Terms and Conditions
1) Information on how to enter this promotion and the prizes form part of these Terms and Conditions.
Entry into the promotion or acceptance of the prize is deemed acceptance of these Terms and
Conditions.
2) The Promoter is American Express Australia Limited (ABN 92 108 952 085), 12 Shelley Street,
Sydney NSW 2000, Ph (02) 9271-1111 (“Promoter”).
3) The promotion commences at 12:01am AEDST on 01/12/2012 and
ends at midnight AEDST on
24/12/2012 (“Promotion Period”). 4)
This promotion contains two (2) elements:
i) daily instant win (“Instant Win”); and
ii) the major prize draw (“Major Prize draw”). 5) Subject to clause 6 below, entry is only open to residents of Australia aged 18 years or over
(“Eligible Entrants”).
6) Directors, management and employees (and their immediate families) of the Promoter, its agencies
associated with this promotion and Maltese Falcon Pty Ltd trading as Anisimoff Legal (ABN 40 134
644 689) and their respective related bodies corporate, are not eligible to enter this promotion.
Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle,
aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
7) To enter, Eligible Entrants must, during the Promotional Period (“Instant Win Entry”),
a) visit the Promoters Facebook page at
www.facebook.com.au/americanexpress or the
website
www.lightupyourseason.com.au to be directed to the Promoter’s Facebook page
(either via their mobile phone handset capable of accessing the Promoters Facebook page
or their computer);
b) enter through the “Light Up Your Season” application on the Facebook Platform. This is
located on the “Light Up Your Season” tab on the Promoters Facebook page; and
c) fully complete and submit the online entry form.
By completing the Instant Win Entry, an Eligible Entrant will:
a) automatically have a chance to win in the Instant Win component of the promotion for that
day (as per clause 15); and
b) receive one (1) Major Prize entry.
A maximum of one (1) Instant Win Entry per day is permitted per Eligible Entrant.9) At the time of completing their Instant Win Entry in accordance with clause 6), Eligible Entrants will
be given the opportunity to “post” their participation in the Promotion on their Facebook wall.
Eligible Entrants will receive one (1) additional entry in to the Major Prize draw per each Facebook
friend who clicks their shared post, and successfully submits an Instant Win Entry into the
Promotion by following clause 7 on the same day of the Eligible Entrant’s post on their Facebook
wall.
10) Multiple entries permitted into the Major Prize draw, subject to the following: (a) only one (1) initial
entry permitted per Eligible Entrant per day in accordance with clause 8; (b) only one (1) additional
entry permitted per each Facebook friend who clicks on an Eligible Entrant’s shared post, and successfully submits an Instant Win Entry into the Promotion in accordance with clause 9; and (c)
each entry must be submitted separately and in accordance with entry requirements.
11) All entries will be deemed invalid if incomplete or indecipherable.
12) The Promoter accepts no responsibility for:
a) any late, lost or misdirected entries; or
b) instances where Eligible Entrants are not entered into the Major Prize draw due to forces
beyond the Promoter’s control.
13) If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its
sole discretion, to determine the identity of the Eligible Entrant.
14) At the time of completing their Instant Win entry, Eligible Entrants will be notified immediately
onscreen whether or not they are an Instant Winner. The Instant Winner is determined using a
random computer generated selection system based on the number of prizes allocated to each day
and an algorithm that randomly distributes timeslots throughout those days, prior to promotion
beginning. Instant Winners of all prizes will have their names published online at
www.lightupyourseason.com.au by 02/01/2013 for a period of 28 days.
15) Instant Win Entry for each day commences at 12:01am AEDST and ends at midnight AEDST each
day during the Promotional Period. Instant Win Entry prizes are awarded for each day of the
Promotional Period as follows:

17) Pink Concert Prize includes double pass tickets to a Pink concert of the winner’s choice (as detailed
below) including one (1) night’s twin share accommodation (minimum 3 star) and return limo
transfers between hotel and concert venue. Flights, spending money, meals, insurance, transport to
and from departure point, additional transfers outside of those to and from the concert venue from
the hotel, items of a personal nature, in-room charges and all other ancillary costs are not included.
The winner may be required to present their credit card at time of accommodation check in. Pink
Concert Prize must be taken to coincide with a Pink concert of the winner’s choice (as detailed
below) and is subject to booking availability:

18) The Major Prize draw will take place at midday AEDST on 27/12/2012 at Message Media, Level 22,
385 Bourke Street, Melbourne VIC 3000. The Major Prize winner will be notified in writing via email
within two (2) business days of the draw and their name will be published online at
www.lightupyourseason.com.au by 02/01/2013 for a period of 28 days.

