‘BIG NIGHT IN’ PROMOTION TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions (“Conditions”). Entry into the Woolworths „Big Night In‟ Promotion (“Promotion”) is deemed to be an acceptance of these Conditions.
2. The Promotion is open to residents of Australia aged 13 years or over. Individuals between the ages of 13 and 18 years must obtain parental consent to enter. Parents/guardians may be required to enter into a further agreement with the Promoter as evidence of consent to the minor entering this Promotion.
3. Employees and their immediate families of the Promoter and the Promoter‟s related companies and agencies directly associated with this Promotion are ineligible to participate.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant‟s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Fully complete and submit the online entry form, including Woolworths unique receipt number displayed on Woolworths store receipt or online order number, the last 5 digits of all three (3) Eligible Product barcodes, full name, address, phone number and email address and any additional information as required by the Promoter and submit the full completed online entry form.
7. Participating Woolworths supermarkets means all Woolworths supermarkets located in Australia excluding Woolworths/Caltex co-branded fuel outlets.
8. Incomplete or indecipherable entries will be deemed invalid.
9. Multiple entries are permitted, subject to Clause 12 and the following: (a) only one (1) entry permitted per three (3) Eligible Products purchased in as single transaction; (b) a maximum of three (3) entries will be accepted per household per day; (c) a maximum of three (3) entries will be accepted per Woolworths receipt (regardless of the number of Eligible Products featured on that receipt); (d) limit of six (6) prizes to be awarded per household excluding SA residents, (e) each entry must be submitted separately by filling in and submitting a separate online entry form as specified in Clause 6(c) and in accordance with these Conditions; and (f) unrecognised Woolworths receipt numbers and Eligible Product barcodes will be deemed invalid in the absolute discretion of the Promoter.
10.Entries are deemed to be received at the time they are received by the Promoter and not at the time of the submission by the entrant. The Promoter does not accept responsibility and is not liable for late, lost,
incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
11.Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including but not limited to the use of a competition entry service, will be void.
12.Entrants must retain their original or a photocopy of their Woolworths receipt(s) as proof of purchase for all entries. Failure to provide your Woolworths receipt(s) when requested may, in the absolute discretion of the Promoter, render all of an entrant‟s entries invalid and forfeit their right to any prize.
13.Entrants can only enter in their own name. Entrants who enter using multiple aliases may be disqualified. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter‟s satisfaction, at its sole discretion) in order to confirm the winners‟ identity, age, residential address, eligibility to enter and any other information submitted by the winners in entering the Promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter‟s satisfaction within the time requested, the winner‟s entry will become invalid. The prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
Instant Win Prizes
14.At the time of submitting an entry in accordance with Clause 6 above, each entrant will be notified instantly online whether or not they are an instant winner. All valid entries received from winners and non-winners of an instant prize will be automatically placed in the relevant weekly prize draw.
15.Prior to the commencement of the Promotion, the Promoter will draw 2,500 random times (“Winning Times”). The first valid entry received on or after each random Winning Time will be deemed a provisional instant winner, subject to verification. Weekly Prizes
17.There are a total of six (6) prizes to be awarded, (1 prize each week) during the Promotional Period. Each weekly prize comprises of a family fun
weekend away for two (2) adults and two (2) children (aged 12 years or under) valued at up to $8,850 depending on the holiday chosen, date and point of departure. Prize includes:
Tickets to the winner‟s choice of stadium event in either Sydney, NSW; Melbourne, VIC; or Brisbane, QLD to the value of $150 per person. The Promoter (or its prize suppling agency) will contact each winner and determine the State and the weekend in which the winner would like to travel to and the Promoter/prize suppling agency will then confirm the list of stadium events available to them (in that State) that they can source tickets to. Depending on the stadium event chosen the prize may also include a stadium tour for four (4) people (or group tour, subject to availability);
Return economy airfares, for two (2) adults and two (2) children (aged 12 or under), from winner's nearest capital city to either Sydney, NSW, Melbourne, VIC or Brisbane, QLD depending on the chosen stadium event

18. Winner will be required to sign a prize acceptance form including a liability and publicity waiver within six (6) weeks of being notified as the winner to formally accept the prize. Winner must finalise the prize booking within 90 days of the prize draw date and all travel must be completed within 12 months of the prize draw date. Winner must book at least 60 days prior to intended travel departure. Prize is a single event holiday and cannot be separated into different holiday vacations. Availability cannot be guaranteed during Christmas, School holiday, weekend and special event periods. All passengers must travel together on the same flights and stay at the same property. A credit card imprint may be required from the winner (or their accompanying parent/guardian) at check-in to the hotel for all incidental charges. Once booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur a fee of $150 including GST plus supplier charges which is payable by the winner. Travel suppliers/airlines/restaurants to be chosen at the discretion of 33 Degrees Worldwide Pty Ltd (the Prizing Agency). Travel insurance is highly recommended and at the expense of the winner. In the event that an element of the prize is cancelled or postponed for any reason, the winner forfeits the specified element and no cash alternative offer will be granted in lieu of the part of the prize. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the major prize winner and their companion including but not limited to all meals, spending money, incidentals, mini-bar, laundry, room service, telephone calls and all other ancillary costs. The winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation. Supplier ticketing conditions may apply including minimum age restrictions.
