Entry Restrictions
Open only to Australian residents who are: aged 18 or over; and able to take the major prize between 22/08/14 and 26/08/14 (inclusive). Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies or participating outlets associated with this competition are not eligible to enter.
Competition Period
9.00am (AEST) 19/05/14 to 11.59pm (AEST) on 06/07/14.
Entry Method
During the Competition Period, entrants must: purchase a promotional case (24x 355ml bottles) or promotional 6 pack (6x 355ml bottles) of Carlton Dry (Eligible Purchase) for off premise consumption from any participating liquor outlet (Outlet) and locate the unique code printed inside the case or obtain the barcode number found on the 6 pack; and visit www.carltondry.com.au (Website) and fully complete and submit the online entry form, including by providing their full name, postcode, email address, phone number, the unique code (if they have purchased a case) or the last 5 digits of the barcode (if they have purchased a 6 pack), receipt number and any additional information as required by the Promoter. For the avoidance of doubt, the barcodes on the 6 packs contained within a promotional case cannot be used to enter the competition.
Minor Prize Draw Details
There will be 49 minor prize draws conducted. The minor prize draws will take place at 12.00pm (AEST) daily between 20/05/14 and 07/07/14 (inclusive) at Prime Focus, 403/62 Beach Street, Port Melbourne VIC 3207 (Prime Focus). Any minor prize draws that fall on a weekend or public holiday will be conducted on the next business day.
Major Prize Draw Details
There will be 3 major prize draws conducted. The major prize draws will take place at 12.00pm (AEST) on 09/06/14, 23/06/14 and 07/07/14 at Prime Focus.
Prize Details
There are 49 minor prizes and 3 major prizes to be won.
Each minor prize is a Carlton Dry branded FYVE snow jacket valued at $249 (inc GST). Winners can choose the size they wish to receive from the options available, subject to availability. See paragraph 8 for full details and conditions.
Each major prize is a trip for the winner and 3 companions (who must be aged 18 years or over) to Wanaka, New Zealand between 22/08/14 and 26/08/14 (inclusive) valued at up to $32,000 (inc GST) depending on the winner’s point of departure. See paragraphs 9 and 10 for full major prize details and conditions.
Prize Pool
The total minor prize pool is valued at $12,201 (inc GST).
The total major prize pool is valued at up to $96,000 (inc GST).
The overall total prize pool is valued at up to $108,201 (inc GST).
Entry Limits
Entrants may enter as many times as they wish, provided that each entry is based on a separate Eligible Purchase and separate unique code or barcode and separate receipt number.
Retain Receipt Requirements
Entrants must retain their original itemised receipt to verify each entry.
Winner Notification and Publication
The winners will be notified by phone and in writing within two days of the relevant draw. The major prize winners will have their name and state/territory of residence will be published on the Website on either 13/06/14, 27/06/14 or 11/07/14 for a period of 28 days.
Prize Claim Date and Time
Minor prizes must be claimed by 5.00pm (AEST) on 07/10/14.
Major prizes must be claimed by 5.00pm (AEST) on 16/07/14.
Unclaimed Prize Draw Details
Minor prizes: 12.00pm (AEST) on 08/10/14 at Prime Focus.
Major prizes: 12.00pm (AEST) on 17/07/14 at Prime Focus.
Unclaimed Prize Draw Winner Notification and Publication
Any winner(s) in the Unclaimed Prize Draw will be notified by phone and in writing within two days of the relevant Unclaimed Prize Draw. Any major prize winner(s) in the Unclaimed Prize Draw will have their name and state/territory of residence published on the Website on 24/07/14 for a period of 28 days.

Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.

The competition will be conducted during the Competition Period.

Each entrant will receive a return online notification confirming their successful entry into the competition. By entering this competition, entrants consent to receiving this electronic message.

Entries must be received during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. Failure of an entrant to provide their original itemised receipt(s) (as per the Retain Receipt Requirements) (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid). The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses, phone numbers or aliases may be disqualified. Consumers are responsible for their own costs associated with accessing the Internet. Automatically generated entries will not be accepted.

Bonus entries may be offered by the Promoter throughout the Competition Period at its discretion. Where an entrant has received a promotional communication from the Promoter containing a bonus entry code, they will automatically receive one bonus entry into the competition if, at the time of entering the competition in accordance with the Entry Method section of these conditions, they enter the bonus entry code they received or they follow the instructions in the promotional communication from the Promoter to submit their bonus entry. The bonus entry code can only be used to submit an online entry and cannot be used to enter by SMS. The bonus entry code will expire on the date specified in the promotional communication.

The minor prize draws will be conducted at the time, dates and location as stated in the Minor Prize Draw Details. In each minor prize draw, the first valid entry randomly drawn from all valid entries received during the Competition Period up to the time of the relevant minor prize draw (excluding previous minor prize winning entries) will win a minor prize. If, on the date of a minor prize draw, no entries have been received, the minor prize will be carried over to the next minor prize draw date on which the Promoter has received enough entries to award some or all of the minor prizes.

The major prize draws will be conducted at the time, dates and location as stated in the Major Prize Draw Details. In each major prize draw, the first valid entry randomly drawn from all valid entries received during the Competition Period up to the time of the relevant major prize draw (including minor prize winning entries) will win a major prize.

