HOOROO SECRET SPOTS PROMOTION
CONDITIONS OF ENTRY AND VOTING Information on how to enter and vote, mechanics of Entry and voting and prizes form part of these Conditions of Entry and Voting. Entry into the promotion is deemed acceptance of these Conditions of Entry and Voting. Entry is via Internet only.
All times in this document are expressed in 24 hour time. References to 12 midday and any time between 12 midday and 1pm will start with "12". Any references to 12 midnight and any time between 12 midnight and 1am will start with "00".
The promoter is Hooroo Pty Ltd (ABN 32 152 774 457) of Level 8, 241 O'Riordan Street, Mascot, NSW 2020, Australia (Promoter).
ENTRANT ELIGIBILITY
Entry is only open to residents of Australia aged 18 years or older who, in the event that they are a winner of the Major Prize or a Minor Prize, are able to participate in the Major Prize or Minor Prizes (as applicable) as set out in Conditions 19, 20 and 23 (Entrants). The directors, management and employees, contractors (and their immediate families) of the Promoter, participating stores, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
PROMOTIONAL PERIOD
The promotion starts at 10:00 AEDST on Tuesday 13th November 2012 and ends at 17:00 AEDST on Wednesday 28th November 2012 (Promotional Period).
HOW TO ENTER
To enter, Entrants must, during the Promotional Period:
visit the Hooroo page on Facebook (
http://www.facebook.com/hooroo) (Promotional Page);
'like' the Promotional Page. Entrants who have previously 'liked' the Promotional Page will not be required to complete this step. For the avoidance of doubt, to 'like' in this context means to click on the 'like' icon on the Promotional Page;
access the "Secret Spots" promotional application (Application) made available via a tab on the Promotional Page; and
follow the prompts of the Application in the manner required to submit the online entry form, including providing the Entrant's full name, postcode, phone number, current and valid email address, the name of their "favourite holiday secret spot – an Australian destination or experience that you love but is off the beaten track" (Secret Spot), the Secret Spot location and select the Secret Spot's category from the list provided on the Application. Entrants must also provide a description in one hundred (100) words or less as to why this is their favourite Secret Spot, share their inside tip and upload a photograph:
depicting the Secret Spot;
taken by the Entrant;
of less than 5MB in size;
in one of the following formats: .jpeg, .gif or .png; and
the photograph may be digitally manipulated or edited by the Entrant but must accurately depict the Secret Spot;
check a box confirming that they are over 18 years of age at time of entry; and
check a box confirming that they have they accept the terms and conditions, including that they have obtained the permission of any persons pictured in the photograph,
(together, an Entry).
Once an entry is submitted, Entrants acknowledge that the entry may not be withdrawn, altered or deleted (except as and when required by the Promoter).
Multiple Entries accepted however each Entry must be submitted separately, must be substantially unique and must independently comply with these Conditions of Entry and Voting. Each Entrant may only win one prize in this promotion.
Entries will be deemed to be submitted at the time they are received by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible Entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected Entries.
GRANT OF LICENCE TO THE PROMOTER IN RELATION TO THE ENTRY
All Entrants grant to the Promoter a non-exclusive, royalty-free, perpetual, irrevocable, world-wide, sub-licensable, transferable license to use, reproduce, modify, adapt, publish and display all or any part of the Entry in any media, including any future media which does not yet exist, without restriction or liability for any purpose, including but not limited, promotional and marketing materials produced by or for the Promoter. Note, this grants a broad licence to the Promoter to use the Entry, or any part of it, for free, but the Entrant retains the copyright in the Entry.
CONFIRMATION ENTRY IS ORIGINAL AND THE ENTRANT IS ABLE TO GRANT LICENCE TO THE PROMOTER
Each Entrant confirms that their entry is their original work, does not infringe the rights of any third party, and that they have the right to the grant the licence in the in clause above.
ENTRANT'S AGREEMENT NOT TO ASSERT MORAL RIGHTS
By submitting their Entry, each Entrant agrees not to assert any rights of integrity of authorship, rights of attribution of authorship, rights not to have authorship falsely attributed, rights of integrity of authorship and rights of a similar nature that exist, or may come to exist, anywhere in the world (Moral Rights) that they may have in relation to the use of the Entry under the licence granted to the Promoter or its sub-licensees or assignees
ENTRANT'S CONFIRMATION IN RELATION TO THE PERMISSION OF THIRD PARTIES AND THEIR AGREEMENT NOT TO ASSERT MORAL RIGHTS
By submitting their Entry, each Entrant confirms:
any other parties who may have Moral Rights in connection with the Entry have:
been provided a copy of these terms and conditions;
read these terms and conditions and understood them;
consented to the use of the Entry in accordance with these terms and conditions; and
agreed not to assert those Moral Rights in relation to the use of the Entry by the Promoter or its sub-licensees or assignees;
that all persons appearing in the Entry or whose identity is apparent in the Entry (and the parents or guardians of minors appearing or whose identity is apparent in the Entry) have:
been provided a copy of these terms and conditions;
read these terms and conditions and understood them; and
consented to you uploading the Photo and for it to be used in accordance with these terms and conditions; and
if the Entry contains a reference to or image of a third party or third party property , that they have all required permissions and consents from all relevant third parties (including a third party that is a body corporate or business) to submit the Entry to be used in accordance with the terms and conditions.
