VIRO GIFT CARD COMPETITION TERMS AND CONDITIONS - 2010

1           Introduction

1.1 This competition will commence on March 29th 2010 and will expire upon the earlier of:-

-        The drawing of all prizes provided for herein; or

-        March 28th 2011.

1.2 The competition is open to all persons who successfully apply for a Viro Visa Prepaid Card1 during the period in which the competition is open (Refer to clause 3 below).

1.3 The total prize pool is a value of not more than $5,000 in the form of five $1,000 Viro Gift Cards.

1.4 When you successfully apply for a Viro Visa Prepaid Card you will be eligible to go into the draw to WIN one of five $1,000 Viro Gift Cards and you are required to agree to these terms and conditions.

1.5 The Promoter has used its best endeavours to ensure that this competition complies with any registration requirements pursuant to Gaming & Licensing legislation within the jurisdiction of the States of Australia. If for any reason this competition is in breach of those legislation then it will cease immediately upon the Promoter receiving notification to that effect.

2            Terms and Conditions

The terms and conditions set out below shall apply to this competition.

3            Who can enter

3.1 Subject to clause 3.2, entry is open only to all residents of Australia.
The entrant must be able to show proof of residency upon request e.g. Drivers License.

3.2 All successful applicants for a Viro Visa Prepaid Card during the competition period are automatically entered into the competition.

3.3 Employees and their immediate families of Viro International Pty Ltd are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

3.4 Unsuccessful applications will NOT qualify for this competition.  

4            How to enter

4.1 The competition commences on March 29th 2010 at 0:01am (AEST) and conclude upon the earliest occurrence of all available prizes have been drawn or midnight on March 28th 2011.

4.2 All successful applications for the Viro Visa Prepaid Card will automatically be in the draw to win the competition during the above outlined competition period. Five (5) random draws will take place based on the number of successful Viro Visa Prepaid Card applications received.

4.3 Entry is free. Only one entry per Viro Visa Prepaid Cardholder.

4.4 Entrants under the age of 18 years must obtain the prior permission of a parent or guardian over the age of 18 years before entering the competition.

4.5 Any person entering the competition needs to answer the question correctly on the competition entry form either online www.viro.com.au or on the paper application form.  

5            Prizes

5.1 There are five (5) prize winners with the total prize pool value of $5,000. Each prize winner will receive the prize as set out below:

    *        Viro Gift Card to the total value of $1,000.

5.1 The prize is not redeemable for cash. If for any reason a winner does not use the prize or any element of the prize by the expiry date specified on the Viro Gift Card, then the prize or any remaining balance of the prize will be forfeited and will not be redeemable for cash.

5.2 The Viro Gift Card is subject to the terms and conditions specified on the card and on the website www.viro.com.au .

5.3 All prizes are not transferable, exchangeable or redeemable for cash. In the event of that any prize item is unavailable; the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winners.

5.4 In participating in the prizes, the winners agree to participate and co-operate as required in all marketing activities relating to the promotion, including but not limited to being interviewed and photographed. The winners grant the promoter a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.

6            How to win

6.1 Each entrant who has applied and has been successful in becoming a Viro Visa Prepaid Cardholder over the Competition Period and registered all details in accordance with clause 4 will be automatically entered into a draw from a random number selector adjudging by the Promoters.

6.2 The judging will take place at the principal place of business of Viro International Pty Ltd (currently 2190 Gold Coast Highway, Miami, Queensland).

    *        The 1st prize will be drawn when the total number of successful applications for a Viro Visa Prepaid Card reaches 1,000. Every person who has successfully registered as a Viro Visa Prepaid Cardholder at this time will be included in this draw.
    *        The 2nd prize will be drawn when the total number of successful applications for a Viro Visa Prepaid Card reaches 2,000. Every person who has successfully registered as a Viro Visa Prepaid Cardholder at this time will be included in this draw.
    *        The 3rd prize will be drawn when the total number of successful applications for a Viro Visa Prepaid Card reaches 3,000. Every person who has successfully registered as a Viro Visa Prepaid Cardholder at this time will be included in this draw.
    *        The 4th prize will be drawn when the total number of successful applications for a Viro Visa Prepaid Card reaches 4,000. Every person who has successfully registered as a Viro Visa Prepaid Cardholder at this time will be included in this draw.
    *        The 5th prize will be drawn when the total number of successful applications for a Viro Visa Prepaid Card reaches 5,000. Every person who has successfully registered as a Viro Visa Prepaid Cardholder at this time will be included in this draw.

6.8 The prize winners will be notified by phone or mail within seven days of the prize draw.

6.9 The winners may be announced and their photo published on www.viro.com.au  (subject to the Promoters decision).

6.10 The Promoter's decision is final and the Promoter will not enter into correspondence regarding the result.

7            No Liability

7.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.

