8.Each Claimant who is offered the opportunity to play the Game and who plays the Game in the manner required will be awarded one (1) gift. The type of gift awarded to the Claimant will be determined at random and not by the use of any skill. Once a Claimant completes a Game Play, a message will immediately appear on-screen confirming the Game Play has been successfully completed and advising the Claimant which gift they have been awarded. The name and locality of the Claimant who is awarded AUD$5,000.00 cash will be published on the Promotional Websites within seven (7) days of the close of the Offer Period and will remain on the Promotional Websites for twenty eight (28) days.
9.Each successful Claimant must provide their full name in the manner required as set out in the Game to claim their gift. Once submitted they will automatically be sent an email from the Promoter to the email address provided in the claim process to explain how to claim their gift. 11.Total gift pool value for this offer is up to AUD$1,048,069.80. Gifts are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). 14.The Wet’n’Wild Sydney Gold Season double pass includes unlimited admission during the 2013/2014 public operating season, free parking all season, exclusive entry – a dedicated entry gate for Season Gold pass holders, in-park discounts – 10% off select meal deals at the in-park dining facilities. Unless otherwise stated, fees for parking, food, merchandise, locker rentals, Fast Pass, pay-per-ride attractions (The Surf Deck and Sydney SkyCoaster), special concerts or events are not included in season pass prices. 17.The movie voucher can be redeemed from

Each voucher is valid for four (4) adults to see a general admission screening of the movie of their choice including those designated as No Free Ticket sessions, up to the value of $19.00, at Village, Greater Union, Birch Carroll Coyle or Event cinemas nationwide. Movie tickets cannot be split or used at different times. Voucher price excludes any 3D/Real D or VMAX surcharge which is in addition to the voucher value and is payable by the user if applicable. 18.Wet‘n’Wild Sydney Gold Season double passes and Theme Park VIP double passes do NOT include travel and/or transport to and from the Claimant’s ordinary residential address and Sydney or the Gold Coast, Australia (as applicable), or accommodation in Sydney or the Gold Coast, Australia (as applicable). For the avoidance of doubt, each Claimant who is awarded a Wet’n’Wild Sydney Gold Season double pass or a Theme Park VIP double pass and their companion (if any) must make their own way (at their own cost and responsibility) to the relevant theme park location. Any other additional travel and accommodation expenses are also at the cost and responsibility of the Claimants (as applicable). Additional costs may include, but are not limited to, transfers, meals, beverages and spending money.
19.Acceptance and redemption of Wet’n’Wild Sydney Gold Season passes and Theme Park VIP passes is subject to any prevailing terms and conditions of the gift suppliers, and in particular, age, health, behaviour, and safety requirements. Each Claimant who is awarded a Wet’n’Wild Sydney Gold Season pass or a Theme Park VIP pass and their companion (if any) must follow all reasonable directions given by the Promoter and any gift supplier during the course of their participation in the gift, including all directions relation to age, health, behaviour, safety. Each Claimant and their companion (if any) acknowledges that these gifts may involve a dangerous activity, which may result in injury or death, and participate at their own risk. The Promoter and any gift supplier reserve the right in their absolute discretion to disqualify, sanction and/or remove a Claimant and/or their companion (if any) from the relevant theme park or refuse to allow the Claimant and/or their companion (if any) to take part in any or all aspects of the gift on the grounds of inappropriate behaviour, for age, health or safety reasons, or for any breach of these Conditions of Offer generally. If a Claimant and/or their companion (if any) fails to redeem a Wet’n’Wild Sydney Gold Season pass or a Theme Park VIP pass in the manner required, as stated in this condition and in the reasonable opinion of the Promoter, their claim and the balance of the gift will be forfeited with no compensation payable.
20.Any passes, tickets or vouchers issued by the Promoter in this offer are subject to prevailing terms and conditions of use and are not replaceable if lost, stolen or damaged.
21.The Promoter reserves the right to request a Claimant’s companion (if any) produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the companion’s identity and age before issuing a Wet’n’Wild Sydney Gold Season pass, Theme Park VIP pass or movie voucher.
22.It is a condition of accepting a gift that the successful Claimant (and their companion, if any) may be required to sign a legal release or releases in a form determined by the Promoter and/or any gift supplier in its or their absolute discretion.
23.As a condition of participating in this offer, a Claimant consents to, in the event that they receive a gift, the Promoter using the Claimant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the offer (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Claimant agrees that, in the event that they receive a gift, the Claimant will participate in all reasonable promoted activities in relation to the offer as requested by the Promoter and its agents.
24.Claims will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Claims received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible claims will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected claims. Contact details entered incorrectly by a Claimant will deem a claim invalid.
25.Costs associated with accessing a Promotional Website remain a Claimant’s responsibility and may vary depending on the Internet service provider used.
26.The use of any automated claim software or any mechanical, electronic or other means that allows a Claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that Claimant invalid.
27.Claimants can only participate in their own name and email address. Claimants who provide incorrect, misleading or fraudulent information are ineligible to participate in the offer and all claims of a Claimant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Claimant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Claimant’s identity, age, residential address, eligibility to participate in a Game Play and claim a gift, and any information submitted by the Claimant in participating in the offer, before issuing a gift. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or a Claimant or claim has not been verified or validated to the Promoter’s satisfaction then all the claims of that Claimant will be ineligible and deemed invalid.
28.The Promoter reserves the right to verify the validity of any and all claims and reserves the right to disqualify any Claimant for: (a) tampering with the claim process; (b) submitting a claim which is not in accordance with these Conditions of Offer; or (c) engaging in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the offer. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
29.A gift will only be awarded where the Claimant fulfils all of the requirements of the Promoter’s validation and verification tests and procedures. The validation and verification tests and procedures shall be determined by the Promoter in its absolute discretion. Electronic and other quality control errors will not invalidate an otherwise valid claim. Unless otherwise due to fraud or ineligibility under these Conditions of Offer, all claims in excess of the advertised gift pool will be met.
30.If this offer is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this offer, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the offer and/or, if necessary, to provide an alternative gift or gifts to the same value as an original gift or gifts, subject to any written directions made under applicable State legislation.
31.The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable Consumer Guarantee under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth)), for any direct or indirect injury, loss and/or damage arising in any way out of the offer. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this offer and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this offer as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged claims, gift claims or gifts; and/or (iv) acceptance and/or use of any gift. Applicable manufactures and/or distributors should be contacted in regards to all gift warranty claims.
32.If a gift becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable gift of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State legislation.
33.Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this offer may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Offer or any other legal obligation by a Claimant, the Claimant agrees to indemnify the Promoter for those losses, damages and costs.
34.The Promoter collects personal information about a Claimant to include the Claimant in the offer and, where appropriate, award gifts. If the personal information requested is not provided, the Claimant cannot participate in the offer and is deemed ineligible. A Claimant also agrees that the Promoter may, in the event the Claimant is awarded AUD$1,000.00 cash, publish or cause to be published the Claimant’s name and locality in any media, as required under the relevant State lottery legislation. 35.By participating in the offer and opting in in the manner required on a Promotional Website, a Claimant also acknowledges that a further primary purpose for collection of the Claimant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Claimant in the future with information on special offers or to provide the Claimant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