19.Prize must be taken to coincide with the stadium event chosen by the winner and is subject to booking event availability and flight availability.
20. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. Itinerary to be determined
by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers.
21.Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
22.The ticket prizes are subject to the relevant stadium and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

24. The first valid entry randomly drawn in each weekly draw will win a weekly prize (subject to verification). All non-winning entries will be included in every subsequent weekly prize draw held.
25. Each weekly prize winner will be notified in writing within two (2) business days of the relevant draw, by telephone and by email.
26.Upon request by the Promoter, the weekly prize winners will be required to send the Promoter the original or a copy of their Woolworths receipt. Failure to provide the original or a copy of their Woolworths receipt when requested by the Promoter may, in the absolute discretion of the Promoter, render an entrant‟s entries invalid and forfeit their right to any prize.
27.Winners of a weekly draw prize will have their names published online at
www.woolworths.com.au/BNI on the dates specified in the table above.
28. Where delivery is applicable, prizes will be delivered only in Australia.
29. If a winner of a weekly prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner‟s behalf.
30.As a condition of accepting a weekly prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner is under the age
of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
Unclaimed Prize Draw
31.If there are any unclaimed weekly draw prizes, a further draw will be held at 12.00 midday AEDST on 04/12/2014 at Prime Focus, 403/62 Beach Street, Port Melbourne VIC 3207, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and email within two (2) business days of the draw.
32.Any unclaimed weekly draw prize winners will be published at
www.woolworths.com.au/BNI on 11/12/2014.
General Conditions
33.Prizes are subject to the standard terms and conditions of individual prize and service providers.
34.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of any prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
35.Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. The Promoter accepts no responsibility for any variation in the prize value.
36.Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize)
37. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
38.The Promoter‟s decision is final and no correspondence will be entered into.
39. The total prize pool for this Promotion is RRP $153,075.
40.Any cost associated with accessing the promotional website is the entrant‟s responsibility and is dependent on the Internet service provider used. Any contact details incorrectly entered on the website may invalidate the relevant entry, in the Promoter‟s discretion. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
41.Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 2500 online instant win prizes to be won in this Promotion.
42. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any
outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
43. The Promoter is not responsible for prizes damaged in transit.
44.If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
45.Nothing in these Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other warranties, conditions or terms implied by any other commonwealth, state or territory law that cannot be excluded under the ASIC Act or similar consumer protection laws in the State and Territories or Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
46.Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter‟s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
47.All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the Promotion. The Promoter may disclose entrants‟ personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants, and as required, to Australian regulatory authorities. If the entrant has marked the „opt-in‟ box on the online entry form, the entrant consents to: (a) the storage of their personal information on the Promoter‟s computer systems; and (b) that the Promoter may use their personal information for future promotional and marketing purposes regarding the Promoter‟s products including contacting the entrant via electronic messaging and disclose the entrant‟s personal information to its contracts and agents for those purposes.
