TERMS AND CONDITIONS

1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. The promoters are Dilmah (Aust.) Pty. Ltd. (ABN 83 057 782 304) of Units 1 & 2, 12 Compark Circuit, Mulgrave, Victoria 3170 and Bauer Media Pty Ltd (ABN  18 053 273 546  ) of 54-58 Park Street, Sydney NSW 2000 Telephone:  (02) 9282 8000  (“Promoters”).

3. Entry is only open to Australian residents aged 18 years or over.

4. Employees (and their immediate families) of the Promoters and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5. The Promotion commences on 1st August 2014 at 09.00am (AEST) and closes at 11.59am (AEST) on 31st August 2014 (“Promotional Period”).

6. How to Enter: To enter, individuals must visit the Australian Women’s Weekly website at www.aww.com.au/news-features/comps/, follow the prompts to the promotion entry page, fill in the entry form including their full name, address, current email address, daytime telephone number and an answer to the question in 25 words or less “What is your favourite Dilmah tea cocktail recipe and why?”, and submit the fully completed entry form, as instructed during the Promotional Period.

7. Incomplete or indecipherable entries will be deemed invalid.

8. Only one (1) entry permitted per person.

9. If there is a dispute as to the identity of an entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the entrant.

10. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on their literary and creative merit of the answer to the question provided. The Promoters’ and judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into. The winner will be notified by phone or email and published on either or both the Dilmah Australia and Australian Women’s Weekly Facebook Page.

11. The entrant warrants to the Promoters that the entry submitted is an original literary work of the entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the entrant in relation to the entry was provided by a third party, the entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoters against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

12. As a condition of entering this promotion, each entrant licenses and grants the Promoters, their affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. The Promoters are entitled to use any of the entries submitted in any manner and for any purpose at their absolute discretion, including using the entries for future Promoters’ or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoters are entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

13. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoters in this regard.

14. The Promoters reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoters have reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoters’ discretion. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoters’ legal rights to recover damages or other compensation from such an offender are reserved.

15. The best (1) valid entry, as determined by the judges, will be deemed the major prize winner and will win a trip for two (2) adults to Melbourne for the Spring Racing Carnival, valued at up to $4,000. Prize includes:
• two (2) x return economy airfares from winner's nearest capital city to Melbourne valued at up to $1,600 (including taxes), depending on point of departure (flights only provided if winner resides outside of Victoria);
• three (3) x nights standard twin share accommodation (to be redeemed between 3-5 November 2014), including breakfast daily for two (2) adults in a minimum of 3 star hotel valued at up to $1,100;
• Return corporate taxi for transport for two (2) adults, from their accommodation venue to Flemington racecourse;
• two (2) x General admission entry tickets to Flemington Cup Carnival on Emirates Melbourne Cup Day, 4 November 2014;
• two (2) x entry wristbands to the Dilmah marquee for corporate hospitality on Emirates Melbourne Cup Day, 4 November 2014; and
• one (1) x $500 Myer gift card (for winner only).


16. If the winner is from Victoria, the airfare component of the prize will not be included. No alternative prize or cash will be given to the winner in lieu of the airfares. The Total prize pool is valued at up to $4,000 (including taxes). Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.

17. Prize must be taken in full and as a package to coincide with the 2014 Emirates Melbourne Cup Day event with flights departing on 3rd November 2014 and is subject to booking and flight availability. In the event a winner is not available to or for any other reason, cannot take the prize to coincide with the 2014 Emirates Melbourne Cup Day they will forfeit the right to the prize and the prize will be awarded to the next best valid reserve entry.

18. The Promoters are neither responsible nor liable for any loss or damage suffered in the event that the 2014 Emirates Melbourne Cup Day event is postponed, cancelled, rescheduled or relocated for any reason whatsoever.

19. Prize does not include transfers to and from the winner’s place of residence to the departure point or transfers between the hotel and airport in Melbourne. These costs are the responsibility of the winner. The winner (and his/her companion) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoters in their absolute discretion. Frequent flyer points will not form part of the prize.

20. The winner is responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges and all other ancillary costs.

21. It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.

22. Transport to and from departure point including but not limited to additional domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companion. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking.

23. For the removal of doubt, taxes for domestic travel are included in the domestic airfares provided by the Promoters. All airfares and accommodation costs were correct as of 17 July 2014. The Promoters will not be responsible for any variation in price.

24. The 2014 Emirates Melbourne Cup Day tickets are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoters and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

25. The winner and their guest must not engage in any illegal or unsafe behaviour whilst participating in the prize. To the extent allowable by law, the Promoters and their partners exclude any legal liability or responsibility for legal or otherwise incidents or activities engaged in by the winner or their guest during participation in the prize.

26. Myer Gift Card is valid for six (6) months from the date of issue. Redemption of the Myer Gift Card is subject to the terms and conditions stipulated on the Myer Gift Card. The Promoters will not be liable for any Myer Gift Card that has been lost, stolen, forged, damaged or tampered with in any way. Any ancillary costs associated with redeeming a Myer Gift Card are not included. Any unused balance of a Myer Gift Card will not be awarded as cash.

27. Prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoters accept no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoters will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of prize at a venue is subject to the standard rules and regulations of that venue/s.

28. In acceptance of the prize, the winner acknowledges that they may incur on-going costs associated with the prize which are the entire responsibility of the winner.

29. Prize is subject to the standard terms and conditions of individual prize and service providers.

30. In the event that for any reason whatsoever the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoters, then the prize (or that element of the prize) will be forfeited by the winner and cash will not be awarded in lieu.

31. In the event that a prize, or part of a prize, is unavailable, the Promoters reserve the right to substitute the prize or part of the prize in their discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification.

32. The Promoters are neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

33. The Promoters are not responsible nor liable for any prize damaged in transit in the delivery of their prize.

34. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

35. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Promoters reserve the right, to cancel, terminate, modify or suspend the promotion.

36. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

37. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoters. Method of validation (without limitation) will be determined by the Promoters in their complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the Terms and Conditions herein. In the event that the Promoters request the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoters. As a condition of accepting the prize, the winner (and his/her companion) may also be required sign any legal documentation as and in the form required by the Promoters and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

38. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

39. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize and/or attendance/participation in the prize event.

40. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoters reserves the right, in their sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

41. Entrants consent to the Promoters using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.

42. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoters and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.

43. Bauer Media Privacy: Bauer Media Pty Ltd (ABN  18 053 273 546  ) (“Bauer”) collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. Bauer will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in Bauer’s Privacy Policy, Bauer may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to Bauer and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoters. The entrant’s PI will not be disclosed overseas.

44. Dilmah (Aust.) Pty. Ltd. Privacy: Dilmah (Aust.) Pty. Ltd. (ABN 83 057 782 304) (“Dilmah”) collects PI in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers.
