TERMS AND CONDITIONSSubaru Impreza XV Rescue Promotion
1. Information on how to enter and prizes form part of these Terms and Conditions.
2. Entry is open to all residents of Australia over the age of 18 years and who complete and submit a valid entry. Directors, officers and employees (and their immediate families) of Subaru (Aust) Pty Limited (the “Promoter”), its agencies and any companies associated with this promotion are not eligible to enter.
3. To enter, entrants are required to go to

www.xvrescue.com.au click through to the “Rescue Me” promotion page and in
100 characters or less tell us why they should be saved from the mundane by Subaru XV Rescue. The prizes will be awarded to each of the most original, creative and humorous entries illustrating a need to be rescued from the mundane, as judged by our Judging Panel. The entrant will then be asked to register their details and must fully complete the online entry form, including by providing their name, age, address, contact number and an email address before being eligible to win. Entrant's entries will be publically posted on
www.xvrescue.com or
www.xvrescue.com.au. By submitting an entry Entrants agree to be bound by these Terms and Conditions, and in particular, consent to their entries being publically posted.
4. This is a game of skill and chance plays no part.
5. Incomplete, inappropriate or indecipherable entries will be deemed invalid.
6.There are a total of four prizes to be won, the details of which follow:
Prizes:
(Have deleted those that have closed - only one prize remaining) Prize 4: 28th to 29th August: Food & Cooking Experience with renowned Chef Sean Connolly * Return economy class airfares for 2 people from prize winner’s nearest Australian capital city to Sydney.
* All airline and airport taxes.
Airport transfers to and from Sydney airport for 2 people:
o Picked up by the XV Rescue fleet and taken to the Food Experience;
o Shuttle bus transfer from hotel to Sydney airport;
o Transfers as required for the selected activity on Sunday.
Saturday 28th August, half day Food & Cooking Experience beginning at 9.30am (TBC pending flight schedules) with Renowned Chef, Sean Connolly, in Sydney:
The winner and their companion will be treated to a Food & Cooking experience beginning with a trip to select the freshest ingredients from Sydney’s finest markets, and then heading to the Chef’s restaurant for a private cooking experience. The winner and their companion will learn all the secrets to creating amazing food with some hints and tips to take home to their own kitchen. The Food and Cooking experience will end with a delicious lunch for 2 at the Chef’s restaurant.
At the end of the experience the winner will be given the chance to celebrate their awakening and vanquish the mundane from their previous life such as burning their suit or breaking a computer.
* Saturday 28th August, dinner for 2 adults at Icebergs restaurant (or equivalent) to the value of $500 (incl. GST).
* Saturday 28th August, 1 nights accommodation for 2 adults at the Swiss Grande, twin share.
* Full breakfast for 2 adults included.

Sunday 29th August, choice of one of the following activities on day 2:
o 1 hour Parasailing (with 15 minute Parasailing time each) for 2 people; or
o 30 minute Shark Tank Dive for 2 people; or
o 30 minute City to Surf helicopter ride for 2 people;
* Sunday 29th August, lunch for 2 adults at North Bondi Italian (or equivalent) to the value of $200 (incl. GST). NOTE: Location for lunch will be dependent on the activity selected for the morning.
* Total of $1000 spending money for the winner (incl. GST).

7. Other than as detailed above, additional spending money, additional meals, beverages, refreshments, miscellaneous hotel charges, telephone and internet charges, additional taxes, insurance, additional petrol, transport to and from the winner’s nearest capital city departure point, all other transfers and all other ancillary costs are the responsibility of the winner and/or their companion. Winners may also be required to produce a credit card at time of hotel check-in.

The promotion begins at 7.00pm (AEST) on Friday 23rd July 2010. Entries close at the following times for each prize:
1. Prize 1 - entries close on Sunday 1st August 2010 at 11.59pm (AEST)
2. Prize 2 - entries close on Sunday 8th August 2010 at 11.59pm (AEST)
3. Prize 3 - entries close on Sunday 8th August 2010 at 11.59pm (AEST) 4. Prize 4 - entries close on Sunday 22nd August 2010 at 11.59pm (AEST)
9. One prize will be awarded to each of the most original, creative and humorous entries illustrating a need to be rescued from the mundane, as judged by our Judging Panel. The Judging Panel will be composed of two members of the staff of the Promoter’s agency (Leo Burnett Pty Limited) and one staff member of the Promoter. Judgements made by the Judging Panel will be deemed final and no correspondence will be entered into.
10. Entries that, in the Promoter’s judgment, are offensive, defamatory or otherwise objectionable or inappropriate or that infringe any third party rights will be invalid. The Promoter’s decision is final and no correspondence will be entered into. If a winning entry is deemed not to comply with these terms, the Promoter reserves the right to discard that entrant’s entry and proceed as if that entrant had not entered the promotion.
11. All entries and materials submitted to the Promoter in connection with this promotion (in any form, including without limitation in hard copy or electronic form), become the property of the Promoter. The Promoter may use such entries and materials and any intellectual property rights subsisting in them in any medium and in any manner it sees fit, including without limitation, by reproducing, modifying or adapting such entries and materials.

