Terms and Conditions

1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
 
2. The Promotion is a game of chance, and skill plays no part in determining the winners.
 
3. The Promotion is only open to eligible entrants, being individuals who are:
 
a) permanent residents of Australia and New Zealand; and
 b) a Foxtel, Telstra or Optus subscriber, or live in a household with a Foxtel, Telstra or Optus subscription and have the subscriber’s permission, and the subscriber’s account is not in arrears for the duration of the Promotion up to and including any re-draw or unclaimed prize draw; and
 c) over the age of 18;
 
and are not:
 
d) employees of the NGC Network Australia Pty Ltd, Salmat Digital, Foxtel, Telstra or Optus or an employee of these companies’ related corporations or agencies or any other company associated with the Promoter and the Promotion; or
 e) a spouse, de facto spouse, parent, child or sibling (whether natural or by adoption) of such an employee.
 
4. The competition will be advertised via the website and on National Geographic Channel.
 
5. The competition commences on Monday 24 September 2012 at 20:30 (AEST) and concludes on Monday 3 December 2012 at 20:29 (AEST) (the “Promotional Period”). However, there are ten (10) Entry Periods, each with a different start time and date and draw date as set out below:

New Zealand residents should be mindful that the outlined timings are stipulated in AEST (Australian Eastern Standard Time) and AEDT (Australian Eastern Daylight Time). NZST is 2 hours ahead of AEST.
 
6. To enter and be eligible to win, entrants must enter within one of the Entry Periods using these methods:
 
a) Tune into “Wicked Tuna” (“Program”) on National Geographic Channel (Channel 610) during the Promotional Period and take note of the advertised weekly code word (the “Code word”) supplied at some time during transmission; and
 
SMS entry (Australian residents only):
 
i. send an SMS message containing their full name and the correct and current weekly code word to 1974 6767 (“SMS Number”). Entrants will receive a reply SMS message confirming their entry has been received.
 
OR
 
Website entry (Australian and New Zealand residents):
 
ii. Go to the National Geographic Channel website: www.natgeotv.com.au/ or www.natgeotv.co.nz/; and click through to “Watch and Win: Wicked Tuna” competition link; and complete an online entry form and provide the correct and current weekly code word. Details collected include (but are not limited to) full name, address, phone number, age, gender, e-mail address and subscription platform. Mandatory details will be indicated on the entry form
 
7. Only code words supplied at the time of the original transmission of the Program will be valid for use to enter into the Competition during the corresponding Entry Periods. The code word will change weekly and entries which quote an incorrect or out-dated code word will be ineligible for entry. Entrants acknowledge that code words which appear in subsequent playbacks of the Program, including where the Program is recorded and viewed after the time of original transmission, may be deemed invalid for entry if the corresponding Entry Period for that code word has closed in accordance with clause 5.
 
8. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.
 
9. SMS entry cost is $0.55c (including GST) which is charged by your mobile phone carrier provider.
 
10. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider
 
11. Entry via the SMS number is unlimited, however Website entry is limited to one entry per person, per entry period (as outlined in clause 5) Entrants can enter the Competition as many times as they like via the SMS Number during the Competition Period. Only one (1) entry per person per entry period will be permitted or accepted via online entry. However, the use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is strictly prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using a Repeat Entry Device, the Promoter may disqualify that entrant without notice. To ensure fairness, the Promoter may undertake automatic and/or manual audits of entries and may deem entries ineligible if it is reasonably believed that they are frivolous, incomprehensible, incomplete, or otherwise not genuine.
 
12. Incomprehensible and incomplete entries will be deemed invalid.
 
13. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
 
14. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
 
15. Entries must be received during one of the entry periods outlined in clause 5. The time of entry will in each case be the time the SMS message or online entry is received by the Salmat database or the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted..
 
