TERMS AND CONDITIONS FOR WIN $1,000 DINING EXPERIENCE AT GAMBARO RESTARANT.
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this "Win $1,000 Dining Experience at Gambaro Restaurant" Promotion ("Promotion") is deemed acceptance of these Terms and Conditions.
ELIGIBILITY
2. Subject to condition 3, this Promotion is only open to Australian residents.
Entrants under 18 years old are not permitted to enter this Promotion. The Promoter reserves the right to ask customers for valid proof of age identification.
3. The following are ineligible: (i) Employees of the Promoter, or any of the Promoter's agencies that are associated with the Promotion; (ii) the spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iii) any person who the Promoter has previously notified is not permitted to enter the Promoter's promotions.
PROMOTION PERIOD
4. This Promotion commences at 9.00am Australian Eastern Standard Time ("AEST") on Friday 21st September, 2012 and ends at 12pm midnight Australian Eastern Standard Time ("AEST") on Tuesday 20th November, 2012 ("Promotion Period").
HOW TO PARTICIPATE
5. The Promotion will be conducted via the Gambaro's Restaurant and Function Centre website located at
www.gambaros.com.au ("Website").
6. To participate in this Promotion, eligible individuals must, during the Promotional Period, visit the VIP Membership page on
www.gambaros.com.au and submit all required information fields including name, email address, postcode and mobile phone number. Individuals that submit their details will join the VIP membership database, and will automatically be included in the chance to win the Prize.
7.The Promoter does not charge a fee for entering into the Competition. However, costs of accessing the internet and the Website is the entrant's responsibility and may be dependent on the internet service provider used.
LIMITS ON ENTRY/PARTICIPATION
8.
Only one (1) entry per person permitted, and must be in accordance with the entry requirements.9. Multiple and varied entries per person will not be accepted. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted from that source and by those entrants invalid.
10. All entries must be received within the Promotion Period. Entries are deemed to be received at the time they are received by the Promoter's database and not at the time of submission by the entrant. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible,
corrupted or misdirected entries, claims or correspondence due to error, omission, tampering,
deletion, theft, and communications failure or otherwise. The Promoter has no control over
communications networks and is not liable for any problems associated with them due to traffic
congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of
user error including (without limitation) costs incurred.
11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants
(including an entrant's identity, age and place of residence) and to disqualify any entrant who
submits an entry that is not in accordance with these Conditions or who tampers with the entry
process.
DRAW DETAILS
12. The draw will take place at Gambaro's Restaurant & Function Centre, 33 Caxton Street, Petrie
Terrace Brisbane 4000, at 11.00am AEST on Wednesday 21st November 2012.
13. A provisional winner will be randomly selected from the group of members contained in the
database as at 12.01am on Wednesday 21st November, 2012.
WINNER NOTIFICATION
14. The provisional winner will be notified by mobile phone and email. A provisional winner will only
be deemed a winner once verified by the Promoter. The provisional winner must respond within
seven working days to claim their prize. Failure by a winner to claim their prize within seven days will
result in a new winner being determined in accordance with these Conditions. If the Promoter is
unable to contact the winner within seven working days to claim fulfilment of the prize, that winner
will forfeit the prize in its entirety and it shall be awarded to next best valid entry selected. The
Promoter will not be liable for a winner that cannot be contacted within this time and no
correspondence will be entered into.
15. The winner will have their name and suburb published on
www.gambaros.com.au commencing
on 21/11/12.
16. The winner that accepts the prize agrees, at the Promoter's request, to participate in any and all
promotional activity (such as publicity and photography) involved in the winning of any prize, and
they consent to the Promoter using their name and image in promotional material relating to the
Promotion.
PRIZE DETAILS
17. The first (1) valid entry draw will win a $1,000 dining experience at Gambaro's Restaurant. The
prize will be awarded as a gift certificate to the value of $1,000, that will be available for redemption
from the date the winner receives the voucher, valid for up to 12 months.
18.
The total voucher value must be redeemed in one sitting, and cannot be spread across multiple
dining occasions. The voucher cannot be used in Gambaro Function Centre, only in the Restaurant
and only during normal trading hours.
19. The voucher can be used to order both food and beverage items from the current restaurant menus at the time of redeeming the voucher. The voucher cannot be used to order beverages only.20. If any item on the current menu (or part of any menu item) is unavailable due to reasons beyond the control of the Promoter, the Promoter at its discretion, reserves the right to substitute the item with an item of equal value and/or specification.
21. Dining reservations are recommended and may be limited based on availability.
22. The prize is non-transferable, non-refundable, non-exchangeable, non-replaceable and non-redeemable for cash.
23. Any ancillary costs associated with redeeming the $1,000 dining voucher at Gambaro Restaurant are not included.
GENERAL
24. Incomplete, indecipherable or illegible entries will be deemed invalid.
25. All fields of the entry form must be completed to be a valid entry.
26. If there is a dispute as to the identity of an entrant, including their age, the Promoter reserves the right, in its sole discretion to determine the identity of the entrant.
27. Some items on the current menu may be unavailable due to reasons beyond the control of the Promoter. Only items available can be ordered at the time of redeeming the dining voucher.
28. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
29. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant, or (b) subject to any written directions from a regulatory authority to modify, suspend, terminate or cancel the Promotion, as appropriate.
30. The Promoter's decision is final and no correspondence will be entered into.
31. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees").
32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence) for any personal injury, or any loss or
damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether received by the Promoter or not) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant or winner; or (f) use of the prize.
PRIVACY
33. In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Gambaro database. The Promoter may for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes,
including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored at the office of the Promoter. Upon the entrant's request, all information provided will be removed from our active database. To request details to be removed, please write to the Promoter, or use the unsubscribe function in emails.
