months after the end of the Promotion Period  1. Any capitalised terms used in these Terms and Conditions have the meaning given in the Schedule. The Schedule forms part of these Terms and Conditions.
2. By participating in the Promotion, all entrants acknowledge that they have read, understood and agree to be bound by these Terms and Conditions.
3. The Promotion commences on 8 August 2022 at 12.00am AEST and ends on 4 September 2022 at 11.59pm AEST or until all Gifts are exhausted, whichever is sooner (Promotion Period).
4. This Promotion is only open to Australian residents who are 18 year of age or over (Entrant).
5. Employees (and the immediate family members) of the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. “Immediate family members” includes spouse, ex-spouse, de- facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step- brother, step-sister or first cousin.
6. To enter the Promotion and receive a Gift, an Entrant must make a one (1) Qualifying Transaction during the Promotion Period (Entry).
7. Upon submitting an Entry, the Entrant will receive a one (1) scratch card. If a scratch card is not immediately provided, the Entrant must request a scratch card.
8. The Entrant must scratch the play area on the scratch card to instantly reveal what Gift they have won. Entrants will be shown the Gift they have won immediately upon scratching the scratch card.
9. All Entrants who make an Entry will receive a Gift. The Gift awarded to the Entrant is determined by chance.
10. There are 2,647 scratch cards available in QLD and 980 in WA during the Promotion (3,627 in total).
11. Entrants must retain their original itemised receipt/s and scratch cards to verify each Entry, identify where the Qualifying Transaction was made, the product/s purchased and the date the Qualifying Transaction was made.
12. Entrants are limited to one (1) Entry per Qualifying Transaction.
13. If the Fulfilment Point of a Gift is the Tommy Gun’s Original Barbershop Store, then the Entrant must present their scratch card at the Tommy Gun’s Original Barbershop Store where the Qualifying Transaction to claim their Gift.
14. If the Fulfilment Point of a Gift is the Warehouse, then the Entrant must:
a. visit the URL noted on the play area of the scratch card; and
b. follow the prompts and submit all requested details to claim the Gift, including any unique code noted their scratch card, full name, email address, phone number and address details (Online Redemption).
15. When the Promoter receives a valid Online Redemption which is verified and accepted by the Promoter, the Promoter will deliver the relevant Gift to the Entrant at the address noted on the Online Redemption within 28 days.
16. The Promoter takes no responsibility for an incorrect email, mobile number or address being provided by the Entrant when the Online Redemption is submitted. When the Gift is dispatched the Promoter, the Promoter is not liable for any Gift that has been lost, stolen, damaged or tampered with in any way.
17. All Gifts must be accepted and claimed by the Claim Date. If a Gift is not claimed by the Claim Date, the Gift will be forfeited and Entrants will not be entitled to a Gift.
18. Any Gifts not claimed by Entrants by the Claim Date, including any Gifts which have not been awarded during the Promotion Period, will be subject to an unclaimed prize draw conducted by the Promoter.
19. The Promoter reserves the right, at any time, to verify the validity of Entry’s and Entrants (including the Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
20. Gifts are not transferable, deferrable, exchangeable or redeemable for any other product and cannot be taken as cash. If the Gift is not fulfilled for any reason, then the Gift is forfeited.
21. If a Gift (or portion of a Gift) is unavailable, the Promoter reserves the right to substitute the Gift (or that portion of the Gift) to a Gift of equal or greater value and/or specification, subject to any written directions of a regulatory authority.
22. The value of the Gift pool for Entries made in QLD is $30,197.47 (inclusive of GST).
23. The value of the Gift pool for Entries made in WA is $10,962.49 (inclusive of GST).
24. The value of the Gift is accurate and based upon the recommended retail price of the Gifts (inclusive of GST) at the start of the Promotion Period. The Promoter accepts no responsibility for any variation in the value of the Gifts after that date.
25. If required by the Promoter, the Entrants agree to participate in any promotional activities associated with the Promotion. The Entrants agree to the Promoter using their name, likeness and image for any purpose related to the Promotion in any media worldwide for an unlimited period. The Entrant will not be entitled to any consideration of compensation for such use.
26. The Promoter reserves the right to disqualify Entrants and Entries in the event of non- compliance with these Terms and Conditions. Where there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each Entrant.
27. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant who tampers or interferes with the entry process; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
28. Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies under the Competition and Consumer Act 2010 (Cth) that cannot be excluded, restricted or modified.
29. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim, entry or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Gift value specified in these Terms and Conditions; (e) any tax liability incurred by an entrant; or (f) use of a Gift.
30. By participating in the Promotion, the Entrant consents to the Promoter collecting personal information of Entrants in order to conduct the Promotion and may, for this purpose, disclose that information to third parties, including but not limited to related bodies corporate, associates, agents, contractors, service providers, prize suppliers and regulatory authorities. The Promoter may use that information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. Entrants should direct any request to access, update or correct information to the Promoter.
31. Any part of these Terms and Conditions that is illegal, void or unenforceable may be severed, and the remainder will continue in force.
32. Failure by the Promoter to enforce any of its rights at any stage does not constitute