7.2 Viro International Pty Ltd and their associated agencies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

7.3 Viro International Pty Ltd and their associated agencies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

a.     during the draw;

b.     whilst undertaking any travel won on or connected with their entry into the draw; or

c.      in the participation of any prize;

d.     as a consequence of late, lost or misdirected mail;

e.     arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion;

f.      due to circumstances outside the Promoter's reasonable control.

7.4 Viro International Pty Ltd and their associated agencies and its affiliates assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserve the right to take any action that may be available.

7.5 If, for any reason, this competition is not capable of being conducted as planned, including, but not limited to, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to State Legislation.

Just as a bit of warning, there are a lot of fees associated with this - the main one being a $4 per month account keeping fee.

     I.  Transactions, per                 

•Load Fee- No charge ($0.00) per transaction: deducted from your Viro Visa Prepaid Card at the same time the load transaction value is credited (added) to your Viro Visa Prepaid Card.
•Redemption Fee - No charge ($0.00) per transaction: deducted from your Viro Visa Prepaid Card at the same time a successful purchase occurs from using your Viro Visa Prepaid Card.
•Declined Transaction Fee- $0.50 per transaction: deducted from your Viro Visa Prepaid Card at the same time you attempt to use your Viro Visa Prepaid Card at an EFTPOS device, or the internet or telephone to make a transaction but that transaction is declined.
        II.   Account

Monthly Account Fee of $4.00 will be deducted from Viro Visa Prepaid Card on the last business day of each month.

      III.   ATM Transactions

Westpac and St George ATMs

•Successful withdrawal fee - $1.75 per transaction deducted from your Viro Visa Prepaid Card at the same time you successfully withdraw cash at a Westpac or St George branded ATM. Balance on receipt will not reflect this fee applied at the time of this transaction. Balance on receipt or screen will not reflect the deduction of this fee, you must consider this fee amount before proceeding with a purchase transaction.•Balance enquiry fee - $1.75 per transaction deducted from your Viro Visa Prepaid Card after you complete a balance enquiry at a Westpac or St George branded ATM. Balance on receipt or screen will not reflect the deduction of this fee, you must consider this fee amount before proceeding with a withdrawal transaction.•Declined fee - $0.50 per transaction deducted from your Viro Visa Prepaid Card at the same time you attempt to withdraw cash from a Westpac or St George branded ATM but the transaction is declined. Balance on receipt or screen will not reflect the deduction of this fee, you must consider this fee amount before proceeding with a withdrawal or purchase transaction.•It is often cheaper for you to use a Westpac or St George branded ATM when withdrawing cash using your Viro Visa Prepaid Card.
All other ATMs (other than Westpac & St George branded ATMs)

ATM Owners fee: as displayed on screen at time of withdrawal or balance enquiry transaction (not charged by Indue),  PLUS

•ATM Viro Visa Prepaid Card Issuers Fee (successful; declined & balance enquiry) - $0.50 deducted from your Viro Visa Prepaid Card at the time as the transaction takes place. Balance on receipt or screen will not reflect the deduction of this fee, you must consider these fee amounts before proceeding with a withdrawal or purchase transaction.•International ATM (successful & declined) - $1.00 deducted from your Viro Visa Prepaid Card at the same time as the transaction takes place. Balance on receipt or screen will not reflect the deduction of this fee, you must consider these fee amounts before proceeding with a withdrawal or purchase transaction.

      IV.   Currency Conversion Fee

3.5% of the total amount of each transaction, payable and deducted from your Viro Visa Prepaid Card at the same time you make a transaction on your Viro Visa Prepaid Card account in a currency other than Australian dollars, or you make a transaction on your Visa Prepaid Card in any currency (including AUD) that is processed by a card scheme or billed by the merchant outside of Australia.  1% of the total amount of each such transaction is payable to Visa as a currency conversion charge and the remaining 2.5% of the total amount of each transaction is an administration fee payable to Indue.

       V.   Servicing

•Account Closure Fee - $15.00 will be charged to your Viro Visa Prepaid Card at the time of you closing your account (refer to section 14 and 15 below).
•Viro Visa Prepaid Card Replacement Fee - $10.00 will be charged to your Viro Visa Prepaid Card at the time of you ordering a replacement Viro Visa Prepaid Card (refer to sections 8 above and 14 below).
•Expiry Fee - (refer to section 14 and 15 below).
•PIN Reset Fee- No charge to reset your PIN for your Viro Visa Prepaid Card online at www.viro.com.au.
•Chargeback Fee - $35.00 (refer to section 19 below)
•Voucher Retrieval Fee - $25.00 (refer to section 19 below)
•Dispute Resolution Fee - $35.00 will be charged to investigate any disputed transactions which occurs on your Viro Visa Prepaid Card (refer to section 19 below)
