3. Entry is only open to Australian residents aged 21 years of over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Individuals can enter through the “Taste California” application on the Facebook Platform. This is located on the “Taste California” tab on the California Australia Facebook Page on Facebook (
www.facebook.com/visitcaliforniaAU). Individuals must “Like” the California Australia Facebook Page and agree to allow the “Taste California” application before proceeding to submit an entry.
5. To submit an entry, entrants must then answer the question in 25 words or less ‘what foodie experience you are most excited to try in California and why’ using the “Taste California” application by 11:59pm AEDST on 04/12/2011.
6. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at

Entrants understand that they are providing their information to the Promoter and not Facebook. 11. The judging will take place at Gate 7, 32 Crown Street, Woolloomooloo NSW 2011 on the dates specified in the above table. The winners will be notified by email. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the literary and creative merit to the answer provided to the question. Entries in each Round will NOT be entered into any subsequent Rounds. The Promoter’s decision is final and no correspondence will be entered into.
12. The five (5) best valid entries in each Round, as determined by the judges, will each win a Pre-Paid Visa card valued at $100.
13. The Promoter will then judge the twenty five (25) winning entries from all Rounds in a final round (“Final Round”) on 04/12/2011 at the same location stipulated in clause 12 above to determine the winner of the major prize. The best valid entry in the Final Round, as determined by the judges, will win the major prize. The major prize is a trip for two (2) adults to California, USA for seven (7) nights valued at up to AUD$8,200. The major prize includes:
return economy class airfares from the winner’s nearest capital city to San Francisco, USA;

transfers from Mendecino County, USA to San Francisco Airport 14 .Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 30/11/2012 and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or other peak periods. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.15. As a condition of accepting the major prize, the major prize winner (and his/her/their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
16. The dinners, tours and activities included in the major prize are subject to each venue’s terms and conditions, including any applicable age restriction. The Promoter and organisers hereby expressly reserve the right to eject the major prize winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the major prize.
17. Any ancillary costs associated with redeeming the Pre-Paid Visa card are not included. Any unused balance of the Pre-Paid Visa card will not be awarded as cash. Redemption of the Pre-Paid Visa card is subject to any terms and conditions of the issuer including those specified on the Pre-Paid Visa card.
18. If for any reason a winner does not redeem the prize by the time stipulated by the Promoter, then the prize will be forfeited.
19. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of any prize) with a prize to the equal value and/or specification.
20. Total prize pool value is $10,200. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
21. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
22. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
24. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
