner's nominated valid Australian bank account; and v. either: • Grandstand tickets to FIA Formula One World Championship in Monza on 31/08/2018 to 02/09/2018; or • if travel is taken outside of the dates of the FIA Formula One World Championship in Monza (being 31/08/2018 to 02/09/2018 ) the prize winner may determine one replacement premium experience, up to the value of RRP = $4,000.00. (Total maximum RRP $26,100.00) 13. Prize valued at maximum RRP of $26,100.00. 14. All costs not expressly listed in paragraph 12 above, including but not limited to taxes (excluding GST), fuel, frequent flyer points, passports, visas, vaccinations, meals and beverages (unless specified), in-room changes, transfers (unless specified), travel and other insurance, incidentals, items of residential address of the winner or the Travel Guest and Sydney International Airport, either at departure or upon return. 16. It is a condition of accepting the Prize that the winner and the Travel Guest arrange, at their own expense, valid travel insurance with the highest available coverage for their period of travel that includes medivac and emergency relocation cover. The winner and the Travel Guest must provide evidence of appropriate travel insurance prior to the winner and the Travel Guest availing of, or participating in, any element of the Prize. The winner and the Travel Guest are also solely responsible for ensuring that they have any necessary travel documentation. 17. All travel, accommodation and activities are subject to availability at all times. Travel may be dependent on select seat class with airlines or specific room category availability with accommodation partner. The Promoter may refuse any requested changes. The winner and the Travel Guest will be solely responsible for the payment of any change, amendment or cancellation fees incurred as a result of the winner and/or the Travel Guest changing or cancelling a booking. Any unclaimed or unused portions of the Prize will be forfeited. All travel arrangements must be made by the winner via PMG Media Pty Ltd (ABN 12 081 343 259) (phone (02) 9357 6477) or its agent. Travel must be taken and completed by 03/04/2019 or otherwise Prize will be deemed to be forfeited. Travel cannot be taken between 20/12/2018 to 10/01/2019 and 22/02/2019 to 08/03/2019. All bookings must be made a minimum of [20*] days in advance of requested departure dates. The winner and the Travel Guest may be required to present a credit card at time of accommodation check in to the accommodation that will be used to charge for incidentals (such as optional activities) and/or as a bond in case of damage to the property. 18. The winner must immediately provide a copy of these Terms and Conditions to the Travel Guest. By agreeing to participate in the Prize, the Travel Guest agrees to be bound by these Terms and Conditions in the same manner, and to the same extent, as the winner. 19. The Prize draw will take place at 13:00 AEST on 09/04/2018 at Traction Digital Pty Ltd, Level 1, 100 Harris Street, Pyrmont, NSW 2009 ("Traction Digital"). The first (1) valid entry drawn will receive the Prize. The winner will be determined at random by an electronic draw process. 20. The Prize winner will be notified by telephone and email within two (2) days of the draw and the name and suburb of the winner of the Prize will be published in The Australian on 14/05/2018. The notification will include instructions on how to accept the Prize (which will include a requirement for the winner to nominate a valid Australian bank account). 21. The Prize winner must accept and claim the Prize, in accordance with the instructions referred to in paragraph 20 above, by 12.59 AEST on 21/05/2018, or else he or she will be taken to have forfeited his or her right to any Prize. 22. The Promoter will make all reasonable attempts to identify and contact the Prize winner. 23. In the event that the Prize winner cannot be identified or contacted by 12:59 AEST on 21/05/2018, despite all reasonable attempts to do so by the Promoter, or the Prize is unclaimed by that time for any other reason whatsoever (including because the winner has forfeited his or her right to the Prize, the winner does not accept and claim the Prize in accordance with paragraph 20 above, the winner or the winning entry does not comply with these Terms and Conditions, or otherwise), the Promoter will conduct a second chance draw on 23/05/2018 at 13:00 AEST at Traction Digital in order to distribute the unclaimed Prize. 24. The second chance draw winner will be notified by telephone and email within two (2) days of the second chance draw and the name and suburb of the winner of the Prize will be published in the Australian on 30/05/2018.The notification will include instructions on how to accept the Prize (which will include a requirement for the winner to nominate a valid Australian bank account). 25. The second chance winner must accept and claim the Prize, in accordance with the instructions referred to in paragraph 24 above, by 12.59 AEST on 06/06/2018 or else he or she will be taken to have forfeited his or her right to the Prize. 26. The Promoter will make all reasonable attempts to identify and contact the second chance Prize winner. 