PARTICIPATION
This competition (“Competition”) is conducted by Australian Pensioners Insurance Agency Pty Limited (“APIA”) (“the Promoter”) ABN: 14 099 650 996, of 447 Collins Street, Melbourne VIC 3000, phone number (03) 8681 9387.
Entry to the Competition constitutes acceptance of these Terms and Conditions of Entry (“Conditions”). All entry instructions and prize information published by the Promoter forms part of these Conditions.
The Competition is only open to individuals who: (i) are residents of Australia aged 18 years or older as at time of entry; and (ii) are not employees of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee.
Competition entry commences at 12:01am (AEDT) on 09/10/12 and closes at 12:00pm (AEDT) on 13/11/2012 (“Competition Period”). Except as otherwise stated, all times are in Melbourne time.
Except as otherwise indicated, all amounts stated in these Conditions are stated in Australian dollars.
ENTRY
To enter the competition, an Eligible Entrant is deemed to have accepted these terms and conditions of entry and must during the Competition Period do one of the following:

To obtain an entry into the Competition, the Eligible Entrant must fully complete the entry form including First Name, Last Name, Postcode, Date of Birth and current and valid email address.
Fully and correctly complete the specially marked entry form provided in the Promoter’s direct mail communication received by the Eligible Entrant, including providing the Eligible Entrant’s full name, residential address and then mail the completed entry form in the Reply Paid Envelope provided to “reply paid 3081, South Melbourne VIC 3205” to be received by last mail on 13/11/2012; or
Providing personal information including name and contact details (and any other information requested by the Promoter to the Promoter by calling the Promoter (standard call costs apply) or as part of any outbound call campaign conducted by the Promoter (or any of it’s agents).
Apia general insurance products are designed for people over 50 and no longer working full time or planning to retire in the next 12 months. Eligible Entrants who think one or more of their friends or relatives might be interested in entering the competition, and in accordance with these terms & conditions, learning more about Apia products can send details of the Competition to a number of friends or relatives who the Eligible Entrant thinks may be interested based on this criteria, and register that they invited their friends or relatives via the Competition Website. To invite friends or relatives, Eligible Entrants must submit their friends’ or relatives’ names and current and valid email addresses (and any other information requested by the Promoter) in the manner required and where indicated on the online entry form. The operation of this referral mechanism is subject to the Spam Act 2003 (Cth). An Eligible Entrant may refer a particular friend or relative only once during the Promotional Period and Eligible Entrants who have already entered the Promotion cannot be referred as friends or relatives by a subsequent Eligible Entrant. Each Eligible Entrant’s relative or friend nominated must be eligible for entry in accordance with Condition 3 of these Terms & Conditions. Each Eligible Entrants warrants that any and each friend or relative that they nominate is known to them personally and that they have consented to receiving commercial electronic messages.
Subject to these Terms and Conditions, an Eligible Entrant will receive a total of
one (1) entry into the Competition for entries made by any one of the means in Condition 6(a), (b), (c) or (d) during the Competition Period and
one (1) entry for every friend or relative invited to a maximum of five (5) entries made during the Competition Period by the means in Condition 7.
Only one (1) entry per person entering pursuant to Condition 6(a), (b), (c) and (d) is permitted. Any subsequent entry from a person under Condition 6(a), (b), (c) and (d) after the first valid entry under Condition 6(a), (b), (c) and (d) is received will be invalid.
All Eligible Entrants must ensure that the Promoter receives their entries during the Competition Period. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of submission by the Eligible Entrant. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment. Contact details entered incorrectly on the Competition Website by an entrant will deem an entry invalid.
Eligible Entrants must submit their internet entries manually. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
The Promoter may, at its absolute discretion, declare any or all entries made invalid if the entrant tampers with the entry process, benefits from such tampering or submits an entry that is illegible, incomplete or not in accordance with these conditions.
The Promoter reserves the right to verify the validity of entries including an Eligible Entrant’s identity, eligibility, age and postal address, and to disqualify any entrant who has breached the entry criteria explained in these Terms and Conditions.
Cost of entry via the internet is free, but internet connection and usage rates may apply. Costs associated with accessing the Promotional Website remain an entrant’s responsibility and may vary depending on the Internet service provider used. All entrants should obtain details of such costs from their service providers.
Calls from public telephones or mobiles may incur an additional charge. The charges for all telephone call entry services (if applicable) will appear on an entrant’s next telephone or mobile phone bill. All queries relating to mobile phone and telephone bills should be directed to an entrant’s mobile phone or telephone carrier.
An entry submitted by post must be an original and photocopies or images of entry forms will not be accepted.
