Promotional Period Promotion commences on Monday 22nd July 2024 and ends at close of business (5:00pm AEDT) on Tuesday 31st December 2024.
Eligible Entrants
Entry is open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, its related entities, any prize draw and any agencies associated with this Promotion are ineligible to enter.
Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Competition
Win your own Island Retreat for up to 21 guests over 2 nights & 3 days at Tiwi Island Retreat, located at Port Hurd, Bathurst Island, Tiwi Islands, Northern Territory, Australia, approx. 30 minute flight from Darwin, Northern Territory.
To get to the Island, all guests must make their own way to Darwin, then Tiwi Island Retreat will arrange a small charter plane (approx. 30 minute flight from Darwin) and boat (approx. 10 minute boat ride to the Retreat) to take guests to Port Hurd, Bathurst Island where the Retreat is located.
Guests under the age of 18 travelling as part of this Prize must travel with a parent or guardian.
Entry
To enter, each Eligible Entrant must complete the following steps during the Promotional Period:
Competition is open to all Australian Residents;
Entries are limited to 1 per person;
Entrants must complete and submit their full name, address, email, phone and confirm they are over 18 years;
Entrants must subscribe to Tiwi Island Retreat’s mailing list, and;
Entrants must confirm they have read the Terms and Conditions of the promotion.
Entries which in the reasonable opinion of the Promoter:
Are received outside the Promotional Period;
are incomplete or indecipherable;
are considered as an ineligible Entrant or has multiple entries; or
do not otherwise comply with these Terms, will be invalid and ineligible for any Prize.
After the closing date, no further entries to the competition will be permitted.
Draw
The Draw will take place at 2:00pm (AEDT) on Thursday 2nd January 2025 by way of a random draw. The Promoter may wish to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The Draw will take place at Collab Capital, Level 1, 181 Roberts Road, Subiaco, WA 6008. Approved agent to the Promoter.
1 valid entry randomly drawn from this Draw will win the Prize.
The Promoter may at any time (including after the Promotional Period), verify the validity of entries and Eligible Entrants and disqualify any individual who the Promoter reasonably believes has breached any of these Terms or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion.
If there is a dispute as to the identity of an Eligible Entrant, the Promoter may, in its sole discretion, may request additional detail to determine the identity of the Eligible Entrant.
Prize(s)
Winner will receive a weekend at Tiwi Island Retreat for 2 nights / 3 days for up to 21 pax including;
Transfers from Darwin to Tiwi Islands (return flights to Darwin responsibility of winner & guests). Transfers from Darwin to Tiwi Island Retreat is approx. 30 min plus a short boat ride.
Food and beverages throughout the stay including daily canapes and cocktails.
Activities including beach dinner and bonfire, blue water fishing tour, estuary fishing tour, and 20 minute scenic helicopter flight.
Welcome pack per guest.
Total RRP of the Prize is valued at $88,487.00
All taxes (excluding GST) and any ancillary costs which may be payable as a consequence of receiving the Prize are the sole responsibility of the Winner.
The prize must be taken during the following period: 21st March 2025 to 23rd March 2025.
The prize is not transferable and is not redeemable for cash.
The room configuration for up to 21 guests available for the prize is as follows;
1 x Family Ocean Room with private ensuite for 6 guests
10 x Ocean Room (sleeps up to 2 guests per room)
8 x Village Room (6 rooms sleep up to 2 guests per room, 3 rooms sleep up to 4 guests per room)
The winner and guests will be required to provide a credit card imprint that will be used as a bond in case of damage to the property and charged for incidentals, such as additional activities, certain alcohol, and any other items that are not listed as part of the prize package.
The winner and guests will be required to sign a Participant Agreement and Release as part of the prize.
The winner and guests may be filmed during their stay (with their consent) to capture content for social media use for an extended period of time without renumeration for the purpose of promoting the destination.
We strongly recommend the winner and guests take out travel insurance in case of unforeseen circumstances beyond the control of the promoter ie flight cancellations of extreme weather events.
If the prize is unavailable, the Promoter at its absolute discretion, may substitute the prize (or a component of the Prize) with a prize of equal value, subject to any written directions from a regulatory authority. Other than this, the Prize is not transferable or exchangeable, and cannot be taken as cash.
Guests will be refused service of alcohol if it would breach any relevant laws, codes or policies including those of the liquor licensee relating to the relevant legislation. The Promoter and Island Management supports the responsible service of alcohol.
The Promoter will not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of accepting and/or using this Prize, except for any liability which cannot be excluded by law.
Subject to the unclaimed Prize Draw clause, if for any reason the winner does not take the Prize by the time stipulated by the Promoter, then the Prize will be forfeited.
Notification of Winner
The Winner will be announced on Instagram and notified via phone and email on Thursday 2nd January 2025 following the Draw.
If the prize is unclaimed within 2 weeks by Thursday 16th January 2025, the prize will be offered to the first reserve winner drawn and notified by phone and in writing on this day.
Winner(s) of a Re-draw Prize must claim their Prize within two weeks of the Re-draw.
Privacy
The Promoter will collect, use and disclose Eligible Entrants’ personal information to conduct and manage the Promotion in accordance with its Privacy Policy.
The Promoter may also use Eligible Entrants’ personal information for promotional, marketing, publicity, research and profiling purposes for any of the Promoter’s products, including sending electronic messages to, or telephoning, any Eligible Entrants. Eligible Entrants may opt out of such marketing messages at any time by clicking on the unsubscribe link contained in the message.
Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and any of the Promoter’s products.
Miscellaneous
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason beyond the reasonable control of the Promoter including technical difficulties, unauthorised intervention or fraud, the Promoter may, to the extent permitted by law:
disqualify any Eligible Entrant; or
subject to any written directions from a regulatory authority, modify, suspend, terminate or cancel the Promotion or modify the Prize, as appropriate.
Nothing in these Terms limits, excludes or modifies (or purports to do so) any non-excludable guarantees or warranties under consumer law (Non-Excludable Guarantees).
Except for the Non-Excludable Guarantees and any other liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) will not be responsible and excludes all liability (including negligence) for any personal injury or loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of:
the Promotion and/or the taking or use of the Prize;
any technical difficulties or equipment malfunction outside of the Promoter’s reasonable control;
any theft, unauthorised access or third party interference;
any late, lost, altered or misdirected entries due to any reason beyond the Promoter’s reasonable control, and/or;
any tax liability incurred by a Winner or Eligible Entrant
Disputes All feedback in respect of the Promotion should be submitted to the Promoter’s feedback address at:
marketing@tiwiislandretreat.com.au. In the case of any dispute, the Promoter will make a determination, acting reasonably and taking into account any feedback provided. The Promoter’s decision is final and binding, subject to any legal proceedings initiated by the complainant.
