"UNLOCK XPERIA FACEBOOK" PROMOTION1.Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Entry is only open to Australian residents aged 18 years or over.
3.Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4.To be eligible to enter individuals must complete the following steps during the promotion period:
(a)visit the Sony Ericsson Australia Facebook Page (
www.facebook.com/sonyericssonau); and
(b)become a fan of the page by clicking the ‘like’ button (if not already a fan).
5.To enter, individuals must then:
(i)click the Unlock Xperia Crack the Code application on the Sony Ericsson Australia Facebook Page;
(ii)input the requested details including their full name, last name and valid email address (phone number is optional);
(iii)read and accept the Terms and Conditions for the promotion by clicking the relevant box; and
(iv)enter any four digit code on the Sony Ericsson digital keypad to attempt to unlock the phone; and
(v)click the ‘submit and finish’ button.
6.If a valid entrant successfully unlocks the phone they will receive a congratulatory message letting them know they have won an Xperia arc mobile handset valued at $669. They will also be contacted via email to advise them that they have won. If an entrant’s code does not unlock the handset they will receive a message stating that their guess is incorrect.
7.The Promoter will change the code required to unlock the digital Sony Ericsson phone (“Winning Code”) ten (10) times during the promotion. Each Winning Code will be able to unlock the digital phone on the Facebook Page for a maximum of four (4) days, subject to clause 8. After four (4) days have lapsed a new Winning Code will be required to unlock the digital Sony Ericsson phone.
8.Once a Winning Code is played by a valid entrant, the game will no longer be able to be played for that day. A new Winning Code will be applied to the digital phone in the Sony Ericsson Unlock the Phone application the following day.
9.The promotion starts on 22/11/11 and the latest it will end is at 8pm AEDST on 31/12/11. The promotion will be available between 8am AEDST and 8pm AEDST each day of the promotion period, subject to the above.
10.If a phone is not unlocked by the second day of it being on the Sony Ericsson Unlock the Phone application, the first digit of the 4 digit winning code will be revealed to entrants via a Sony Ericsson Australia Facebook wall post. If a phone has not been unlocked by the third day of it being on the Sony Ericsson Unlock the Phone application, the second digit of the 4 digit winning code will be revealed to entrants via a Sony Ericsson Australia Facebook wall post. Finally, if the phone has not been unlocked by the fourth day of it being on the Sony Ericsson Unlock the Phone application, the third digit of the 4 digit winning code will be revealed to entrants via a Sony Ericsson Australia Facebook wall post.
11.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
12.In the event that no entrants have been able to correctly guess the Winning Code after four days of the code being applied to the phone in the game application, the applicable prize will be deemed un-won. The un-won prize will be given to the entrant with the code closest to the Winning Code (e.g. if Winning Code is 1234, and an entrant guesses 1235, they will be deemed the winner of the un-won prize). If two or more entrants are equally close to the Winning Code (e.g. one entrant submits the code 1235 and another submits the code 1233, and the Winning Code is 1234), then the entrant who submits their tied entry first will be deemed the winner of the un-won prize.
13.Incomplete or indecipherable entries will be deemed invalid.
14.Multiple attempts at guessing the winning code is permitted per person.
15.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
16.On submission of an entry, an entrant will need to wait until the digital hand manually enters the code they have entered on the digital keypad, before being notified if they are a winner or not. Entrants will be placed in a queue if there are too many entrants entering at the one time. They will only be notified of winning/not winning once the hand has played out the code they entered. The entrant may at the time of entry select to be notified via email when their guess is coming up. If they do so, they will be notified via email when there are approximately 10 guesses remaining before their guess will be played out. If an entrant’s guess is correct, they will be notified via email.
17.The Promoter’s decision is final and no correspondence will be entered into.
18.Each valid entrant who is the first to validly enter a Winning Code will win a Sony Ericsson Xperia mobile handset valued at $669. There are ten (10) prizes to be won in total throughout the promotion, one for each Winning Code that is applied to the digital phone in the game application.
19.Mobile phone prize is a handset only. The winners will be responsible for making all arrangements for connection with a service provider and payment of all associated connection, access and call charges.
20.All winners will have their names published in The Australian newspaper on 9/1/12.
21.If for any reason a winner does not take a prize then the prize will be forfeited.
22.If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a
regulatory authority.
23.Total prize pool value is $6,690.
24.Prizes are not transferable or exchangeable and cannot be taken as cash.
25.Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
27.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
28.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
29.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

31.As a condition of accepting the prize, a winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
32.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
