PARTICIPATION
This competition (“Competition”) is conducted by AAI Limited, ABN 48 005 297 807, trading as GIO (“the Promoter”). The Promoter may be contacted at Level 18, 36 Wickham Terrace, Brisbane QLD 4000 or by telephone on 13 10 10.
Entry into the Competition constitutes acceptance of these Terms and Conditions of Entry (“Conditions”). All entry instructions and prize information published by the Promoter forms part of these Conditions. Nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
The Competition is only open to individuals who: (i) are residents of Australia aged 18 years or older as at time of entry; and (ii) are not directors, management or employees (or their immediate family) of the Promoter or any of its related corporations or any of their agencies associated with the Competition (“Eligible Entrant”). Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.   
Competition entry commences at 10.00am on 1/11/2013 and closes at 11:59pm on 30/04/2014 (“Competition Period”). All times in these Conditions refer to AEST or AEDST as relevant and applicable in Victoria. The Competition consists of one (1) major prize draw and six (6) minor prize draws. The prize draws will be conducted in accordance with the schedule provided in condition 15.
Except as otherwise indicated, all amounts stated in these Conditions of Entry are stated in Australian dollars.

ENTRY
To enter the Competition, an Eligible Entrant must during the Competition Period complete one (1) of the following:

For existing GIO customers who receive a direct mail via post or direct email about the Competition, use a compatible browser to visit https://www.insurancepromotions.com.au/gio/choose/dm and follow the directions to fully complete and submit the online entry form, including their first name, last name, postcode, current and valid email address and current GIO Home, Contents, Car, Life or CTP Insurance Policy number; or
For Eligible Entrants that are not existing GIO customers or an existing customer who does not fall into condition 6(a), use a compatible browser to visit https://www.insurancepromotions.com.au/gio/choose/aq and follow the directions to fully complete and submit the online entry form, including their first name, last name, postcode and current and valid email address; or
Via mail:
Fully and correctly complete the specially marked entry form provided in the Promoter’s direct mail communication about the Competition received by the Eligible Entrant, including providing the Eligible Entrant’s email address and phone number and then mail the completed entry form using the Reply Paid Envelope provided with the entry form; or
Via phone:
For Eligible Entrants who receive a telephone call on behalf of the Promoter during which they are invited to enter the Competition, during the telephone call, fully provide the information requested, including providing the Eligible Entrant’s first name, last name, postcode and current and valid email address.

Only one (1) entry per Eligible Entrant is permitted. Any subsequent entry from a person after the first valid entry is received will be deemed invalid. Each Eligible Entrant must make/submit their entry in accordance with the appropriate entry method (applicable to them) outlined in clause 6.

Each valid entry received will be entered into the Minor Prize Draw corresponding to their time of entry referred to in condition 15a (“Minor Prize Draws”). Undrawn entries in each Minor Prize Draw will be entered into any subsequent Minor Prize Draws. All valid entries (including winning Minor Prize Draw entries) received during the Competition Period will be entered into the Major Prize Draw referred to in condition 15b (“Major Prize Draw”).

All Eligible Entrants must ensure that the Promoter receives their entries during the Competition Period. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of submission or posting by the Eligible Entrant.  The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications or postal service or equipment.  Contact details entered incorrectly in an entry form by an Eligible Entrant will deem an entry invalid.
The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter is prohibited. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
The Promoter may, in its absolute discretion, declare any or all entries made invalid if an Eligible Entrant tampers with the entry process, benefits from such tampering or submits an entry that is illegible, incomplete or not in accordance with these Conditions.

The Promoter reserves the right to verify the validity of entries including but not limited to an Eligible Entrant’s identity, eligibility, age and residential address, and to disqualify any Eligible Entrant who has breached the entry criteria explained in these Conditions. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Cost of entry via the internet is free, but internet connection and usage rates may apply. Costs associated with accessing a Competition website remain an Eligible Entrant’s responsibility and may vary depending on the Internet service provider used.   All Eligible Entrants should obtain details of such costs from their service providers.
An entry submitted by post must be an original specially marked entry form as provided by the Promoter and photocopies or images of entry forms will not be accepted. The specially marked entry form must be sent in the Reply Paid Envelope provided and must be received during the Competition Period to be valid.

Minor Prize Draws will take place at 11.00am AEST/AEDST (as the case requires) on the relevant prize draw date in accordance with the schedule set out above.

Major Prize Draw:

Major Prize Draw will take place at 11.30am on 2/5/2014.

Winners will be notified in writing within two (2) business days of the relevant draw via the email address provided within their entry. Winners will also be contacted by phone if provided in their entry. The Minor Prize Draw winners’ names and localities will be published in The Australian on the dates set out in the schedule for Minor Prize Draws in condition 15a above. The Major Prize Draw winner’s name and locality will be published in The Australian on 9/5/2014. All reasonable steps to notify the winners will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
If a winning entry is deemed not to comply with these Conditions the entry will be discarded and a new winner will be determined by a redraw in accordance with condition 25.
Minor Prizes: The first valid and eligible entry randomly drawn from each Minor Prize Draw will each win one (1) Visa Prepaid card pre-loaded with $1,000 credit. Each minor prize is valued at AU$1,000.
Major Prize:
The first valid and eligible entry randomly drawn from the Major Prize Draw will win a total of AU$25,000 awarded in the form of five (5) Visa Prepaid cards each pre-loaded with AU$5,000 credit. This major prize is valued at AU$25,000.