27. In the event that the second chance Prize winner cannot be identified or contacted by 12.59 AEST on 06/06/2018 despite all reasonable attempts to do so by the Promoter, or the Prize is unclaimed by that time for any other reason whatsoever (including because the second chance winner has forfeited his or her right to the Prize, the second chance winner does not accept and claim the Prize in accordance with paragraph 24 above, the second chance winner or the second chance winning entry does not comply with these Terms and Conditions, or otherwise), the Promoter may dispose of the Prize as it sees fit (subject to any written directions from a regulatory authority). 28. All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner. 29. Before the Prize is awarded, the winner and the Travel Guest will be required to sign an agreement to release the Promoter (and one or more of the service providers or Prize suppliers associated with the Promotion) from, and indemnify the Promoter (and one or more of the service providers or Prize suppliers associated with the Promotion) against, any loss, damage or injury arising from the use or participation in the Prize, except to the extent any loss, damage or injury is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law. 30. Redemption, participation in and acceptance of the Prize is subject to the terms and conditions of the relevant airlines and hotel, and any other service provider or Prize supplier associated with the Promotion. The Promoter and all service providers and Prize suppliers associated with the Promotion expressly reserve the right to eject the winner and the Travel Guest for any inappropriate behaviour while participating in any element of the Prize. 31. Prizes are not transferable and are not redeemable for cash. No part of a Prize can be resold (at a premium or otherwise), advertised or offered for resale on the internet or any other medium. Stated Prize values are the recommended retail value (including GST) in Australian dollars, are provided by the supplier and are correct at the time of printing. 32. If any Prize, or component thereof, becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a Prize, or component of a Prize, of equal or greater RRP value, subject to any written directions from a relevant regulatory authority. Winners will not be entitled to any additional compensation in the event that the Prize (or component thereof) has been substituted at equal or greater RRP value. 33. To the extent permitted by law, the Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury in connection with the conduct of the Promotion whether as a result of: a. any late, lost or misdirected entries or other communications; or b. any Internet traffic congestion or problems with, or technical malfunction of, any hardware or software, including but not limited to any damage to the hardware or software of any entrant or other persons related to participation in the Promotion. The decision of the Promoter is final and binding; no correspondence will be entered into. 34. To the extent permitted by law, the Promoter (including its officers, employees and agents) will not be responsible for any acts of god, acts of terrorism or war (declared or undeclared), state of emergency, disaster, technical failures, security breaches, tampering, unauthorised intervention, fraud, computer viruses or other events beyond the Promoter’s control which affect the proper or reasonably anticipated conduct or administration of the Promotion, or prevent the awarding of a Prize in accordance with these Terms and Conditions. If such an event occurs, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a relevant regulatory authority. 35. Nothing in these Terms and Conditions limits, excludes or modifies the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth), or any other implied warranties under any legislation in Australia. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury or any loss or damage (whether direct, indirect, special or consequential) arising in any way out of the Promotion, including but not limited to where such injury, loss or damage arises out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant or a winner; (f) participation in the Promotion or any component of the Prize by an entrant or a winner; (g) the conduct, act or omission of a Participating Outlet or any other service provider or Prize supplier associated with the Promotion; (h) cancellation or postponement of any portion of the Prize for any reason beyond the reasonable control of the Promoter; or (i) any decrease in the number of Participating Outlets due to a cause beyond the reasonable control of the Promoter. 36. The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this Promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any conduct that involves manipulating, interfering or tampering with this Promotion or otherwise preventing the conduct of the Promotion as intended by the Promoter. Entries are void if stolen, forged, mutilated or tampered with in any way. 37. Entrants will be refused service of alcohol or provision of an alcoholic beverage product including refusal for the entrant to make an Eligible Purchase if it would breach any relevant laws, codes or policies including those of the relevant liquor licensee relating to the responsible service of alcohol. The Promoter supports the responsible service of alcohol. 38. Entrants consent to the Promoter using their name, image, entry, and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter. 39. Entries remain the property of the Promoter. Details from entries will be collected and used for the purpose of conducting this Promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the Promotion) and for promotional purposes surrounding this Promotion. By entering this Promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant.
