General
Information published by the Promoter, as defined below, on how to enter and prizes form part of the Terms and Conditions of Entry ('Terms and Conditions'). Entry into this competition deems acceptance of these Terms and Conditions.
To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
Who can enter?
Subject to clause 4, entry is open to all residents of Australia over the age of 18, as of the date of entry who have fulfilled the requirements set out below.
Employees, and their immediate families, of the Promoter and Promoter’s franchisees and associated agencies and companies are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, de facto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin. The Promoter is Choice Hotels Australasia Pty Ltd (ABN 41 081 959 891) of 150 Jolimont Road, East Melbourne Victoria 3002 Australia (the ‘Promoter’).
By entering you are also agreeing to become a member of the Promoter’s loyalty programme, Choice Privileges®, you agree to receive emails and postal mail from the Promoter with information about your account or notifying you of special offers, discount, contests and offers from airlines and other partners. How to enter
The competition may be entered as follows:
Entrants who are not existing members of Choice Privileges may enter the competition during the Promotional Period (defined below) by:
signing up to become a Choice Privileges member by visiting the website

by joining Choice Privileges during a stay at any of the Promoter’s franchised Econo Lodge®, Comfort™, Quality™, Clarion® or Ascend Hotel Collection™ properties in Australia (each a ‘Choice Hotel’) at the property reception; or
by signing up when they visit the competition microsite (

When entering via methods 6.1.1 or 6.1.2 entrants will automatically be entered into the draw for the major prize, however to have an opportunity to win any of the instant prizes, they will need to respond to an email sent by the Promoter confirming membership, by going to the URL displayed (
www.choicehotelscompetitions.com.au/instantwin) and then entering the unique entry code provided in the email.
When entering via method 6.1.3 entrants will automatically be entered into the draw for the major prize, however to have an opportunity to win any of the instant prizes, they will need to visit the URL (
www.choicehotelscompetitions.com.au/instantwin) and enter the unique entry code they receive when joining Choice Privileges at a Choice Hotels property.
When entering via methods 6.1.4 entrants will automatically be entered into the draw for the major prize and upon completing their entry application, they will automatically be redirected to the URL (
www.choicehotelscompetitions.com.au/instantwin) and presented with an opportunity to win any of the instant prizes.
Entrants who are already members of the Choice Privileges program may enter the competition during the Promotional Period by responding to the Promoter’s email inviting the member to enter the competition, going to the URL displayed (

Upon entering the “Unlock the Treasure Chest” competition via method 6.1.4, a bonus entry will be awarded to entrants for ‘liking’ or ‘sharing’ the Promoter’s Australian Facebook page (
http://www.facebook.com/ChoiceHotelsAustralia). This can be done from the Facebook application that will be embedded within the competition entry website (
www.choicehotelscompetitions.com.au).
Entries must include all requested contact details, to be eligible to win. Entrants may only enter their own name. Inaudible, incomprehensible, illegible, inappropriate or incomplete entries will be deemed invalid.
Number of Entries permitted
Entrants may only submit one entry using the methods outlined in clauses 6 -9. Entrants entering via method 6.1.4 will be awarded one bonus entry for liking the Promoter’s Australian Facebook page (