DISCRETION OF PROMOTER TO ACCEPT, DISQUALIFY AND USE ENTRIES
Entrants agree that the Promoter is under no obligation to use all or any part of their Entry if accepted by the Promoter.
The Promoter reserves the right to disqualify any entries it deems, in its sole discretion, unlawful or fraudulent, in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, or otherwise unsuitable for publication. The Promoter, in its absolute discretion, reserves the right to notify relevant authorities including law enforcement bodies and provide them with the objectionable entry and the entrant's personal information.
NO AFFILIATION
If the Promoter accepts or uses all or any part of an Entry, such acceptance or use does not constitute any endorsement, sponsorship, affiliation or any other relationship between the Entrant and the Promoter.
JUDGING
All valid Entries will be judged by panel of judges between 10.00 AEDST Thursday 29th November 2012 and 15.00 AEDST Friday 30th November 2012 to determine the 40 best Entries (Finalist Entries). All Entries will be judged on the basis of creativity and originality of their Secret Spot, description and photograph. Chance plays no part in determining the Finalist Entries. Entrants whose Entries are judged to be a Finalist Entry (Finalists) will be notified in writing (email) by 17.00 AEDST Monday 3rd December 2012. The judges' decision in all aspects of the promotion is final and no correspondence will be entered into.
VOTING
All Finalist Entries will be featured on the Application for public viewing and public voting from 10.00 AEDST on Tuesday 4th December 2012 until 17.00 AEDST on Monday 17th December 2012 (Voting Period).
Voting is only open to residents of Australia aged 13 years or older (Voters). The directors, management and employees, contractors (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies who are directly associated with the conduct of this promotion are ineligible to vote in the promotion.
To vote, Voters must, during the Voting Period:
visit the Promotional Page;
access the Application made available via a tab on the Promotional Page; and
follow the prompts of the Application in the manner required to select one of the Finalist Entries exhibited on the Application by clicking on the 'vote' icon on the image frame,
(together, a Vote).
Multiple Votes accepted however a maximum of one Vote permitted by a Voter for each Finalist Entry during the Voting Period. Votes received will be considered final by the Promoter. The Promoter accepts no responsibility for late, lost or misdirected Votes.
Voters acknowledge and agree that this promotion does not involve awarding of any prizes to Voters, rather the Votes of the Voters will be tallied at the conclusion of the Promotional Period to determine the Entrants who will win prizes in this promotion.
If the Internet voting process fails to operate properly or appears to be tampered with or tainted with errors, fraud or unfair practices, including if it is discovered that attempts were made by an individual to:
vote more than the once per Finalist Entry;
use (or attempt to use) multiple names, identities, email addresses and/or any automated, script, macro or robotic program(s) to submit Votes; and/or
engage in systematic voting from the same computer/IP address, then the Promoter may, in its sole and absolute discretion, disqualify the Votes, entry and/or
Entrant and/or Voter to which such votes relate. Any votes determined by the Promoter to be in violation of these Conditions of Entry and Voting are subject to disqualification in the sole and absolute discretion of the Promoter.
PRIZES
The Finalist whose Finalist Entry receives the highest number of public votes at the end of the Voting Period will win one travel prize to Heron Island Resort, Queensland for the winner and one travel companion aged 18 years or older, valued at up to $5,000 (Major Prize). The Major Prize comprises of the following elements:
two return economy airfares (with a carrier at the discretion of the Promoter) to Gladstone, Queensland from the Australian capital city airport closest to the ordinary residential address of the winner. If the winner's residential address is in the metropolitan/regional area of Gladstone, Queensland this component of the Major Prize is forfeited;
five nights' accommodation at Heron Island Resort, Beachside Suite (twin share);
return boat transfers to and from Gladstone port and Heron Island Resort; and
all standard resort meals at the Shearwater Restaurant, (excludes beverages).
