2. Entry to the Competition constitutes acceptance of these Terms and Conditions. All entry instructions published by the Promoter form part of these Terms and Conditions.
3. The Competition is only open to individuals who: (i) are residents of Australia aged 20 years or older as at time of entry; and (ii) are not employees of the Promoter or any of its related corporations or any of the agencies associated with the Competition; and (iii) are not a spouse, ex-spouse, de-facto partner, ex-de-facto partner, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, grandchild, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin of such an employee; and (iv) hold a current full or probationary driver's licence ("Eligible Entrant").
4. Competition entry commences at 12:00am on 03/09/2012 and closes at 11:59pm on 30/11/2012 ("Entry Period") and is subject to the remainder of this condition 4. Except as otherwise stated, all times are Australian Eastern Standard Time. It will not be possible to apply for an Eligible Insurance Quote via the Competition Website or refer a friend after 27/11/2012.This is to allow enough time for the Promoter's representatives to contact entrants who have requested an insurance quote online and issue them with an Eligible Insurance Quote.
Entry
5. In these terms and conditions:
"Competition Website" means
www.shannons.com.au/texas;"Eligible Insurance Quote" means a quote for a Shannons Motor Insurance Policy (car or motorcycle cover) or a Shannons Home & Contents Insurance Policy (meaning building only, contents only or building and contents cover);
"Eligible Insurance Policy" means a Shannons Motor Insurance Policy (car or motorcycle cover) or a Shannons Home & Contents Insurance Policy (meaning building only, contents only or building and contents cover).
6. To enter the Competition, an Eligible Entrant must, during the Entry Period:
(i)Use a compatible browser to visit the Competition Website, apply for and receive an Eligible Insurance Quote from the Promoter. The Promoter's normal underwriting criteria apply. An Eligible Entrant will receive one entry for each risk quoted on the Eligible Insurance Quote. For the avoidance of doubt, a building and contents Eligible Insurance Quote constitutes one risk for the purposes of this Competition. An Eligible Insurance Quote will not be received immediately upon providing details but the Promoter will endeavour to provide an Eligible Insurance Quote within 2 business days of receiving all relevant information. It will not be possible to apply for an Eligible Insurance Quote via the Competition Website after 27/11/2012; or
(ii)Call the Promoter on 13 46 46 and obtain an Eligible Insurance Quote. The Promoter's normal underwriting criteria apply. The Eligible Entrant must provide all details required by the Promoter. An Eligible Entrant will receive one entry for each risk quoted on the Eligible Insurance Quote (for the avoidance of doubt, a building and contents Eligible Insurance Quote constitutes one risk for the purposes of this Competition); or
(iii)Use a compatible browser to visit the Competition Website and follow the directions there to send details of the competition to a number of friends using their unique share URL. The unique share URL can be shared via direct link, email, Facebook, Twitter or Google+. That friend must during the Entry Period via the Eligible Entrant's unique share URL apply for and receive an Eligible Insurance Quote from the Promoter. The Eligible Entrant will receive one entry into the competition for each person they referred who received Eligible Insurance Quote from the Promoter via the Eligible Entrants unique share URL.
The referral mechanism described is subject to the Spam Act 2003. Eligible Entrants who have already entered the promotion cannot be referred as friends by a subsequent entrant. Each person referred must be an Australian resident aged 20 years or older. Each Eligible Entrant warrants that each friend they refer is known to them personally, and that they have their consent to send email and send electronic communications to such persons. It will not be possible to refer a friend after 26/11/2012; or
(iv)Purchase a new Eligible Insurance Policy. An Eligible Entrant will receive two entries for each risk insured (ie. vehicle or insured address) under the new Eligible Insurance Policy. For the avoidance of doubt, a building and contents Eligible Insurance Policy constitutes one risk for the purposes of this Competition. The Promoter's normal underwriting criteria apply. An existing customer of the Promoter will not receive any entries into the Competition for renewing an existing insurance policy.
(v)An Eligible Entrant will automatically receive one entry into the competition if they hold a fully paid Home and Contents Insurance Policy at the conclusion of the competition (11:59pm 30/11/2012) and they have not opted out of receiving marketing communications from the Promoter.
7. In respect of entries received via Eligible Insurance Quotes, an Eligible Entrant will only receive one entry in respect of each risk quoted on by the Promoter during the Entry Period. For the avoidance of doubt, a building and contents Eligible Insurance Quote constitutes one risk for the purposes of this Competition. Further, an Eligible Entrant will only receive one entry for obtaining multiple insurance quotes for the same vehicle or address risk.