The minor prizes are as stated in the Prize Details. The Promoter will not be liable in any way if a winner does not receive the minor prize in the size of their choice. If a requested size is unavailable, the Promoter may supply another size in its absolute discretion.

The major prizes are as stated in the Prize Details. Each major prize consists of the following for the major prize winner and each of their 3 companions:

(a)return economy airfares (including airfare taxes) from the major prize winner’s nearest Australian capital city to Queenstown, New Zealand;

(b)return transfers between Queenstown airport and the hotel;

(c)3 nights accommodation (twin share) at the Haka Lodge, Queenstown);

(d)a 1 day lift pass at The Remarkables, Queenstown;

(e)a 1 day lift pass at Coronet Peak, Queenstown;

(f)a Shotover Jet experience in Queenstown;

(g)a Kawarau Bungy experience in Queenstown;

(h)return transfers between Queenstown and Wanaka;

(i)1 nights accommodation (twin share) at the Purple Cow, Wanaka;

(j)a 1 day lift pass at Treble Cone, Wanaka and a 2 hour lesson with a professional snowboarder or skier;

(k)services of a Haka Tour Guide for the duration of the trip;

(l)either ski or snowboard equipment hire as required;

(m)a World Heli Challenge hoodie jumper; and

(n)VIP tickets to the World Heli Challenge Award Night on 25/08/14 and return transfers to and from the event.

Flights, activities and accommodation are subject to booking and availability. The major prize must be taken between 22/08/14 and 26/08/14. All other costs associated with the major prize, including but not limited to any additional transfer costs, meals, additional taxes, insurance and other ancillary costs are the responsibility of each major prize winner and their companions, as incurred. Each major prize winner and their companions must depart and return at the same time. The major prize is subject to any additional terms and conditions specified by the prize supplier(s). The major prize winners and their companions are responsible for ensuring that they have all necessary documents to travel to New Zealand, including a current passport and any visas that may be required.

The winners will be notified in accordance with the Winner Notification and Publication. By entering this competition, each entrant requests that his or her full address not be published.

The winners (and the major prize winners’ companions) must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

Entrants (and the major prize winners’ companions) acknowledge that there are inherent risks in some aspects of the major prize and that using the major prize involves participating in dangerous activities. By entering this competition and/or accepting the major prize, entrants and the major prize winners’ companions accept that risk.

In order to participate in the activities awarded as part of the major prize, the major prize winners and their companions must comply with applicable height, weight, health, fitness and any other requirements normally associated with a particular activity. It is each major prize winner’s responsibility to ensure that they and their companions are sufficiently healthy and fit so as to safely take the trip and undertake the activities awarded as part of the major prize. The Promoter reserves the right to deem that a major prize winner and their companions are not sufficiently healthy or fit. The major prize winners must comply with all requirements and directions of the people responsible for the conduct of the relevant activity and must ensure that their companions also comply. The major prize winners and their companions may be required to sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the major prize prior to undertaking the activities included in the major prize. If a major prize winner or any of their nominated companions does not sign the form provided by the Promoter within the time requested by the Promoter, the major prize winner’s entry or claim will be deemed invalid.

The Promoter may require winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.

If a winning entry is deemed not to comply with these conditions of entry, including if a major prize winner is unable to take the major prize between 22/08/14 to 26/08/14, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraphs 6 and/or 7, as applicable.

The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person. The Promoter may in its absolute discretion cancel the major prize or otherwise cease to provide any benefit of the major prize to a major prize winner (and their companions, if applicable) if the major prize winner (or their companions, if applicable), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate.

The Promoter’s decision is final and no correspondence will be entered into.

The prizes are not transferable or exchangeable and cannot be redeemed for cash. If for any reason a major prize winner or any of their companions does not take an element of the major prize at the time stipulated by the Promoter then that element of the major prize will be forfeited by the major prize winner and cash will not be supplied in lieu of that element of the major prize. The Promoter accepts no responsibility for any variation in prize value. Unless as otherwise stated in these conditions (and subject to paragraph 20), if a prize or any element of a major prize is unavailable for any reason, the Promoter may substitute for that prize or element of that major prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities if required.

If an activity or event awarded as part of the major prize is abandoned, called off or postponed for any reason, the major prize winners and their companions forfeit their entitlement to that component of the major prize, and no cash or alternative prize will be substituted for that component of the major prize.

If any prize has not been accepted or claimed in accordance with the Prize Claim Date and Time, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws in accordance with the Unclaimed Prize Draw Details as are necessary to distribute the relevant prize(s), subject to any requirements of the relevant gaming authorities. Any winner(s) in this draw will be notified as stated in the Unclaimed Prize Draw Winner Notification and Publication.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to prizes. Delivery of prizes within Australia only.

The Promoter may communicate or advertise this competition using Facebook. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.

As a condition of accepting or participating in the major prize each major prize winner’s companion accept these conditions.

If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities if required.

The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. Entry and continued participation in this competition is subject to each Outlet’s liquor serving policy.

All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The information entrants’ companions provide will be used by the Promoter for the purpose of fulfilling the prize and otherwise administering this competition. The Promoter may collect entrants’ personal information (including through its contractors or agents) or disclose entrants’ or their companions’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants or their companions. By entering this competition, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the Privacy Principles in the Privacy Act 1988 (Cth).