The first valid entry drawn in the Major Prize draw will win a VW Polo 2011 Trendline 5 Door with
manual or automatic transmission. Total Major Prize is valued at up to $26,000 RRP, including all
on road costs, registration, compulsory third party insurance, stamp duty and dealer delivery
charges (which may vary State by State). Additional insurance, options, petrol and all other
ancillary costs are the responsibility of the winner. The Promoter may, in its absolute discretion,
accommodate the winner’s colour preference (excluding metallic options), subject to availability.
The winner must collect the prize from their nearest authorised VW dealership.
20) If the Major Prize winner is an AMEX cardholder at the time of winner notification (pursuant to
clause 19), the Major Prize will also include a $2,000 Caltex fuel voucher (“Bonus Prize”). For

The total prize pool value (which includes all instant prizes and the Major Prize and Bonus Prize) is
up to $93,765. Prizes, or any unused portion of a prize, are not transferable or exchangeable and
cannot be taken as cash, unless otherwise specified.
22) Prizes are subject to the standard terms and conditions of individual prize and service providers.
23) The Promoter reserves the right to redraw in the event of an Eligible Entrant being unable to satisfy
these Terms and Conditions or forfeiting or not claiming a prize. Subject to any written direction
given under applicable law, the redraw will occur at the same place and time as the original Major
Prize draw on 27/03/2013. Winners, if required, will be notified in writing within two (2) business
days of the draw. Winners’ names will be published online at

29/03/2013 for a period of 28 days.
24) The use of any automated entry software or any other mechanical or electronic means that allows
an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by
that entrant invalid.
25) Any cost associated with accessing the promotional website is the entrant’s responsibility and is
dependent on the Internet service provider used.
26) Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless
otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess
of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised
total prize pool will be awarded in the unclaimed prize draw. Instant win game materials void if
stolen, forged, mutilated or tampered with in any way. There will be a total of 515 electronic instant
win notifications for this promotion.
27) If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to
substitute the prize (or that part of the prize) with a prize to the equal value and/or specification,
subject to the directions of the State and Territory lottery departments. 28) If any act, omission, event or circumstance occurs which is beyond the reasonable control of the
Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the
Promoter reserves the right to: (i) disqualify an Eligible Entrant; or (ii) subject to the directions of the
State and Territory lottery departments, to cancel, terminate or modify or suspend this promotion.
29) Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or
modify the statutory consumer guarantees as provided under the Competition and Consumer Act,
as well as any other implied warranties under the ASIC Act or similar consumer protection laws in
the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that
cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the promotion.
30) Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) are not
responsible for and exclude all liability (including negligence), for any personal injury; or any loss or
damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in
any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the
Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or
prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by
the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in
Minor Prize or Major Prize value to that stated in these Terms and Conditions; (e) if a Pink concert
is cancelled for delayed or any reason beyond the reasonable control of the Promoter; (f) any tax
liability incurred by a winner or Eligible Entrant; or (g) use of a prize.
31) Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the
event they are a winner (including photograph, film and/or recording of the same) in any media for
an unlimited period without remuneration for the purpose of promoting this promotion (including any
outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
32) Privacy Consent: Entry details remain the property of the Promoter. To provide Eligible Entrants
with this promotion, the Promoter needs to collect personal information about each Eligible Entrant.
If the Eligible Entrant does not provide the information requested, the Promoter may not be able to
provide the Eligible Entrant with entry into the promotion. In Australia, the American Express
Privacy Policy Statement sets out policies on management of personal information. To arrange
access to your personal information, to request a copy of the American Express Privacy Policy
Statement or to enquire generally about privacy matters, write to the Promoter. Each Eligible
Entrant agrees that subject to the Privacy Act, the Promoter or its agents may do the following:
transfer personal information confidentially to the Promoter or other organisations that
provide services/prizes in relation to this promotion, including transferring personal
information to Australia, USA or other countries for processing;
disclose Eligible Entrants’ personal information to State and Territory lottery departments;
publish winner’s name as required under applicable law;
use entry details for promotional, marketing, publicity, research and profiling purposes,
including sending electronic messages or telephoning the Eligible Entrant; and
use winner’s personal information in any media for publicity purposes associated with the
promotion without any further payment or other compensation, unless the winner otherwise
notifies the Promoter at the time of accepting a prize.
33) As a condition of accepting a prize, a winner must sign any legal documentation as and in the form
required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited
to a legal release and indemnity form.
34) The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants
(including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible
Entrant who is engaged in unlawful or other misconduct calculated to jeopardise the fair and proper
conduct of the promotion or who tampers with the entry process. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Errors and omissions
may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at
any stage does not constitute a waiver of those rights.
35) Entry and continued participation in the promotion is dependent on entrants following and acting in
accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at
www.facebook.com/terms.php.
36) This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
Entrants understand that they are providing their information to the Promoter and not to Facebook.
The information an entrant provides will only be used for the purposes outlined in these Terms and
Conditions. Any questions, comments or complaints about this promotion must be directed to the
Promoter and not to Facebook.
37) In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to
cancel, terminate, modify or suspend the promotion or suspend or modify the promotion, subject to
any written directions from a relevant regulatory authority.
38) The result of the Instant Win, Major Prize draw and the unclaimed prize draw is final, and no
correspondence shall be entered into.