The winner of the major prize (14 days Fiji & South Pacific cruise from Princess Cruises, for two adults and two children in an Oceanview cabin). It is strongly recommended that the prize winner source their own travel insurance. Choice Hotels will not be responsible for any liabilities, losses, damages, costs or expenses arising from their death or any injury sustained by them while away or any loss or damage to their belongings.
Compliance with any health or other government requirements is the responsibility of the prize winner and their travel companions. All prize travel will be subject to the carrier’s General Conditions of Carriage. The Promoter and carrier make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade at
www.smartraveller.gov.au. Prizes for travel for a particular event or attraction must be taken to coincide with the event or the times and dates during which the attraction is available. Travel insurance is not included in the prize but is highly recommended.
By entering this competition, and by collecting a prize, the major prize winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.
The winner of the major prize (14 days Fiji & South Pacific cruise from Princess Cruises, for two adults and two children in an Oceanview cabin) has a choice of four departure dates (subject to availability) – 20 September 2014; 25 November 2014; 24 January 2015; 20 February 2015. The prize winner must confirm their choice of ONE of the departure dates no later than 30 June 2014.
The major prize does not include: on board expenditure (including any additional meals at specialty restaurants, beverages, extra entertainment, The Sanctuary, Beauty Salon, Lotus Spa, Casino, Boutiques, facilities fees or service charges not covered by the package terms for the relevant berth); any purchases (on board or onshore) made by the prize winner or their guest (winner will be liable for purchases made by them and, where applicable, their guest); gratuities; any other costs associated with the prize winner and/or their guests using the prize.
The major prize is not transferable to another cruise or transferrable to another person without prior written approval from an authorised Carnival plc representative.
The major prize cannot be exchanged for cash, substituted for another prize or combined with other promotional offers. If for any reason the major prize winner does not use their prize within the time specified above, the prize is forfeited.
All other Carnival plc conditions of travel including cancellation policies apply to the major prize and are detailed in the Princess Cruises 2014-15 Cruising from Australia brochure, Issued February 2014. If any prize (or part of any prize) is unavailable for any reason, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Redemption of Instant Win Prizes 3, 4, 5, 6, 7 and 9 is subject to the terms and conditions of the vouchers. All vouchers are valid for a minimum of 6 months or until the expiry date and are subject to any terms and conditions imposed by the provider. Once awarded the Promoter shall not be liable for any voucher that is lost, stolen, forged, damaged or tampered with in any way. Winner is responsible for any cost in excess of the voucher value. All ‘instant win’ prizes will be given to winners as per the descriptions above and cannot be exchanged for cash or substituted for another prize.
If any prize is unavailable, for whatever reason, then the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. Cash will not necessarily be awarded as a substitute. It is a condition of accepting a prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
Prize Open, Close, Draw and Publish dates
28. The competition commences 27/02/14 at 00:01 AEDT and closes 14/05/14 at 23:59 AEST (the ‘Promotional Period’). Entries must be received by the Promoter prior to the competition close date and time and in accordance with the following draw schedule to go into the corresponding draw.
The winner of the major prize will be the first valid entry drawn at the premises of Permitz Group Pty Ltd at Suite 9, 18 Karalta Road ERINA NSW 2250 in accordance with the following draw schedule:

Prizes will be sent within twenty-eight (28) days of the draw.
The Promoter may conduct such further draws on 01/09/2014 at the same time and place as the original draw in order to distribute the Major Prize and any unclaimed instant win prizes if unclaimed by this date, subject to State and Territory legislation. Winners of any further draws will be notified by phone and mail within two (2) business days of the draw. Winners will also be published on

Further Terms and Conditions
Printing and other quality-control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant-win game materials are void if stolen, forged, mutilated or tampered with in any way.
By entering this competition and agreeing to become a Choice Privileges member, you agree to the Choice Privileges Program Rules and Regulations, including your consent of our use of your information in accordance with the Rules and Regulations. Your personal information will be processed and retained by Choice Hotels outside Australia and its Territories. By becoming a Choice Privileges member, entrants are also agreeing to receive emails or postal mail from Choice Hotels, notifying them when their Choice Privileges statement is ready online for viewing or notifying them of special offers, discounts, airline bonuses, or contests from Choice Hotels Australasia and its affiliates. Their contact information will not be disclosed to companies that are business associates of Choice Hotels Australasia, which may include airlines, hotels, retailers, telecommunications companies, credit card companies, banks and financial institutions, affinity membership program operators, restaurants, tradeshow operators, magazine and other publishers, and charitable organizations. Entrants acknowledge that their Facebook profile photograph may be featured on the Application and/or any associated Facebook page for public viewing. Facebook membership and the use of Facebook generally are subject to the prevailing Facebook terms and conditions of use available at
www.facebook.com. The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users via Facebook. To the extent permitted by law, each entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an entrant in respect of the entrant’s participation in the promotion. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook.
Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
Any entrant found to have provided incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will also be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, then the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if an entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
The Promoter strongly recommends that a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize-winner.
The Promoter reserves the right to request winners to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
The Promoter reserves the right to conduct a redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
The Promoter’s decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and any third parties associated with this promotion will take no responsibility for prizes damaged or lost in transit.

45. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. The Promoter and its related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and for related purposes which would reasonably be expected without your permission. For example, the Promoter may from time to time use your personal information to provide you with information about products and services which it expects may be of interest to you. However, the Promoter does respect your right to direct it not to do this if and when any future communication is sent to you by the Promoter. The Promoter may disclose personal information to essential service providers who provide services in connection with its products and services. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to grant the Promoter a perpetual, irrevocable and exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
The Promoter (subject to State and Territory Legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generation and use “scripting” is not permitted and will not be accepted.

Nothing in these Terms and Conditions limit, exclude or modify or purport to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or any other implied terms, conditions or warranties under other legislation (‘Non-Excludable Guarantees’).