The two Finalists whose Finalist Entries receive the next highest number of Votes at the end of the Voting Period from all remaining Finalist Entries will each win one travel prize to Wildman Wilderness Lodge for the winner and one travel companion aged 18 years or older, valued at up to $2,000 each (Minor Prize A). The Minor Prize comprises of the following elements:
two return economy airfares (with a carrier at the discretion of the Promoter) to Darwin, Northern Territory from the Australian capital city airport closest to the ordinary residential address of the winner. If the winner's residential address is in the metropolitan/regional area of Darwin, Northern Territory this component of the Major Prize is forfeited;

daily continental breakfast and three-course dinner meal on each night (excludes beverages).
The two Finalists whose Finalist Entries receive the next highest number of Votes at the end of the Voting Period from all remaining Finalist Entries will each win one travel prize to Wildman Wilderness Lodge for the winner and one travel companion aged 18 years or older, valued at up to $1,000 each (Minor Prize B). The Minor Prize comprises of the following elements:
two return economy airfares (with a carrier at the discretion of the Promoter) to Adelaide, South Australia from the Australian capital city airport closest to the ordinary residential address of the winner. If the winner's residential address is in the metropolitan/regional area of Adelaide, South Australia this component of the Major Prize is forfeited;
two nights' 3.5 star accommodation at Wilpena Pound Resort, Standard Room (twin share); and
daily continental breakfast.
The remaining 35 Finalists will each win one $100.00 Hooroo.com credit voucher (Hooroo Credit). To claim the Hooroo Credit, winners must have a Hooroo.com site profile and must nominate a Hooroo.com site profile to which the Hooroo Credit will be applied. Hooroo Credit must be used for a single transaction greater than $100. Credit expires three months from the date of issue. Credits can only be used to book travel a maximum of 12 months in advance. Credit will be refunded in the event of booking cancellation.
In the event of a tie, the Promoter will judge the tied entries based on creativity and originality to determine which Entrant will be awarded a prize. The Promoter's decision is final and no correspondence will be entered into.
Finalists will be notified of their prizes by email by Monday 7th January 2013.
For the Major Prizes and Minor Prizes, the following conditions apply:
travel must be booked by 12th March 2013 for travel completed in full by 31st December 2013
the prizes are subject to availability at the time of booking, and cannot be taken at peak periods such as school holidays, public holidays and any other times or dates advised by the Promoter to the prize winner
the winner and their travel companions must travel and stay together for all prize travel and accommodation, and will not accrue Qantas Frequent Flyer points on any element of the prize
prizes include GST and taxes included in the price of the ticket. Unless otherwise stated, the prize does not include travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation or any other costs of a personal nature.
compliance with any health or other government requirements is the responsibility of each prize-winner and their companion.
the Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Prize travel is subject to Qantas' and Jetstar's General Conditions of Carriage; and
a credit card may be required to be presented at the time of check-in;
It is a condition of accepting a prize that the winners and their travel companions accept the conditions of use of the prize. No compensation will be payable if the winners, or their travel companions, forfeit or are unable to use any element of a prize as stated for any reason, including refusal of entry or departure into or out of the prize destinations or participation in certain activities for health, age, behaviour or safety reasons. Any part of a prize that is not taken for any reason is forfeited.
Total maximum prize pool value is up to $14,500 (including GST). Prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). Prizes must be taken as offered and cannot be varied. For cash or other goods or services except as stated. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variations in prize values. Major Prize and Minor Prize values are recommended retail price including GST, depending on point of departure.
For any prize that remains unclaimed on Friday 1st February 2013, the Promoter may award a prize to the next highest publically voted Finalist Entry or next best judged Entry (as applicable). Any prize winner determined in accordance with this clause will be notified by email by Friday 1st February 2013.
If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter's reasonable control, then a comparable prize or prize element of approximately the same value will be awarded in lieu.
IMPORTANT TERMS RELATING TO FACEBOOK
The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. By entering this competition, each Eligible Entrant releases Facebook from any action or claim arising out of the competition. GENERAL
The Promoter may, without any liability, take any steps necessary in order to respond to a law enforcement or regulatory body or to comply with the law (to the extent the Promoter is legally authorised or obliged to do so) at any time and without notice to the Entrant.
The Promoter reserves the right to request the Entrant (and if they are a prize winner and their travelling companions) to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm their identity, age, residential address, eligibility before issuing a prize.
It is a condition of accepting a prize that the winner and their companion/s (if any) may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.
If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
The exclusion of liability in clause 42 does not apply to limit or exclude liability:
for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business;
or
to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).

Entry details remain the property of the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize.