PROVISIONS APPLICABLE TO THE PRIZES GENERALLY
Each prize will be issued in the relevant prize winner’s name and delivered via secure post to the Australian address nominated by the winner. Prizes are subject to the supplier’s prevailing terms and conditions of use, including expiration dates (if any), and are not replaceable if lost, stolen or damaged. No compensation will be payable if a winner is unable to use any element of a prize as stated for whatever reason. All additional costs not expressly stated, but which may be incurred in acceptance and use of a prize, are the responsibility of the winner.
A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion. The Promoter reserves the right to request a person whose name is drawn to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction and at its sole discretion) to confirm the winner’s identity, age, residential address and email address, eligibility to enter this Competition and to claim a prize and any information submitted by the winner in entering the Competition, before issuing the prize.
The total prize pool is valued at AU$31,000. The prize pool is valued as at 19/09/2013. The Promoter takes no responsibility for any variations in the prize pool value, or an individual prize value, due to exchange rate changes or otherwise.
The prizes may not be transferred or substituted except at the Promoter’s discretion and subject to State or Territory legislation. The prizes, or any unused portion of a prize, are not redeemable for cash unless otherwise specified in accordance with the terms and conditions relevant to the prizes. However, the Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability, subject to approval by the relevant State or Territory regulatory authorities. Any tax on a prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in this Competition. If the winner does not accept/take/redeem a prize by the time stipulated by the Promoter, then the prize will be forfeited.
The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any Eligible Entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained in connection with this Competition or taking and/or using any prize, except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

WINNER OF THE PRIZE
The prize notifications will state the relevant prize that has been won and will include instructions as to how the prize winner is to claim the prize and establish his/her entitlement to it.
The Promoter may conduct a further draw at the same time and place as the Major Prize Draw as is necessary on 11/8/2014 in order to award any prize(s) if unclaimed by that date or if the original winner drawn is deemed ineligible under these Conditions, subject to any written directions given under applicable State or Territory legislation. In the event of a winner(s) in the unclaimed prize draw, the winner(s) will be notified within two (2) business days of the redraw via the email address provided in their entry. Winner(s) will also be contacted by phone if provided in their entry. The name and locality of the winner(s) will be published in The Australian on 18/8/2014. All reasonable steps to notify the winning Eligible Entrant(s) will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
It is a condition of accepting a prize that the winner may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.

GENERAL
If for any reason the conduct or operation of the Competition is not capable of running as planned or is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct. The Promoter reserves the right to amend these terms at its sole discretion, subject to any permission required by relevant regulatory authorities.
Nothing in these Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize values to that stated in these Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use/redemption of a prize.
All of the Promoter's decisions in relation to all aspects of this Competition are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
A prize winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without compensation, financial or otherwise, for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
All entries become the property of the Promoter and will be entered into a database. Information resulting from the Eligible Entrant’s entry and participation in a promotion is used by the Promoter and its agencies associated with the Competition for the determination of a prize winner. Information about Eligible Entrants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of planning and product development. By applying or participating in the Competition, Eligible Entrants consent to these uses and disclosures of their information.

PRIVACY AND MARKETING CONSENT AND DISCLOSURE
Privacy Statement. Eligible Entrants’ personal information will be collected by or on behalf of the Promoter to enable the Promoter and its agencies to administer the Competition and may also be used by the Promoter, its agents, contractors and related companies, for the purpose of carrying out planning, product development, and designing future promotional campaigns. Each Eligible Entrant agrees that it is a condition of entry into this Competition that they must consent to being contacted by the Promoter (by any means, including email) for the duration of the Competition Period and the subsequent draw periods. This is required to ensure that the Competition entries are properly recorded, processed and so that the winner can be drawn. The personal information of a prize winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers and to regulatory authorities if requested. The Promoter will disclose the prize winner's first initial, surname, suburb and State/Territory of residence to The Australian newspaper, which will publish these details. By entering this Competition, each Eligible Entrant consents to the use of their personal information as described. Eligible Entrants may contact the Promoter by post at the address stated in clause 1 of these Conditions or by calling 13 10 10 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Eligible Entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize. The collection, use and disclosure of all personal information is handled in accordance with the Promoter’s Privacy Policy available online at www.gio.com.au.
If an Eligible Entrant has entered pursuant to Condition 6(b) and has marked the “opt-in” box on the online entry form, the Eligible Entrant also consents to the storage of their personal information on the Promoter’s database so that the Promoter may use this information for the further primary purpose of future promotional and marketing purposes regarding the Promoter’s products and services via email and SMS. Eligible Entrants may unsubscribe from the Promoter’s marketing program at any time using information contained in the email or SMS or by making a request during a telephone call.
 Notwithstanding anything in clause 36 of these Conditions, if an Eligible Entrant (who has entered pursuant to Condition 6(a) or (b)) uses section 2 of the online entry form to request future contact from the Promoter and/or its related entity Suncorp Life & Superannuation Limited ABN 87 073 979 530 AFSL 229880 (Suncorp Life) by completing the required information on the entry form, the Eligible Entrant understands and agrees that the Promoter will store their personal information on the Promoter’s database and disclose their personal information to its related entity Suncorp Life  so that Suncorp Life and the Promoter can use this information for the further primary purpose of contacting the Eligible Entrant at a later date (by any permitted means including telephone, email, mail, SMS or online marketing) in order to market their respective products and services.
If an Eligible Entrant has entered pursuant to Condition 6(c) and has used the mailed entry form to request future contact from the Promoter by completing the required information on the entry form, the Eligible Entrant understands and agrees that the Promoter will store their personal information on the Promoter’s database so that the Promoter can use this information for the further primary purpose of contacting the Eligible Entrant at a later date (by any permitted means including telephone, email, mail, SMS or online marketing) in order to market their respective products and services.
If entering with Facebook, entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