DRAW AND PRIZES
The draw to determine the winner will take place at 12:00pm (AEDT) on 21/11/2012 at Contact Management Associates (VIC) Pty Ltd, 92-94 Tope Street, South Melbourne VIC 3205. Winner will be notified in writing via the email or mailing address provided in their entry. Winner will also be contacted by phone if provided in their entry. Winner’s name and locality will be published in The Australian on 28/11/2012. All reasonable steps to notify the winner will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
The first eligible entry randomly drawn from all entries received will receive the following Prize, which is valued up to $43,994:
one (1) new Renault Koleos 4x4 Dynamique Diesel Auto in non-metallic paint (no accessories are included) (“the Vehicle”). The colour of the Vehicle is subject to availability and the discretion of Vehicle Distributors Australia Pty Ltd;
the cost of 12 months registration for the Vehicle in the state or territory of the Entrant's nominated address;
stamp duty on the Vehicle (if applicable); and
the dealer delivery charge payable for the Vehicle to be delivered to a dealership or Renault service centre will also be included in the Prize. The Promoter will aim to ensure the Vehicle is delivered to the dealership or Renault service centre closest to the winning Entrant's nominated address, however the place of delivery will be chosen at the discretion of the Promoter.
PROVISIONS APPLICABLE TO THE PRIZE GENERALLY
The winning Entrant must collect the Vehicle from the dealership or Renault service centre to which it is delivered in accordance with Condition 18(d) above and is responsible for all costs associated with this collection. The promoter is not liable for any costs associated with the collection of the prize. Any costs will be at the winner's expense.
The Prize in total is valued at up to $43,994 including GST. The Prize is valued as at 6 September 2012. The Promoter takes no responsibility for any variations in the Prize value due to exchange rate changes or otherwise.
All additional options, petrol, licensing and all other ancillary costs associated with redeeming the prize are the responsibility of the winner.
To register the Vehicle, the winner must provide the Promoter with the necessary signed documents and identification to satisfy the State or Territory government vehicle registration authority. The winner is responsible for arranging any third party or comprehensive car insurance for the Vehicle and all costs associated with insurances.
The prize may not be transferred or substituted except at the Promoters discretion and subject to State or Territory legislation. Save any stated cash component of the prize, the prize is not redeemable for cash. However, the Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability. Any tax on the prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in this promotion.
The Promoter shall not be liable for any costs associated with the prize before or after the delivery.
The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking and/or using any prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the Internet or telecommunications services. No responsibility will be taken by the Promoter for any incomplete, late, lost or misdirected entries.
WINNERS OF THE PRIZE
The Prize notification will state the Prize that has been won and will include instructions as to how the Prize winner is to claim the Prize and establish his/her entitlement to it.
The Promoter may conduct a further draw at the same time and place as the original draw as is necessary on 21/02/2013 in order to award the Prize if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of a winner in the unclaimed prize draw, the winner will be notified by telephone or writing and the name and locality of the winner will be published in The Australian on 28/02/2013. All reasonable steps to notify the winning Entrant will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into. The Prize winner will be notified in writing via the email or mailing address provided in their entry. Winner will also be contacted by phone if provided in their entry.
If the Prize or an element of the Prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
It is a condition of accepting the Prize that the winner (if any) may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.
GENERAL
If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any delay in delivery, or failure of safe delivery of the Prize.
All of the Promoter's decisions are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Prize winner consents to the Promoter or Renault Australia using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without compensation, financial or otherwise, for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
All entries become the property of the Promoter and will be entered into a database. Information resulting from the Eligible Entrant’s entry and participation in a promotion is used by the Promoter and its agencies associated with the Competition for the determination of the Prize winner. Information about Eligible Entrants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of planning and product development. By applying or participating in the Competition, Eligible Entrants consent to these uses and disclosures of their information.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter.
PRIVACY AND MARKETING CONSENT AND DISCLOSURE
The entrants’ personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise the Prize winner. Subject to conditions 37 and 38, entry into the Competition also entitles the Promoter to market its products and services to the Eligible Entrant. See condition 38 for more information about the Promoter’s marketing. Each Eligible Entrant agrees that they must provide and/or maintain their consent to receive marketing communications from the Promoter for the duration of the Competition Period. This is required to ensure that Competition entries are properly recorded, processed and the winner can be drawn.
The personal information of the Prize winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, Prize suppliers and deliverers, and to regulatory authorities. The Promoter will disclose the Prize winner's first initial, surname, suburb and State/Territory of residence to The Australian newspaper, which will publish these details. An entrant also agrees that the Promoter may, in the event the entrant is the winner, publish or cause to be published the entrant’s name and locality in any media, as required under the relevant State or Territory lottery legislation.
If an entrant participates in the promotion and also chooses to opt in to receiving marketing materials, including by ticking the box on the entry form agreeing to receive marketing about competition news and promotions by the promoter, the Eligible Entrant understands and agrees that the primary purpose of collecting information about the Eligible Entrant’s insurance needs is to enable the Promoter to contact the Eligible Entrant at a later date (by any permitted means including telephone, email, mail or SMS) to market its products and services. If an Eligible Entrant does not provide accurate personal information, the Promoter may determine that they are not eligible to win the Prize. All personal information is handled in accordance with the Promoter’s Privacy Policy available by calling 13 50 50. If the Eligible Entrant would like to access or correct the personal information that the Promoter holds about them, or if the Eligible Entrant wishes to opt out of receiving the Promoter’s marketing communications after the end of the Competition Period, the Eligible Entrant should inform the Promoter by calling 13 50 50 or write to the Promoter at the postal address in condition 1.