8. The maximum cost of a call to 13 46 46 will not exceed the cost of a local call when made from an Australian land line. Calls from mobile phones or pay phones may attract a higher rate. Cost of entry via the internet is free, but internet connection and usage rates may apply. Eligible Entrants should obtain details of such costs from their telecommunication service providers.
9. All Eligible Entrants must ensure that the Promoter receives their entries during the Entry Period. Entries will be deemed received at the time that the Promoter is satisfied that the relevant requirements under conditions 6 and 7 (as relevant) have been met and not at the time of submission by the Eligible Entrant. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures to provide an Eligible Insurance Quote or delays or failures in any telecommunications service or equipment.
10. The Promoter may, in its absolute discretion, declare any or all entries made by an Eligible Entrant invalid if the Eligible Entrant tampers with the entry process, benefits from such tampering or submits an entry that is illegible, incomplete or not in accordance with these terms and conditions.
11.The Promoter reserves the right to verify the validity of entries including an Eligible Entrant's identity, eligibility, age and postal address and to disqualify any entrant who has breached the entry criteria explained in these Terms and Conditions.
Draw and Prize
12. All valid entries received during the Entry Period will be entered into the prize ("Prize") draw. The random draw for the Prize will be held at 12:00 Sydney time on 14/12/2012 at 5th Finger Pty Ltd, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW, 2000. There is one Prize. An Eligible Entrant does not need to be in attendance at the Prize draw to win the Prize.
13.The first valid entry randomly drawn in the Prize draw will win the Prize. The Prize consists of:
■2 adult economy class airfares from Sydney, NSW Australia to Dallas, Texas USA.
■2 adult economy class airfares from Dallas, Texas USA to Los Angeles, California USA.

14.If the Prize is won jointly (for example, in the case of joint policyholders), the joint Prize winners must:
(i) both take the Prize together, or
(ii) jointly nominate one third person (over 18 years of age) to accompany one of them.
Provisions applicable to the prize generally
15. The Prize is valued at up to $13,322 AUD including GST as at 07/08/12. The Promoter takes no responsibility for any variations in the Prize's value due to exchange rate changes or otherwise.
16. All components of the Prize must be taken together, with two adults travelling together on the same routing as a single trip booked by the Promoter, to coincide with the 2013 V8 Supercars Round at the Circuit of Americas, Austin, Texas USA. Dates of this event are still to be determined but are likely to be between May-July 2013. Any part of the Prize that is not taken for any reason is forfeited.
17. The Prize does not (except as expressly stated) include travel costs to and from the points of departure, excess baggage, any additional meals and drinks, transfer costs, taxes, levies and charges, passports, insurance (such as travel insurance or any additional cost of non mandated insurance or policy excess reduction in relation to the Hertz hire vehicle), medical or health related services, additional accommodation, additional spending money, extension of stay, additional passengers, tours and other ancillary costs. These are the responsibility of the Prize winner and their companion.
18. The Prize winner is responsible for any amendment fees or charges once the booking has been confirmed. Flights may not be changed once the booking has been confirmed.
19. Flights and accommodation are subject to booking and availability and confirmation by the travel supplier at the time of booking. All bookings are subject to the travel supplier's booking conditions.
20. The Prize winner and their travelling companion are responsible for ensuring that they have all necessary documents and permissions to travel to the relevant destination (including a current passport and any visas or travel authorisations that may be required). The Prize winner and their travelling companion are also responsible for ensuring they take any necessary inoculations prior to taking the Prize.
21. If the Prize (or part of the Prize) is unavailable for any reason, the Promoter may, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or equivalent specification, subject to the approval of any relevant regulatory authority that has issued a permit for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by the Prize winner or any other party if the Prize (or part of the Prize) is unavailable for any reason.
22. Subject to conditions 21 and 29, the Prize is non-transferable, non-refundable, non-exchangeable, non-replaceable, and non-redeemable for another prize including cash, excluding the cash component of the Prize, except at the Promoter's discretion and subject to state and territory legislation.
23. Where car hire is included in the Prize, the Prize winner or their companion must be aged 20 years or over and must have a current Australian driver's licence. The car hire is also subject to any terms and conditions specified by the car hire provider. If these conditions are not met, the car hire component of the Prize will be forfeited by the Prize winner and any costs or liabilities incurred by the hire car driver will not be the responsibility of the Promoter. The Promoter will not be liable for the failure of the Prize winner (and/or their companion) to attend the event, for whatever reason.
