CONDITIONS OF ENTRY
1. Instructions on „how to enter‟ and prizes form part of these conditions of entry. Participation in this promotion is deemed acceptance of these terms and conditions of entry.
2. Entry is only open to residents of Australia who are 18 years and over and who sign up to become a Summer Fix member during the promotional period. Employees, of the Promoter and their immediate families and companies associated with this promotion are ineligible to enter.
3. Entrants must go to ninemsn Summer Fix page at
www.thefix.ninemsn.com.au/summerfix and follow the prompts to become a Summer Fix Member / competition page. Entrants must become a Summer Fix Member by entering their full name, email address, telephone number and full address to be eligible to go in the draw. Submit your Membership/ entry as directed.
4. By becoming a Summer Fix member, each entrant consents to Ninemsn Pty Ltd using their personal details for the purpose of sending at least one (1) email communication per month. The collection, use and disclosure of personal information provided is governed by Ninemsn Pty Ltd Privacy Policy (see
www.ninemsn.com.au)
5. A maximum of one prize will be awarded per person in each Promotional Period (excluding SA and ACT residents).
6. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant‟s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. Promotion commences 0:01am 03 October 2011 and closes 11:59pm 13 February 2012 (“Promotional Period”) with monthly draws taking place, in accordance with the table A below. All draws will take place at Promoter‟s premises, Level 4, 54 Park Street, Sydney 2000 on the dates and times specified in the below table A. All times indicated are AESDT or AEST unless specified otherwise. Winners will be notified by email and telephone using contact details provided in their entry and the names of winners of prizes valued at over $250 will have their names published in The Australian newspaper on the dates stipulated in the below table. For the removal of doubt non-winning entries will roll over into the next promotional period.

8. The Promoter may conduct such further draws at the same time and place as the original draw as are necessary at 11.00am AEST on Monday 21 May 2011 in order to distribute any prize that remain unclaimed by that date, subject however to all reference to any relevant state and territory regulations. In the event of a winner in the unclaimed prize draw, the winner will be notified in writing and their name will be published in The Australian within on the 24 May 2011.

10. Items included in the prize pack (including but not limited to titles, colours, brands, designs, flavours etc) are determined by the Promoter in its complete discretion.
11. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the Cleo Swim Party, Cleo Bachelor 25 year anniversary or Home Bake (Sydney) is postponed, cancelled, rescheduled or relocated for any reason whatsoever.
12. Tickets to the Cleo Swim Party, Cleo Bachelor 25 year anniversary or Home Bake (Sydney) is a general admission only and does not include the winner being able to walk the red carpet or participation in any initiation only or restricted access components of the event. Any other meals and drinks (unless specified) are at the expense of winner.
13. Where prize includes travel (airfare) from the winners nearest capital city to Sydney, if the winner is a resident of Sydney flights will not be included in the prize.
14. Where prize involves the attendance of an event and/ or travel, then that prize must be redeemed in full by the date specified in the above table, In the event that for any reason whatsoever the prize is not redeemed by this date , the prize will be forfeited by the winner and cash, nor any other prize will be awarded in lieu of the prize being forfeited.
15. Hotel Accommodation is subject to Availability or change without notice. Selection of accommodation venue is determined by the Promoter in its complete discretion.
16. Changes to flight schedules may require additional overnight accommodation at either commencement, during the itinerary, or on completion of the trip. Any such additional accommodation is not included in the prize pack and is the responsibility of the winner.
17. The winner (and their companion) are responsible for all other expenses including but not limited to taxes, surcharges, spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, and all other ancillary costs.
18. A credit card imprint or cash deposit will be required from the winner at check-in of the hotel for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
19. Prize values are based upon the full fare prices at the time of competition terms lodgement. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date. In the event that the prize, or part of the prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments
20. For any travel based prizes, unless expressly stated in these conditions of entry all other expenses (including travel to and from the departure point) become the responsibility of the winner.
21. The prize (or any part thereof) cannot be sold, is not transferable or exchangeable and cannot be taken for cash.
22. The winner (and any companions) must travel on the same dates, depart from and return to the same point of departure and travel together. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The Promoter‟s decision is final and no correspondence will be entered into. All elements of the prize must be taken together within the one trip. The winner will not be compensated for unused portions of the prize.
23. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
24. Incomplete, indecipherable, illegible or inaudible entries will be deemed invalid.
25. Any incorrect details submitted may render the corresponding entry invalid.
26. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
27. Any change in the value of a prize occurring between the publishing date of these conditions of entry and the date the prize is claimed is not the responsibility of the Promoter.
28. The Promoter‟s decision in relation to any aspect of the competition is final and binding on every person who enters and no correspondence will be entered into.
29. The Promoter accepts no responsibility for late, lost or misdirected, illegible, inaudible or incomplete entries.
30. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
31. If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by a regulatory authority, to cancel, terminate, modify or suspend the competition.
32. In the event that a prize (or part of any prize) is not available, the Promoter reserves the right to substitute a prize (or that part of a prize) with an alternative prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
33. If for any reason whatsoever a Trip Prize winner does not take the Trip Prize or an element of the Trip Prize at the time stipulated by the Promoter, then the Trip Prize or that element of the Trip Prize will be forfeited by the prize winner and cash will not be awarded in lieu of the Trip Prize or that element of the Trip Prize.
34. Unless expressly stated within these Conditions of Entry regarding all prizes, all other expenses become the responsibility of the winner.
35. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Terms and Conditions would contravene any statute or cause any part of these Conditions of Entry to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these Conditions of Entry all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter‟s control); (b) any theft, unauthorised access or third party interference; (c) any entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in reward value to that stated in these Conditions of Entry; (f) any tax liability incurred by a successful claimant or entrant and/or (g) a prize or use of a prize.
36. Entries remain the property of the Promoter and the Promoter and Ninemsn Pty Ltd collect entrants‟ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and for related purposes which would reasonably be expected without your permission. For example, they may from time to time use your personal information to provide you with information about products, services and future promotions which they expect may be of interest to you. However, they do respect your right to direct them not to do this if and when any future communication is sent to you by the Promoter in writing.
37. By entering the promotion, the entrant consents to receipt of any email regarding the promotion from the Promoter and other emails which inform the entrant of the Promoter‟s other publications, products, services and events and to promote third party goods and services it may be interested in.
38. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this competition is governed by the Privacy Notice (please see Contents page of any ACP Magazines Ltd magazine title for location in each issue).
