Kells Facebook and Google Competition 2021 – Terms and Conditions

General
The Promoter of the Kells Competition is Kells the Lawyers, 14-18 Auburn Street, Wollongong, NSW 2500, ABN 67 503 870 940. Telephone: 02 4221 9311.
The Kells Competition is the competition governed and defined by these Terms and Conditions.
Information on entry and prizes is included in these Terms and Conditions.
Entry into the Kells Competition is deemed acceptance of these Terms and Conditions.
In the case of any inconsistency between these Terms and Conditions and any other information referring to the Kells Competition, these Terms and Conditions will prevail.
Who can enter
Entry into the Kells Competition is open to those persons who satisfy all of the following criteria:
any persons over the age of 18 years (as at the date of entry) and who are permanent residents of New South Wales and
the person must be a client of the Promoter in relation to the provision of legal services during the period between the competition open and closing dates.
Employees of the Promoter and the immediate family of employees of the Promoter are not eligible to enter this Kells Competition. Immediate family of employees includes any spouse, ex-spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin of an employee
The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated entrant address and proof of entry validity in order to claim a prize.
When to enter
The competition will comprise of 3 rounds, commencing at 00:00am AEST on Friday, 3 September 2021 and concluding at 09:00 am AEST on Tuesday, 30 November 2021. Entries must be received by the Promoter after the competition open date and time and prior to the competition closing date and time to be considered valid.
Below are the dates for entry into the Competition on Facebook for each Round.

1 Friday, 3 September 2021 Thursday, 30 September 2021
2 Friday, 1 October 2021 Sunday, 31 October 2021
3 Monday, 1 November 2021 Tuesday, 30 November 2021
The time of entry will, in each case, be the time the entry is received by the Promoter, not at the time of transmission by the entrant.
The Promoter accepts no responsibility for any late, lost or misdirected entries, including but not limited to entries not received by the Promoter or late entries caused by internet service delays, technical disruptions or network congestion.
How to enter
Each Round will be advertised between the ‘open’ and ‘closing’ dates outlined in clause 3.2 above.
To enter the Kells Competition, Entrants must post a written review being at least six (6) words in length on either the Promoter’s Facebook site or Google review site in relation to the provision of legal services by the Promoter to the Entrant.
Entrants may view the terms and conditions on the Promoter’s website as a link under the “About” section of the website.
Any entry that is made on behalf of an Entrant by a third party will be invalid, unless the Entrant requires the assistance of a third party to enter due to a disability.
The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Kells Competition which is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the Kells Competition and/or the Promoter.
Number of entries permitted
Entrants may only enter the Kells Competition once per Round.
Draw and notification of winner
The winner will be randomly selected by the Promoter from the pool of valid entries submitted in accordance with these Terms and Conditions. The random selection will occur by the Promoter printing the names of all valid entrants, placing them in a bucket and randomly selecting one entrant’s name from the bucket. The random selection is to occur by 11:59 pm AEST on the Closing Dates outlined above in clause 3. If the Closing Date does not fall on a Business Day, then the random selection will occur by 11:59 pm AEST on the next Business Day.
The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Kells Competition result or any other decisions the Promoter makes in connection with the Kells Competition.
The winner will be notified by telephone within two business days of the draw and the details of the winner will also be published on the Promoter’s Facebook and Instagram sites Unsuccessful entrants will not be notified.
The prize will be awarded to the person named in the entry, however, in the case of a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry.
Should an entrant’s contact details change during the Kells Competition period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
Subject to legislation, any unclaimed prize will be subject to a second draw (“unclaimed prize draw”), to take place one week after the closing date. The winner of the unclaimed prize draw will be notified by telephone or email within two days of that draw.
Prize
For each Round, the prize awarded to the winner will be a $50.00 voucher for use at Coles/Myer.
Prizes cannot be transferred, exchanged or redeemed for cash.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.
All entrants agree that if they win the prize, they will not, and their companions will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the internet. Photographs will be allowed only at the discretion of the Promoter.
The prize must be claimed by the winner 7 days from being notified. In the event a winner does not claim the prize by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in this prize should they be chosen as a winner. The winner releases the Promoter and their employees from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties will not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of acceptance of, and participation in, the prize.
Further terms and conditions
Individual prizes for the Kells Competition will not exceed $150.00. Total prizes during the Kells Competition will not exceed $10,000.00.
Subject to complying with all applicable legislation, the Promoter reserves the right to amend, cancel or suspend the Kells Competition if an event beyond the control of the Promoter corrupts or affects the administration, security, fairness, integrity or proper conduct of the Kells Competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of the Kells Competition.
The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries and reserves the right to take any action that may be available.
Entrants are responsible for any cost associated with entering the competition.
If an entrant uses any form of software or third party application to enter multiple times, organises for a third party to enter on their behalf in breach of these terms and conditions or enters using incorrect contact details, his or her entry will be deemed invalid. If such an entrant wins a prize, the entrant must immediately return the prize to the Promoter. The Promoter has sole discretion to determine whether an entrant has breached this clause. The Promoter reserves the right to request whatever documentation it deems necessary to confirm whether an entrant has breached this clause. Entrants must provide all documents requested by the Promoter.
If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to applicable legislation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. The prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
The Promoter reserves the right to redraw the prize if an entrant who claims to be a prize winner is unable to satisfy these terms and conditions.
Copyright, statutory guarantees, waiver and liability
In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s submission to appear in connection with the Promoter or the advertising or marketing and the winner will not be entitled to any fee for such use.
Each entrant hereby assigns to the Promoter all right, title and interest in and to all copyright and all moral rights in any material created or otherwise submitted to the Promoter in connection with that entrant’s entry or participation in the associated survey.
All entries become the property of the Promoter. The Promoter collects information about you for the purposes of conducting the Kells Competition and for other marketing purposes. Any disclosure of such information will be made as required by law and in accordance with these terms and conditions but no further use of this information will be made without prior consent.
The Promoter collects information about you to provide you with our goods and services, to promote and improve our goods and services, for the purposes described in our Privacy Policy and for any other purposes that we describe at the time of collection. Any representative of the Promoter may contact you for those purposes at any time. We may also disclose your information to our service and content providers, including those located outside Australia. We may disclose your personal information to authorities if you are a prize winner or otherwise as required by law. Pursuant to clause 14 of the Community Gaming Regulation (NSW) 2020, the Kells Competition is authorised by Michael Hatfield on behalf of the Promoter.
