TERMS AND CONDITIONS: Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these terms and conditions.
The promotion is open to Australian residents aged 18 years and over.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
Entries into the promotion open on 26/05/2021 and close at 11.59pm AEDST on 07/07/2021 (“Promotional Period”).
To be eligible to enter, individuals must purchase any V energy drink product (“Qualifying Product”) from a Participating Store during the Promotional Period and collect a receipt at the time of purchase of the Qualifying Product (“Qualifying Transaction”). A participating store is any store that stocks the Promoter’s products and displays material advertising this promotion (“Participating Store”). In the event that a receipt is not automatically provided to an individual upon completion of their Qualifying Transaction, it is the individual’s responsibility to request one from the Participating Store.
To enter the promotion, individuals must then visit v-energy.com.au/winter or scan the QR Code on the promotional poster, input the requested details (including but not limited to full name, phone number and email address), upload a copy of their Qualifying Transaction receipt and then submit the fully completed entry form during the Promotional Period.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used by that entrant.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Product. For example, if an individual purchases three (3) Qualifying Products in one (1) transaction then they will be eligible for three (3) entries subject to clauses 8(b) and 8(c); (b) each entry must be submitted separately and in accordance with entry requirements at clause 6; and (c) a maximum of two (2) entries per person per day is Any additional entries submitted by an entrant will be deemed invalid.
Entrants must retain their original OR a copy of their purchase receipt for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. In that case, the entrant will not be entitled to compensation.
There will be one (1) draw conducted for the entries received by the Promoter during each day of the Promotional Period, for a total of forty-three (43) draws (“Daily Draws”). Subject to the starting and closing time of the Promotional Period, entries into each Daily Draw will open at 12am and close at 11.59pm each day based on NSW local time. Each Daily Draw will take place at Bamboo Marketing, Suite 1 20-40 Meagher Street Chippendale NSW 2008 at 11am AEDST on the first business day after entries close for that Daily Draw, with the first Daily Draw taking place on 27/05/2021 and the last Daily Draw taking place on 08/07/2021. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in NSW. Entries in each Daily Draw will NOT be entered into any subsequent Daily Draw(s). The Promoter may draw additional entries and record them in order in case an invalid or ineligible entrant is drawn.
The first valid entry drawn from each Daily Draw will win a Prezzee Smart E Gift Card valued at $100.00 (“Daily Prize”) will be emailed to the email provided at time of entry. This email will have instructions on how to redeem & use the E Gift Card.
The Prezzee Smart eGift card can only be exchanged for individual retailer gift cards online. These individual retailer gift cards can be redeemed in-store or online, dependent on retailer terms and conditions. Please review all applicable retailers’ terms and conditions prior to the purchase of any Gift Card.
Any ancillary costs associated with redeeming a Prezzee Smart E Gift Card are not included. Any unused balance of a Prezzee Smart E Gift Card will not be awarded as cash. Redemption of a Prezzee Smart E Gift Card is subject to any terms and conditions of the issuer including those specified on the Prezzee Smart E Gift Card.
The Major Prize Draw will take place at Bamboo Marketing, Suite 1 20-40 Meagher Street Chippendale NSW 2008 on 14/07/2021 at 11am AEDST, in the presence of an independent scrutineer. The Promoter may draw additional entries and record them in order in case an invalid entry or ineligible entrant is drawn. The Promoter will draw the Major Prize and Runner-up Prize winners from all valid entries received by the Promoter during the Promotional Period. The Major Prize and Runner-up Prize winners will be the registered owner of the phone number provided at the time of entry.
There is one (1) major prize of a Kia Seltos S 2.0L CVT Wagon with automatic transmission, valued up to AUD$30,500 (“Major Prize”) to be won. The first valid entry drawn in accordance with clause 15 will win the Major Prize. The Major Prize features include In-line 4 cyl. Additional insurance, options, petrol and all other ancillary costs are the responsibility of the Major Prize winner. The Major Prize winner must collect the Major Prize from their nearest authorised Kia dealership & travel expenses will not be covered by the promoter.
If the Major Prize winner is, through any legal incapacity or otherwise, unable to register the Major Prize in their own name, then the Major Prize winner may assign the Major Prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the Major Prize winner and their assignee. The Major Prize winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the Major Prize will be awarded. It is a condition of accepting the Major Prize that the Major Prize winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.

The prize RRPs are correct at the time of printing these Terms and Conditions and all in-store point of sale materials, and the Promoter takes no responsibility for any changes to the RRP stated.
Prizes, or any unused portion of a prize, are not transferable, changeable or redeemable for cash.
In the event that a prize or any part of a prize becomes unavailable for any reason beyond the Promoter’s control, the Promoter reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take/redeem a prize (or an element of the prize) at/by the time stipulated by the Promoter, for any reason, then the prize (or that element of the prize) will be forfeited, and no compensation will be payable.
All Major Prize & Daily prize winners will be contacted by phone and email using the details provided at the time of entry within two (2) business days of the Major Prize and Daily Prize draw.
In the event an invalid or ineligible entry is drawn, or the Promoter is unable to contact a winner within seven (7) days of first attempting to notify that winner, having made reasonable attempts to do so, the Promoter may deem that winner’s entry invalid, and no compensation will be payable.
Daily Prize winners must provide the Promoter with a valid residential delivery address in Australia within twenty-eight (28 days) of being contacted by the Promoter. If the Promoter does not receive a winner’s valid Australian residential delivery address within that period, their prize will be void and no compensation will be payable.
The Major Prize winner & Daily Prize winners and any ACT Instant Win Prize winners will be published at v-energy.com.au/winter from 21/07/2021.
Daily Prizes will be delivered to the address nominated by the winner within thirty-one (31) business days of close of the Promotional Period.
A draw for the Major Prize (if unclaimed) and any unclaimed Daily Prizes may take place on 14/10/2021 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by phone and email within two (2) business days of the unclaimed prize draw and their names will be published on v-energy.com.au/winter from 18/10/2021.
Acceptance of any prize is deemed consent for the Promoter to use the winner’s name, likeness, image and/or voice for promotional and media purposes without compensation, and any copyright will vest in the Promoter.
The Promoter’s decision is final on all matters and no correspondence will be entered
The Promoter reserves the right to amend, suspend or cancel any aspect of this promotion (including any prize or term) at any time in its sole discretion, subject to any written directions from a relevant regulatory authority.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Quality control errors will not invalidate an otherwise valid prize claim.

To the extent permitted by law, the Promoter and its agents take no responsibility for any failure of any entry to be entered into the promotion due to, without limitation, technical malfunction or human error. Entries are deemed received at the time they are received by the Promoter, and not at the time of transmission by the entrant.