Judging will take place at the premises of Leo Burnett Sydney, Bond One, Level 6 20 Windmill Street, Walsh Bay Sydney NSW 2000 on the following dates:
1. Prize 1 - judging will occur on Tuesday 3rd August 2010 at 11.30am (AEST)
2. Prize 2 - judging will occur on Tuesday 10th August 2010 at 11:30am (AEST)
3. Prize 3 - judging will occur on Tuesday 10th August 2010 at 11:30am (AEST) 4. Prize 4 - judging will occur on Tuesday 24th August 2010 at 11:30am (AEST)
13. Each prize winner will be notified by phone and their details will be published on the Subaru XV Rescue microsite

Prizes must be taken on the following dates (Prize Dates) in respect of each prize:
4. Prize 4 - must be taken from Saturday 28th August 2010 to Sunday 29th August 2010. Itinerary will be confirmed with the winner on accepting the prize.

The Promoter shall conduct further judging panels if prizes are unclaimed by the below dates or the winner is unable to take their prize on the Prize Date. Further judging will take place as follows:
4. Prize 4 - if unclaimed by Wednesday 25th August at 17:00pm (AEST), then re-judging will occur on Thursday 26th August 2010 at 10:00am (AEST).
16. Prizes are not transferable or exchangeable and cannot be taken as cash.
17. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
18. The Promoter will use its best endeavours to provide the prizes as listed. If the prizes or a portion of a prize is unavailable, the Promoter will at its absolute discretion, where possible, provide an alternative prize or portion of the prize of equivalent value. Prizes and participation in this promotion are subject to any conditions imposed by the supplier or organiser of the prize, as applicable.
19. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
22. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) participation in a prize related activity.
23. The Promoter may, at its discretion, require any person taking any prize (whether it be the winner or their companion) to be 18 years of age or over, or if a person is under the age of 18, require that that person be accompanied by a parent or legal guardian while taking the prize.
24. The Promoter may, in its discretion, refuse to provide the prize or any part of it if the winner and/or the winner’s companion appear to be intoxicated, under the influence of a drug, behave in a menacing or aggressive manner or otherwise behave in a manner that is in breach of the law or in a manner that may or is likely to cause damage to the good name and reputation of the Promoter. The winner agrees that it will forfeit the prize in such circumstances without recourse to the Promoter.
25. Entrants must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding this promotion or the winning of any prize, free of charge, and they consent to the Promoter and its related bodies corporate using their name, voice and image in promotional material, and where practicable must procure that their companion do likewise. Without limitation, entrants and their companions consent to being broadcast, filmed, photographed or otherwise recorded without compensation while participating in this promotion, or whilst taking or using any prize, and they consent to the Promoter repeating any such broadcast, film or other recording at any time.
26. Entrants acknowledge that there may be inherent risks in some aspects of the promotion, including without limitation any in the taking or using of any prize and that participation in the promotion and/or using the prize may involve participating in dangerous activities. Entrants must inform their companions of this risk. By entering this promotion and/or accepting the prize, entrants and their companions accept that risk.
27. In order to participate in this promotion and/or the activities which may be awarded as part of the prize, the winner (and their companion/s, as applicable) must comply with applicable height, weight, health, fitness, skill, balance, dexterity and any other requirements normally associated with the particular activity. It is the entrant’s responsibility to ensure that they (and their companion/s, as applicable) are sufficiently healthy and fit so as to safely participate in this promotion and/or undertake the activities awarded as part of the prize. The Promoter reserves the right to deem that an entrant/winner (or their companion/s, as applicable) is not sufficiently healthy or fit. The entrant/winner must comply with all requirements and directions of the people responsible for the conduct of the relevant activity and must ensure that their companion/s also comply, if applicable.
28. If requested by the Promoter, any entrant or winner (and their companion/s, if applicable) (or if an entrant, winner or companion is not an adult, their parent or guardian) must sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this promotion and/or providing the prize prior to undertaking any specified activities forming part of the promotion or prize. If any entrant, winner, nominated companion or parent/guardian (if applicable) do not sign the indemnity form provided by the Promoter within the time requested by the Promoter, the relevant entrant’s or winner’s entry or claim will be deemed invalid. Where a winner’s entry or claim is deemed invalid, the Promoter reserves the right to determine a new winner.
