Entry is free to existing and new subscribers of Cruise Passenger open to Australian Citizens aged 18 years and over. Employees of Island Escape Cruises Limited, Cruise Passenger and their immediate families are not eligible to enter. Entries must be submitted via the online entry form provided by Cruise Passenger and include subscriber number. As a condition of entry, entrants agree to sign up to Cruise Passenger and Island Escape Cruises Limited online and mail newsletters. This promotion is being conducted by Island Escape Cruises Limited (“the Promoter”) of 6 Kent Street, Newmarket, Auckland, 1023, New Zealand and runs from 29th November 2013 to 28th February, 2014. There is one prize, which will be awarded to the most creative entry. The Promoter will appoint a panel of judges to evaluate Eligible Entrants’ entries. Entries will be judged on the creativity of answers given. The decision of the judges is final and no correspondence will be entered into. This is a game of skill and chance plays no part in determining the winner. Prize consists of a 6-night cruise for two people, in a luxury en-suite stateroom aboard the Island Passage, departing Opua, NZ in March 2014. Includes gourmet meals, tours and shore visits, 15 minute scenic helicopter flight from the ship, use of tenders, kayaks and fishing equipment, port taxes and charges. Island Escape Cruises Limited will not be responsible for any additional or incurred costs while winner is travelling. Winner is responsible for any associated costs in getting to and from the departure port. Entries close at Midday EDST 28th February 2014. One (1) entry will be selected at 5.00pm on 28th February 2014, from all entries. The prize is strictly NON-TRANSFERABLE & non-negotiable, and may not be replaced or refunded. Entrants can only enter the competition once. Prize-winner will be notified by Island Escape Cruises Limited by 5.00pm on March 1 2014. The winner will be contacted by either email or phone. They will be notified by mail and/or email no later than one week following the prize draw. Results will be published on cruisepassenger.com.au. This promotion does not involve a round in which players are eliminated. Prize letter and prize will be delivered to prize-winner within one week of the winner being decided.
To the extent permitted by law, the Promoter is not responsible or liable for:
(i) inaccurate / incorrect transcription of entry information;
(ii) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, sent with insufficient postage (where entry is by post), or sent other than as directed in the entry instructions;
(iii) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;
(iv) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any Website;
(v) unauthorised human intervention in any part of the competition;
(ii) (vi) electronic or human error which may occur in the administration of the competition;
(vii) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or
(viii) any injury or damage to persons or property, including to the participant’s or any other person’s computer related to, or resulting from, participation or downloading any materials in this competition;
(ix) In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
The prize-winner, and his or her guests (if any), must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner.
This condition does not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.
The personal information of entrants will be collected to enable the Promoter to administer and promote this competition and its winners and may be used to market its services to the entrant. The personal information of the entrants will be held and used in accordance with the Promoter’s privacy policy, which is available from the Promoter. The personal information of winners may be provided to others assisting, including prize suppliers and deliverers, and to authorities that regulate this competition. If an entrant does not truthfully provide all requested personal information, the Promoter may determine that they are not eligible to win the prize.
