FEBFAST 2014 “Win a Spa in Bali” PROMOTION TERMS AND CONDITIONS OF ENTRYThe following terms and conditions (Terms and Conditions) apply for the FebFast 2014 “Win a Spa in Bali” Promotion (the Promotion). By submitting an entry into the Promotion, the entrant warrants that they have read, understood and accepted these Terms and Conditions.
1. The Promotion is conducted by YSAS Pty Ltd (ABN: 51 080 593 380) owner of the FebFast 2014 Campaign, (FebFast or the Promoter, 03 8412 8529).
2. The primary prize provider is YTL Hotels as owner of the Spa Village Resort, Tembok, Bali (Prize Provider).
3. Information on how to enter and prizes available as part of the Promotion form part of these Terms and
Conditions.
4. Entry to the Promotion is only open to an individual who is:
(a)
an Australian resident aged 18 years and over;(b) not an employee of the Promoter or the Prize Provider; and
(c) not a spouse, defacto spouse, parent, child or sibling of such an employee,
(Entrants).
5. The Promotion opens to Entrants at 9:00am on 1 December 2013 AEST
and closes at 5:00pm on 1 March 2014
AEST (Promotion Period).6. To enter the Promotion, Entrants must during the Promotion Period:
(a) visit the Promotion webpage at
www.febfast.org.au;(b) follow the prompts on the Promotion webpage to register for the Promotion by entering their first name,
last name, and provide confirmation that they are an Australian resident where indicated; and
(c) answer in 30 words or less (Promotion Reply)the Promotion questions asked by FebFast on the
Promotion webpage (Promotion Query); and
.
7. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s
identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions, whose validity as an Entrant cannot be verified to the satisfaction of the Promoter, or who tampers with the entry process in any way. All Entrants must deliver to the Promoter copies of any documentation the Promoter may require to verify the eligibility of the Entrant on request.
8. Errors and omissions in any entries may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable, or illegible entries will be deemed invalid.
9. The Promotion is a game of skill and chance plays no part in the determination of winners. Each entry will be individually judged according to the merits of the Entrant’s Promotion Reply as determined by the Promotion judges,in their sole and absolute discretion. The Promotion judges will be appointed by the Promoter and will include representatives from the Promoter and the Prize Provider. The decision of the judges is final and binding and no correspondence will be entered into with an Entrant (or any other person) in respect of the judge’s decision(s). In the event of a tie between the Promotion judges, the Entrant with the highest Referral Points wins.
(a) One referral point is earned through the following process: having completed an Entry, the Entrant must refer a friend by sharing a unique url to their Facebook page. In the event an individual then uses the url and successfully completes competition entry, the Entrant earns one referral point.
10. The winner will be notified by email within 10 business days of the end of the Promotion Period andthewinner’s name will be published on the Promotion webpage and the FebFast Facebook site located at
www.facebook.com/febfastaustralia.
11. If the winner fails to respond to the Promoter and claim the prize within 30 days of being notified of his or her winning entry, then the prize will be forfeited and the Promotion judges will be entitled to determine a subsequent winner in accordance with clause 9. The subsequent winner must respond to the Promoter and claim the prize within 30 days of being notified of his or her winning entry or the subsequent winner will also forfeit the prize and the same process to find a winner will be conducted again.
12. The winner must deal directly with the Prize Provider to redeem the prize and organise any travel arrangements following notification from the Promoter of his or her winning entry. All flights to and from Denpasar, Bali must be arranged directly between the carrier nominated by Febfast and the winner. The Promoter accepts no responsibility for organising or arranging any travel arrangements (including accommodation and flights) relating to the prize.
13.
The prize includes three main elements:
(a) Seven (7) days/ Six (6) night’s accommodation for two (2) adults at the Spa Village Resort, Tembok,
Bali (Resort). Further information about the Resort can be found at the Resort’s website athttp://www.spavillageresort.com/tembokbali/
(b) The Resort’s “School of Life” package for two (2) adults. Further information relating to the “School of Life” package can be found at
]http://www.spavillageresort.com/tembokbali/wellness_lifestyle/school_of_life.htm and includes:
(i) Pre-programme consultation and creation of a personalised itinerary a week prior to arrival.
(ii) Welcome upon arrival at Denpasar airport, followed by car transfer to the Resort;
(iii) Welcome footbath ritual on arrival at the Resort (or at a suitable time arranged between
yourself and the Resort, depending on the Resort’s availability) to symbolise the start of
purification and preparation of total relaxation;
(iv) Healthy food and drinks throughout the stay with breakfast, lunch and dinner included.
Beverages are not include although herbal teas are included as part of the detox program.
(v) Daily creativity class, awareness and wellness workshops and movement practice including
yoga (for 2 people), no limit subject to availability and as per the wellness program specifically
tailored to your needs.
(vi) One (1) healthy cooking class of one hour during your stay for 2 people;
(vii) One (1) spa pre-treatment followed by a 50-minute flower body scrub for 2 people and as per
the wellness program specifically tailored to your needs.
