FOSTER’S GROUP – LINDEMANS
HARVEST CLUB AUGUST – SEPTEMBER COMPETITION TERMS AND CONDITIONS

   1. Information regarding prizes and how to enter forms part of these Terms and Conditions. By entering, entrants accept these Terms and Conditions.
   2. Entry is open only to Australian residents aged 18 years or over who are Harvest Club (Club) members. Continued participation in the Club is subject to the Club Terms and Conditions.
   3. The competition begins at 9am AEST on 23/08/10 and closes at 6pm AEST on 30/09/10 (Competition Period).
   4. To enter, Club members must, during the Competition Period:
         1. log-in to www.harvestclub.com.au (Website) and follow the links to the online entry form; and
         2. fully complete and submit the online entry form accompanied by a 25 words or less statement describing their dream indoor home makeover.
   5. Entrants may only enter this competition once.
Valid entries (including “25 words or less” statements) or parts thereof will be uploaded to the Website for the public to view at the discretion of the Promoter. The Promoter reserves the right not to upload any part of an entry onto the Website and the Promoter will have no liability to entrants in taking any such measure. By entering, entrants acknowledge that their entry (or part thereof) may be made available online and may be accessible to the general public.
   6. All valid entries will be individually judged by representatives of the Promoter based on, among other things, literary and creative merit.
   7. The best valid entry, as determined by the judges, from all entries received will win a $500 Gift Voucher courtesy of Come Inside Homewares Online.
   8. The second best valid entry, as determined by the judges, from all entries received will win a $200 Gift Voucher courtesy of Come Inside Homewares Online.
   9. The third best valid entry, as determined by the judges, from all entries received will win a $75 Gift Voucher courtesy of Come Inside Homewares Online.
  10. Gift Vouchers may only be redeemed at www.comeinside.com.au in accordance with any terms imposed by Come Inside Homewares Online. Gift Vouchers are not redeemable for cash. If a Come Inside Homewares Online order placed by a winner exceeds the value of that winner’s Gift Voucher, the balance must be paid for by the winner in a form of payment permitted by Come Inside Homewares Online. Gift Vouchers and unused portions of Gift Vouchers expire one year from the date of issue or on the earliest date permitted under applicable law, whichever occurs later.
  11. Winners are responsible for any shipping or delivery charges incurred when redeeming their Gift Voucher with Come Inside Homewares Online.
  12. The judges’ decisions are final, and winners cannot request to change the prize they are awarded.
  13. The winning entries will be announced on or before 3pm AEST 08/10/10.
  14. The winners will be notified by email and published on the Website. Prizes will be sent to each winner’s nominated Australia Post registered postal address (not a PO Box address).
  15. Entries must be received by the Promoter during the Competition Period. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. Entrants are responsible for their own costs associated with accessing the Internet. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entries are deemed to be received at the time of receipt into the Promoter’s database, not the time of transmission by the entrant. Entrants who enter using multiple postal addresses, email addresses or aliases may be disqualified.
  16. This competition is a game of skill. Chance plays no part in determining the winners of each competition. The judges’ decisions are final and no correspondence will be entered into.
  17. Each entry, including the relevant 25 words or less statement, becomes the property of the Promoter and will not be returned to the entrant. Each “25 words or less statement” must be the entrant’s original work. By entering this competition entrants:
         1. consent to the Promoter making copies of or publishing the whole or any part of their entry and otherwise exploiting the entry and any rights in relation to the entry, to publicise this competition or for any other purpose; and
         2. undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party rights (including intellectual property rights) or any laws.
  18. Once submitted, entrants cannot alter or delete their entry.
  19. The Promoter, in its absolute discretion, may edit any part of an entrant’s entry. By entering, entrants agree to the Promoter editing, amending or otherwise varying the whole or any part of their entry.
  20. The Promoter may at any time reject and/or remove from access by the public or disqualify or invalidate any entry that it considers (in its sole judgment) infringes these Terms and Conditions or is otherwise inappropriate. The Promoter will have no liability to entrants if this occurs.
  21. The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge and they consent to the Promoter using their name and image in promotional material.
  22. If a winning entry is deemed not to comply with these Terms and Conditions, the non-complying entry will be discarded and a new winner of the relevant prize will be determined by selecting the next best valid entry (as determined by the Promoter in its sole discretion).
  23. The Promoter may require winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
  24. Prizes are not transferable or exchangeable and cannot be redeemed for cash. If a prize, or an element of a prize, is unavailable for any reason, the Promoter may substitute for that prize or that element another item of equal or higher value as determined by the Promoter.
  25. Each prize must be claimed by 31/10/10. If a prize remains unclaimed by that date, that winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the prize to the next best valid entry of the relevant competition.
  26. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.
  27. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  28. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
  29. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  30. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. A full version of the Guidelines is available at http://www.nhmrc.gov.au/_files_nhmrc/file/publications/synopses/ds10-alcohol.pdf.
  31. The information entrants provide is collected and used by the Promoter in accordance with the Club’s privacy policy and the Club’s Terms and Conditions and for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
  32. The Harvest Club is conducted for Foster’s Australia Limited by Foster’s Wine Estates Limited ABN 55 004 094 599 trading as ‘Lindemans Hunter Valley’ (Promoter). Offers are made and liquor supplied under its NSW Packaged Liquor Licence No. LIQP700356448.