24. The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss) or for any personal injury sustained as a result of taking and/or using any prize, except for any liability that cannot be excluded by law.
Prize Winner
25.The Prize winner will be notified by a phone call and a written message by e-mail or mail by 19/12/2012.
26.The Prize notification will state the Prize that has been won and will include instructions as to how the Prize winner is to claim the Prize and establish their entitlement to it. The Prize will only be awarded following any Prize winner validation and verification that the Promoter requires in its sole discretion.
27.The name of the Prize winner will be published in The Australian on 21/12/12.
28.The name of the Prize winner will be published on the Competition Website within 7 days of the Prize being won (including if the Prize is won under any redraw under condition 29), for a period of at least 1 week.
29.Subject, where relevant, to any directions given under the laws regulating the Competition, if the Prize is: (i) not claimed by the Prize winner or the Promoter has been unable to successfully notify the Prize winner on or before 13/02/2013; (ii) forfeited for any reason; or (iii) the Prize winner is determined by the Promoter to be ineligible, the Prize will be awarded to another Eligible Entrant in a redraw for the Prize. Any such redraw will be made from a pool of entries comprising all those entries that were originally eligible to win the Prize. Any such redraw will take place at 12:00 on 14/02/2013 at 5th Finger Pty Ltd, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW, 2000. If there is a redraw, the name of the winner of the redraw will be published in The Australian on 22/02/2013. The redraw Prize winner will be notified by a phone call and a written message by e-mail or mail by 19/02/2013.
General
30.If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to provide an alternative travel prize (including an alternative destination at an alternative date as specified by the Promoter) to the equivalent value as the original prize or to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the regulatory authorities that have issued permits for its conduct.
31.The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any delay in delivery (when not directly caused by the Promoter or its travel supplier), or failure of safe delivery of the Prize.
32.All of the Promoter's decisions are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
33.The Prize winner accepts the Prize at their own risk, as does their travel companion as relevant. Any tax liability arising as a result of accepting the Prize is the responsibility of the Prize winner. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant and/or their travel companion in connection with the Competition or Prize, including without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. The Promoter may request that the Prize winner (and if requested, the travelling companion) sign and return a deed of release to this effect as a condition of the Prize being awarded. If the Prize winner (and if requested, the travelling companion) fails to sign and return such release, the Prize winner may forfeit the Prize.
34.The Prize winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without compensation, financial or otherwise, for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
Privacy and Marketing Consent
35.The entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise the Prize winner. Subject to conditions 36, 37 and 38, entry into the Competition also entitles the Promoter to market its products and services to the Eligible Entrant. See condition 35 for more information about the Promoter's marketing. Each Eligible Entrant agrees that they must provide and/or maintain their consent to receive marketing communications from the Promoter for the duration of the Competition Period. This is required to ensure that Competition entries are properly recorded, processed and the winner can be drawn.
36.The personal information of the Prize winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, Prize suppliers and deliverers, and to regulatory authorities. The Promoter will disclose the Prize winner's first initial, surname, suburb and State/Territory of residence to The Australian newspaper, which will publish these details.
37.The Eligible Entrant also understands and agrees that the primary purpose of collecting information about the Eligible Entrant's insurance needs is to enable the Promoter to contact the Eligible Entrant at a later date (by any permitted means including telephone, email, mail or SMS) to market its products and services. If an Eligible Entrant does not provide accurate personal information, the Promoter may determine that they are not eligible to win the Prize. All personal information is handled in accordance with the Promoter's Privacy Policy available online at
www.shannons.com.au/terms. If the Eligible Entrant would like to access or correct the personal information that the Promoter holds about them, or if the Eligible Entrant wishes to opt out of receiving the Promoter's marketing communications after the end of the Competition Period, the Eligible Entrant should inform the Promoter by calling 13 46 46 or sending an email to
info@shannons.com.au or write to the Promoter at the postal address in condition 1.
38.All entries become the property of the Promoter and will be entered into a database. Information resulting from the Eligible Entrant's entry and participation in a promotion is used by the Promoter and its agencies associated with the Competition for the determination of the Prize winner. Information about Eligible Entrants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of planning and product development. By applying or participating in the Competition, Eligible Entrants consent to these uses and disclosures of their information.
