How to enter:

To be eligible to enter, consumers must purchase, between 9:00am AEDST on 19/03/2014 and 11:59pm AEST on 08/04/2014 (“Promotional Period”), any two (2) x Lipton Ice Tea products, in a single transaction, from any participating Foodland, IGA & Super IGA stores (“Eligible Transaction”).

To enter, individuals must then visit www.liptonicetea.com.au/competitions, follow the prompts to the competition entry page input the requested details including the date of purchase (as shown on the product purchase receipt), the two (2) product barcodes and then submit the fully completed online entry form.

Entrants must retain an original copy of their store purchase receipt(s) and original product barcode(s) for all entries as proof of purchase. The Promoter may request a copy of the store receipt(s) and original product barcode(s) from the entrant to verify the validity of an entry and reserves the right to declare any entry for which a photocopy of their store receipt(s) and original product barcode(s) cannot be provided invalid.

Terms and conditions:

1.Information on how to enter and redeem prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents. Employees of the Promoter, participating Foodland, IGA & Super IGA stores, the Promoter’s associated companies, the Promoter’s agencies associated with this promotion and their immediate families are ineligible to enter. Entrants under the age of 18 years must obtain the consent of their parent or legal guardian to enter and the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

3. Promotion commences at 9.00am AEDST on 19/03/2014 and all purchases must be made by 11.59pm AEST on 08/04/2014. All entries must be received by 11:59pm AEST on 08.04.2014

4. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Eligible Transaction; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) unrecognised barcode numbers will be deemed invalid.

5. There are thirty-two (32) prizes to be won in this promotion, a total of five (5) major prizes and twenty-eight (28) daily prizes.
 
6. At the end of the promotion, entries will firstly be divided up in to groups based on the date on which their Eligible Transaction was made (according to the date specified on their purchase receipt or as indicated at the time of submitting an entry online).

7. There will be one (1) minor prize allocated for each day of the promotion between 19/03/2014 to 08/04/2014 inclusive (“Daily Prize”). The first valid entry drawn for each day of the promotion, will each win the Daily Prize, which consists of one (1) Mini-Mal Surfboard 7”6 long x 21” wide at RRP $800. Entries into one (1) Daily Prize draw will not be entered into any subsequent Daily Prize Draw.

8. All entries (including daily winning entries) will then be placed into a draw to award the major prizes (“Major Prize”). The first Five (5) valid entries drawn in the draw for Major Prizes will each win a Vespa LX 150 3V with 12 month registration and CTP in the winners state plus a helmet voucher valued at RRP $7,190. (NB Vespa does not include property or comprehensive insurance). Winners can nominate the nearest authorised Vespa dealer in their state for the bike to be delivered to. Winners are required to pick the bike up from this dealer. Prize does not include delivery to winners address. Winner can nominate their colour subject to availability

9. All draws to award a Daily Prize will take place at 5:00pm AEST on 09/04/2014 and the draw to award the Major Prizes will take place at 5:30pm AEST on 09/04/2014. All draws will take place at 30Thirty, Level 2, 50 Yeo Street, Neutral Bay NSW 2089.

10. Total prize pool is valued at AUD RRP $51,160.

11. Winners will be notified in writing within two (2) business of the draw. Winners, except those who have indicated otherwise, will be published in The Australian on 12/04/2014.

12. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.

13. The Promoter reserves the right to verify the validity of entries, at any time during or after the promotion, and reserves the right to disqualify any entrant (and ALL entries submitted by that entrant) for tampering with the entry process, and for submitting an entry which is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

14. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any directions from a regulatory authority.

15. The Promoter may conduct such further draws at the same place as the original draw as are necessary on 10/07/2014 at 5.00pm AEST in order to distribute any prizes unclaimed by that date subject however to any written directions given by a regulatory authority. Winners of the unclaimed prize draw will be notified in writing within two (2) business days of the draw. Winners, except those who have indicated otherwise, will be published in The Australian on 12/07/2014

16. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted from that source and by those entrants invalid.

17. The Promoter accepts no responsibility for tax implications that may arise from acceptance of the prize. Independent financial advice should be sought.

18. Cost of accessing the Internet is the entrant’s responsibility. Any costs associated with accessing the promotional website are the entrant’s responsibility and are dependent on the Internet service provider used. Any contact details entered incorrectly shall invalidate the entry. The Promoter is not responsible for receipt of incomplete or incomprehensible entries. All such inaccurate entries will be deemed invalid. No responsibility is accepted for late, lost or misdirected entries. Any entry that does not comply with these Terms and Conditions will be invalid.

19. Prizes are not transferable or exchangeable and cannot be taken as cash.

20. Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem a prize (or an element of a prize), then the prize (or that element of the prize) will be forfeited.

21.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

22. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) use of a prize.

23. It is a condition of entry that winners (or their parent or guardian if under 18 years of age) may be required to execute a Deed of Acknowledgement and/or a Release and Indemnity in a form prescribed by the Promoter in its discretion.

24. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from a relevant Regulatory Authority.

25. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the telephone or internet user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person’s computer related to or resulting from participating in or downloading any materials in the promotion. If for any reason this promotion is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by a relevant Regulatory Authority, to cancel, terminate, modify or suspend the promotion.

26. All entries become the property of the Promoter. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering this promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages and telephoning the entrant. Entrants’ personal information may also be disclosed to State and Territory lottery departments. A request to access, update or correct any information should be directed to the Promoter at its address set out below. 27. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

28. The Promoter reserves the right to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

29. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

30. The Promoter’s decision is final and no correspondence will be entered into.
