Terms and Conditions
Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
The Promotion is a game of chance, and skill plays no part in determining the winners.
The Promotion is only open to eligible entrants, being individuals who are:
permanent residents of Australia; and over the age of 18; and who can take the prize and travel on the dates specified by the Promoter, which are Friday 14 December 2012 to Sunday 16 December 2012; and are not:
employees of the Fox International Channels Australia Pty Ltd, Salmat Digital Pty Limited, FOXTEL, or an employee of these companies’ related corporations or agencies or any other company associated with the Promoter and the Promotion;
a spouse, de facto spouse, parent, child or sibling (whether natural or by adoption) of such an employee.
The competition will be advertised on FX (channel 123), print, online and via social media.
The competition commences on Wednesday 5 September 2012 at 9:00 (AEST) and concludes on Monday 3 December 2012 at 12:00 (AEST) (the “Promotional Period”).

complete the entry form with all the details required, including (but not limited to) full name and email address. Mandatory details will be indicated on the entry form.
The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.
SMS entry cost is $0.55c (including GST) which is charged by your mobile phone carrier provider.
Entry via the SMS number is unlimited. Website and Facebook entry is limited to one entry per person and per household each day.
Incomprehensible and incomplete entries will be deemed invalid.
The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
Entries must be received by 12:00 (AEST) on Monday 3 December 2012. The time of entry will in each case be the time the SMS message or online entry is received by the Salmat Digital Pty Limited database or the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.
Entrants must make their Website entries manually using an internet browser. The Promoter may reject an entry if it reasonably forms the opinion that the entry has been made using automated entry means or by use of a computer entry service.
Any entry that is made on behalf of an Entrant by a third party will be invalid.
The cost of accessing the promotional Website will be dependent on the entrant’s individual Internet Service Provider.
Each valid entrant who has entered the competition over the duration of the Promotional Period will be entered into the draw. There will be one (1) Major Prize Winner and 10 Runner-Up Prize Winners randomly selected from all valid entries. The draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney, NSW 2060 on Tuesday 4 December 2012 at 9:00 (AEST). All attempts will be made to contact the winners. The winners will be notified of their prize via phone and in writing on the day of the draw. The winners will have their details published on the FX official website
www.fxtv.com.au on Wednesday 4 December 2012 and in the Public Notices section of The Australian newspaper on Wednesday 5 December 2012.
Subject to any direction given under relevant State legislation, the promoter shall conduct such further draws as may be deemed necessary for the unclaimed Major Prize at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney, NSW on Monday 10 December 2012 at 9:00 (AEST). The winners will be notified by phone and in writing immediately after the draw. The winners of the prizes valued over $250 will have their details published in the Public Notices section of The Australian newspaper on Wednesday 12 December 2012.
Subject to any direction given under relevant State legislation, the promoter shall conduct such further draws as may be deemed necessary for any unclaimed Runner-Up Prizes at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney, NSW on Monday 11 March 2013 at 9:00 (AEST). The winners will be notified by phone and in writing immediately after the draw.
If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
There is one (1) Major Prize and ten (10) Runner-Up Prizes to be won (the “Prize”).
The Major Prize Winner must travel on the dates specified by the Promoter, which are Friday 14 December 2012 to Sunday 16 December 2012. The Major Prize consists of:
Return economy airfares for four (4) adults from the winners nearest capital city to nearest airport to the location of the “The Smashes” live finale (to be confirmed upon release of the event schedule) valued at a maximum of $2,056; and
2 x night’s accommodation for four (4) in two (2) double or twin rooms at a minimum 3 star hotel ( the “Hotel”) (to be determined by the Promoter in its sole discretion) for the Major Prize Winner and three (3) guests, valued at a total maximum of $800.00; and
Airport transfer to and from an airport closest to the location of “The Smashes” live finale to the Hotel, valued at a maximum of $100; and 4x VIP passes to attend “The Smashes” live finale on Saturday 15 December 2012, valued at a maximum of $400; and
A dinner for the Major Prize Winner and three (3) guest at a bistro restaurant determined by the Promoter in its sole discretion, valued at a maximum of $320
The Major Prize is valued at a maximum of $3,676.00
Each of ten (10) Runner-Up Winners will receive:
UFC Fight Duffle Bag valued at a maximum of $69.95; and
UFC t-Shirt valued at a maximum of $34.95; and
FX Towel valued at a maximum of $10.00.
The individual Runner-Up Prize is valued at a maximum of $114.90
THE TOTAL PRIZE POOL FOR THIS PROMOTION IS VALUED AT A MAXIMUM OF $4,825
All prize values are in Australian dollars based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
Prizes are not transferable, exchangeable or redeemable for cash (unless cash is specified).
The Major Prize must be taken in conjunction with “The Smashes” live finale event and the winner and their three (3) companions must travel to the location where this event is being held. The location of this event will be confirmed upon release of event schedule.
The Major Prize Winner and their three (3) companions are responsible for all other expenses including additional spending money, meals, drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
The Major Prize Winner and their three (3) travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport to and from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide, Perth, Hobart, Canberra or Darwin).
Travel must be taken at the time specified by the promoter to coincide with the dates of “The Smashes” live finale scheduled on Saturday 15 December 2012. All travel arrangements, return economy flights, accommodation, transfers and VIP Passes to “The Smashes” live finale including dates, times, logistics and mechanics are at the discretion of the Promoter and must be taken as specified by the Promoter. If the Major Prize Winner and their travelling companions are, for whatever reason, unable to travel on a nominated date, or do not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.
Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
Fox International Channels Australia Pty Ltd, Salmat Digital Pty Limited and any benefiting parties make no representation as to the safety, conditions or other issues that may exist at any destination.
The Promoter’s decision is final and no correspondence will be entered into regarding the competition result.
If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
The Promoter reserves the right to refuse to allow the Major Prize Winner and/or their travelling companions to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that the Major Prize winner or any of their guests is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the Major Prize Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Fox International Channel or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
Prizes will be awarded to person named in the entry.
Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
To the full extent permitted by the law, Facebook and the Relevant Parties will not be liable for any loss, damage, claim, cost, expense or personal injury suffered or sustained (including, but not limited to, that caused by any person’s negligence) by any Entrant in connection with the Promotion or the Prizes, including:
any indirect, economic or consequential loss or loss of profits;
any loss arising from the negligence of a Relevant Party; and
any liability for personal injury or death.
Entry and continued participation in the Promotion is dependent on Entrants’ acting in accordance with the Facebook Statement of Rights and Responsibilities, available at

Entrants understand that they are providing their information to the Promoter and not to Facebook. Any questions, comments or complaints about this Promotion must be directed to the Promoter (not Facebook) at the address given in clause 1 of these Terms and Conditions.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
The Promoter, Facebook and the Relevant Parties shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Fox International Channels Australia Pty Ltd, Salmat Digital Pty Limited and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
All entries become the property of the Promoter. The Promoter (not Facebook) collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
