TERMS AND CONDITIONS
1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Entry is only open to Australian residents aged 30 years or over who: (a) are new or existing members of the online Shell V-Power Club; and (b) meet the Driver Eligibility Criteria (“Eligible Entrants”). Drivers must hold a current Australian driver’s licence, which they must have held for a minimum period of 3 years (“Driver Eligibility Criteria”). Employees (and their immediate families) of the Promoter and Coles Express, participating Coles Express retailers and agencies associated with this promotion are ineligible to enter. Employees of the Promoter and Coles Express include employment agency employees who are currently performing work for the Promoter or Coles Express. “Immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.Employees (and their immediate families) of the Promoter and Coles Express, participating Coles Express retailers and agencies associated with this promotion are entitled to join the Shell V-Power Club and take up the discount offers, but are ineligible to enter the Shell V-Power Club promotions, including this promotion (and other promotions run by the Promoter).
4.To join the online Shell V-Power club, individuals must visit
www.shellvpowerclub.com.au, follow the prompts to the registration page, input the requested details including their full name, address, and email address and submit the fully completed registration form.
5.To be eligible to enter, Eligible Entrants must, during the promotional period, purchase any amount of either:
1.Shell V-Power petrol (subject to availability) from any participating Coles Express site in NSW, ACT, VIC, SA or QLD; or
2.Shell Premium Unleaded petrol (subject to availability) from any participating Coles Express site in WA, NT or TAS.
Entry is not available for Shell Card, Fleet Card, Motorcharge or Motorpass purchases. 6.To enter, Eligible Entrants must then, during the promotional period, visit
www.shellvpowerclub.com.au, follow the prompts to the competition entry page, input their full receipt number and URN code found on the purchase receipt and submit their fully completed online entry form.
7.The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8.Incomplete or indecipherable entries will be deemed invalid.
9.Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.
10.Eligible Entrants must retain a copy of their Coles Express service station purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Entrant’s entries and forfeiture of any right to a prize.
11.All times indicated are AEST/AEDST unless specified otherwise. Promotion commences on 19/08/10 and ends at 11:59pm on 06/10/10.
12.Entries for each weekly draw close at 11:59pm on the dates listed in the table below. All draws will take place at Anisimoff Legal, Suite 1, Level 1, 34 Chandos Street, St Leonards, NSW 2065 at 3.00pm on the dates listed in the table below. 13.Winners will be notified by mail and their names will be published at
www.shellvpowerclub.com.au within two (2) days of being drawn. Any winners who are residents of Victoria will have their name published in The Australian on 21/10/10. The Promoter’s decision is final and no correspondence will be entered into.
14.Prizes in each weekly draw will be awarded to the first number of valid entries drawn corresponding to the quantity of prizes for that weekly draw as listed in the table below:

16.The Ferrari Drive Day package prize includes:

For both of the Ferrari Overnight Escape and Ferrari Drive Day prizes, spending money, additional meals, taxes, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prizes must be taken on the dates specified by Prancing Horse Pty Ltd which will be before 31/12/11 and are subject to booking and flight availability.
17.Frequent flyer points will not form part of a prize. Prizes are subject to the standard terms and conditions of the relevant service providers. Winners may be required to present credit card at time of accommodation check in.
18.Ferrari vehicles will be supplied by Prancing Horse Pty Ltd and must only be driven by persons who meet the Driver Eligibility Criteria specified in Clause 2. Winners of a prize will procure that any other person who intends to drive a Ferrari vehicle satisfies the Driver Eligibility Criteria, and authorise Prancing Horse Pty Ltd to make enquiries with the local traffic authority in relation to the validity of any participant’s driver’s licence. Insurance is included as part of each prize on the provision that all drivers agree to pay an ‘at-fault’ insurance excess of up to $10,000 in the event that they are responsible for any damage.
19.The model and type of vehicles that will be made available to winners of a prize depends on availability at the time the prize is taken. In the event a certain car is not available, a suitable replacement (determined by the Promoter in its absolute discretion) will be offered.
20.Prancing Horse Pty Ltd will provide each winner with a selection of dates in which the prize can be taken on. All components of a prize must be taken together as a single trip, to coincide with one (1) of the selection of dates offered by Prancing Horse Pty Ltd when the prize is drawn. If for any reason a winner does not take a prize or any part of a prize within the designated time, then the prize or that part of the prize will be forfeited and not redeemable for cash.
21.In the event of a cancellation of the driving component of the prize (due to unforeseen circumstances such as dangerous weather, road closures, or mechanical repairs), Prancing Horse Pty Ltd will notify winners of the cancellation and an alternative date will be advised.
22.If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute that prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
23.Total prize pool value is up to AUD $52,800. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
24.A draw for any unclaimed prizes may take place on 07/01/11 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by mail and their names will be published in The Australian 21/01/11.
25.Eligible Entrants consent to the Promoter using the Eligible Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrants; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
27.Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.
28.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize. Where the law implies warranties which cannot be excluded, the Promoter's liability for breach of those warranties is limited to re-supplying a prize (or paying for the costs thereof), where this is permitted by law.
29.As a condition of accepting any prize, the winner (and any companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
30.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities, and winner’s names may be published. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, research, profiling and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Subject to this paragraph, all personal information collected from entrants will be handled in accordance with the Shell Privacy Policy which can be accessed by visiting