16. Any entry that is made on behalf of an Entrant by a third party will be invalid.
 
17. Each valid entrant who has entered the competition over the duration of the Promotional Period will be entered into the draw. There will be one (1) winner randomly selected from all valid entries. The draw will take place at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney, NSW 2060 on Tuesday 4 December 2012 at 11:30 (AEDT). The winner will be notified in writing within 2 days of the draw and will have their details published in the Public Notices section of The Australian newspaper on Tuesday 11 December 2012.
 
18. Subject to any direction given under relevant State legislation, the promoter shall conduct such further draws as may be deemed necessary for any unclaimed prizes at Salmat, Level 2, 116 Miller Street, North Sydney, NSW on Tuesday 12 March 2013 at 11:30 (AEDT). The winners will be notified of their prize in writing and will have their details published in the Public Notices section of the Australian on Tuesday 19 March 2013.
 
19. If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
 
20. There is one (1) prize (the “Prize”). The Prize winner will receive:
 
a) 2 x return economy airfares for the winner and their travelling companion from the winner’s nearest capital city to Sydney, NSW valued at a maximum of $988.00; and
 
b) 2 x return economy airfares for the winner and their travelling companion from Sydney, NSW, Australia to Boston, Massachusetts, USA valued at a maximum of $ 5,700.00; and
 
c) Airport transport to and from Logan International Airport in Boston, Massachusetts to Gloucester, Massachusetts valued at a maximum of $200.00; and
 
d) 4 x night’s accommodation in a minimum 4 star hotel (standard twin room) for the Winner and their guest ( the “Hotel” to be determined by the Promoter in its sole discretion. The Winner and their travelling companion must spend at least 1 night in Gloucester where they depart from for their charter fishing trip however the Promoter is flexible to arrange the remaining 3 x night’s accommodation in Boston if the Winner wishes to do so) , valued at a maximum of $1,200.00; and
 
e) 1 day charted fishing trip with Captain Dave for two (2) including food supplies, refreshments and fuel, valued at a maximum of $1,900.00
 
21. The total prize pool is valued at a maximum of $9,988.00
 
22. All prize values are in Australian dollars based upon the recommended retail prices at the time of printing (inclusive of GST). Any prize values that have been converted from the US dollars to Australian dollars are in accordance with the conversion rate as at Tuesday 4 September 2012. The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
 
23. The cash component of the prize will be awarded in the form of a cheque made payable to the Winner and crossed not negotiable or directly deposited into the Winner’s account by electronic funds transfer.
 
24. Prizes are not transferable, exchangeable or redeemable for cash (unless cash is specified).
 
25. The winner and their companion are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
 
26. The winner and their travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide, Perth, Hobart, Canberra or Darwin)..
 
27. The prize must be taken by 31 July 2013. All aspects of the Prize, including but not limited to travel arrangements, return economy flights, accommodation and the charter fishing trip with Captain Dave are subject to availability and are at the ultimate discretion of the Promoter. The prize is not available during blackout periods and peak times such as public holidays and school holidays and cannot be changed once the booking has been made.
 
28. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
 
29. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
 
30. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.
 
31. NGC Network Australia Pty Ltd, Salmat Digital Pty Limited and any benefiting parties make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
 
32. The Promoter’s decision is final and no correspondence will be entered into regarding the competition result.
 
33. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
 
34. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
 
35. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
 
36. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
 
37. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with National Geographic Channel or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
 
38. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
 
39. Prizes will be awarded to person named in the entry.
 
40. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
 
41. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
 
42. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
 
43. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
 
44. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
 
45. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
 
46. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
 
47. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
 
48. NGC Network Australia Pty Ltd, Salmat Digital and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
 
49. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
 
50. By entering the promotion via Website entry, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. By entering competition you agree to become a member of natgeotv.com.au and subscribe to the free monthly newsletter. You can change your subscription and membership details at any time by logging on and editing your details.
 
51. Salmat Digital, on behalf of NGC Network Australia Pty Ltd, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat Digital for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
 
52. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.