(viii) One (1) spa pre-treatment followed by a 50-minute 3-point-massage for 2 people;
(ix) One (1) spa pre-treatment followed by a 50-minute detoxification wrap for 2 people;
(x) Three (3) evening detoxifying mineral baths;
(xi) One (1) conclusion session of one to two hours for 2 people with SOL facilitator;
(c) A redeemable flight voucher, to be paid for by the Promoter, for the lesser of:
(i) the cost of two (2) adult return economy flights from any Capital City of an Australian State or
Territory to Denpasar, Bali; and/or
(ii) $1,800 in order to contribute to 2 adult return economy flights from any Capital City of an
Australian State or Territory to Denpasar, Bali;
The voucher will be redeemable with a carrier to be nominated by the Promoter. To the extent that the voucher does not cover the costs of 2 adult return economy flights from any Capital City of an Australian State or Territory to Denpasar, Bali, the prize winner will be liable to pay the difference in costs.
14. The total value of the prize is $4,386 (all amounts are in Australian dollars based on foreign exchange rates as at the date of these Terms and Conditions), apportioned as follows:
(a) Accommodation at the Resort for one (1) room for up to a maximum of two (2) adults and the ‘School of
Life’ package for two (2) adults valued in total at USD$2,360 (or A$2,586 at time of conversion) and
(b) Return economy flights from any Capital City of an Australian State or Territory to Denpasar, Bali up to
a maximum value of A$1,800 for two (2) adults (or A$900 per person).15. The prize is for the winner and one travel companion only. Any costs (including accommodation, flights and ancillary costs) associated with additional travel companions (including any accompanying children), additional accommodation, additional activities or any other item not specifically listed are not included in the prize and will be the responsibility of the winner.
16. Any alterations to the prize or requests for upgrades are subject to availability and the Prize Provider’s absolute discretionand may result in additional costs being incurred by the winner.
17. The winner acknowledges that if any part of the “School of Life” package is unavailable at the time of their booking at the Resort, then the Promoter (and the Prize Provider) will not be liable for any changes made to the package (in the discretion of the Prize Provider) and the Prize Provider may change any component of the package for another item of similar value without recourse by the winner.
18. The travel companion of the winner must be an Australian resident aged 18 years or over.The winner and the travel companion must travel together on the same flight and share accommodation. All components of the prize must be taken together.
19. The prize or any unused portion of the prize is non-exchangeable, non-transferable and is not redeemable for cash or other prizes.
20. Spending money, beverages, taxes (including airline and airport taxes to and from Denpasar, Bali), transfers to and from the main airport at any capital city of an Australian State or Territory , insurance premiums, passports, visas, vaccinations, items of a personal nature, in-room charges and all other ancillary costs are not included in the prize.
21. The winner and the travel companion are responsible for ensuring they have valid passports, and any requisite visas, vaccinations and travel documentation.
22. It is a condition of taking the prize that the winner and their travel companion take out adequate travel insurance (at their cost). The Promoter or the Prize Provider may request that the winner and the travel companion provide evidence of such insurance policy before the prize is taken.
23. An Entrant may enter only one Promotion Reply in relation to each Promotion Query. An Entrant may however enter a Promotion Reply for more than one Promotion Query during the Promotion Period.
24. All travel is subject to flight and accommodation availabilityand the prize is valid for redemption only between 1 March 2014 and 31 October 2014 but excluding the period between 1 July 2014 and 31 August 2014.
25. The Promoter and the Prize Provider accept noresponsibility or liability for any variation in the value of the prize. In the event that the prize is unavailable for any reason, the Promoter reserves the right to substitute the prize for a different prize item of equal or greater value.
26. All Entrants consent to the Promoter using the Entrant’s name, likeness, image or voice in the event they are the winner (including any photograph, film or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this Promotion (including any outcome), and promoting the FebFast 2014 and any future FebFast campaigns. All entries, including the Promotion Replies, become the property of the Promoter.
27. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including as a result of any act or omission of the Prize Provider), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to disqualify any Entrant or modify, suspend, terminate or cancel the Promotion, as appropriate.
28. Costs associated with accessing the Promotion webpage, the FebFast Facebook site and any other social media sites relating to this Promotion (if any) are each Entrant’s responsibility and are dependent on the internet service provider used by the Entrant.
29. Except for any liability that cannot be excluded by law, the Promoter and the Prize Provider (including any of their officers, employees and agents) exclude all liability (including negligence), for any personal injury, death or damage to property suffered or sustained in connection with this Promotion or any prize; and any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to a claim for (or arising out of):
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their
receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner, an Entrant or travel companion; and
(f) use of the prize.
30. As
form required by the Promoter and Prize Promoter in their absolute discretion, including but not limited to a legal release and indemnity form.

The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to FebFast, the Prize Provider and any third parties, including but not limited to agents, contractors, service providers and other prize providers. The Promoter may, for an indefinite period, unless otherwise advised, use the personal information for Promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. Entrants should direct any request to access, update or correct information to the Promoter.
32. These Terms and Conditions are governed by the laws of the State of Victoria, Australia.
