Eligibility Criteria
1. Entry is only open to Australian residents aged 18 years or over who meet the criteria set out in clause 4 in respect of each draw and are available to take the Riverfire Prize (defined below) from 26/09/2014 – 28/09/2014 if drawn as a winner in Draw Two or Draw Three (as set out below).
2. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entry Instructions
3. Promotion commences on 06/08/2014 and final entries close at 11:59pm AEST on 02/09/2014
(“Promotional Period”).
4. There will be three (3) draws conducted for this promotion. To enter each draw, eligible individuals for each draw (as set out below) must complete the relevant entry method during the Promotional Period as follows:
a) Draw One (only open to Sunsuper members that reside in postcodes 4003-4306, 4500-4569, 4572-4574 & 9736, herein referred to as “South East Queensland”): visit
www.sunsuper.com.au/Campaign_pages/Win_a_Sunsuper_Riverfire_VIP_experience, follow the prompts to the promotional entry page, input the requested details (including their Sunsuper member number, full name, date of birth, Tax File Number [TFN], and a valid email address), agree to the Terms and Conditions by ticking the relevant tick box, and submit the fully completed entry form so it is received by 11:59pm AEST on 02/09/2014.
All individuals that enter Draw One will automatically be entered into Draw Two.
b) Draw Two (only open to existing Sunsuper members): visit
www.sunsuper.com.au/Campaign_pages/Win_a_VIP_Sunsuper_Riverfire_experience, follow the prompts to the promotional entry page, input the requested details (including the Sunsuper member number, full name, date of birth, TFN, and a valid email address), agree to the Terms and Conditions by ticking the relevant tick box, and submit the fully completed entry form so it is received by 11:59pm AEST on 02/09/2014.
c) Draw Three (open to the following):
a. Individuals that are an existing Sunsuper member and receive a promotional email directly from the Promoter inviting them to enter Draw Three: Follow the prompts contained in the promotion email to access the online form, complete requested details (including their full name, address, DOB, email address, Sunsuper Member Number, TFN and mobile phone number), agree to Terms and Conditions by ticking the relevant tick box, and submit the completed form so it is received by 11:59pm AEST on 02/09/2014; or
b. Individuals that are an existing Sunsuper member and receive a promotional letter directly from the Promoter inviting them to enter Draw Three: complete the ‘Please don’t transfer my Sunsuper account to the ATO’ slip at the bottom of the Unclaimed Super letter addressed directly to them by supplying the requested details (including their full name, address, DOB, email address, Sunsuper Member Number, TFN and mobile phone number), sign and date the slip, agree to the Terms and Conditions by
ticking the relevant tick box and return the fully completed slip to Sunsuper at Reply Paid 2924, Brisbane Qld 4001 so it is received by last mail on 28/08/2014; or
c. All Australian residents [who may or may not be a Sunsuper member]: Visit
www.sunsuper.com.au/supersearch, follow the prompts to the Super Search entry page, input the requested details (including their full name, DOB, a valid email address, address, phone number and TFN), agree to the Terms and Conditions by ticking the relevant tick box, and submit the fully completed Super Search entry form so it is received by 11:59pm AEST on 02/09/2014.
5. Incomplete or indecipherable entries will be deemed invalid.
6. Multiple entries permitted, subject to the following: (a) only one (1) entry into Draw One permitted per eligible person; (b) only one (1) entry into Draw Two permitted per eligible person; (c) only one (1) entry into Draw Three permitted per eligible person; (d) each entry must be submitted separately and in accordance with the entry instructions; and (e) a limit of one (1) prize per person (excluding SA residents) across all three (3) draws.
Draws & Winner Notification
7. The draws will take place at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne, VIC 3004 on 08/09/2014 at 3:00pm AEST. The Promoter may draw additional reserve entries in each draw and record them in order in case an invalid entry or ineligible entrant is drawn.
8. The winners will be notified by telephone and in writing by email within two (2) business days of the relevant draw, and the Riverfire Prize winners’ names will be published online at
www.thedreamonline.com.au from 08/09/2014.
9. A re-draw for any unclaimed prizes may take place on 15/09/2014 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and in writing by email within two (2) business days of the draw, and their names will be published online at
www.thedreamonline.com.au from 15/09/2014.
10. The first forty (40) valid entries drawn in Draw One will each win a double-pass to the Sunsuper Riverfire Dream Party at Stokehouse in Brisbane, QLD on 27/09/2014, valued at $236 (“Ticket Prize”). The Ticket Prizes comprise of tickets only and winners will be responsible for their own travel to and from the Sunsuper Riverfire Dream Party event.
11. The Ticket Prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
12. The first valid entry drawn in each of Draw Two and Draw Three will each win a Sunsuper Riverfire VIP Ultimate Experience for him/herself and one (1) adult travel companion, valued at up to $4,013.50 depending on the winner’s point of departure (“Riverfire Prize”). The Riverfire Prize includes:
• return economy flights from the winner’s nearest Australian capital city/regional centre to
Brisbane, QLD (only provided if winner resides outside of South East Queensland);
• either luxury return transfers from Brisbane airport to Rydges South Bank, Brisbane QLD (if the winner resides outside of South East Queensland) or, two (2) nights parking at Rydges South
Bank (if the winner resides in South East Queensland);
• A double-pass to the Sunsuper Riverfire Dream Party at Stokehouse Brisbane on 27/09/2014
(valued at $236);
• Two (2) nights’ accommodation at Rydges South Bank, Brisbane QLD on 26/09/2014 and
27/09/2014 (valued at $618);
• A day spa package for the winner (exact spa to be determined by the Promoter in its absolute
discretion);
• Three Festival Flavours experiences for two (2) people (valued at $60 each) at three of Brisbane’s best restaurants (as determined by the Promoter);
• $250 Myer Centre gift card for the winner;
• Two (2) tickets to Black Diggers on Friday 26/09/2014 at 7.30pm (valued at $160); and
• A private gondola on the Wheel of Brisbane for two (2) people (valued at $95).
For avoidance of doubt, if the winner is from South East Queensland, then the prize does not include airfares and this component of the prize will not redeemable for cash. Any South East Queensland winner/s must make their own way to/from the accommodation.
13. Spending money, additional meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included in the Riverfire Prize. The Riverfire Prize must be taken to coincide with the 2014 Sunsuper Riverfire Dream Party, with travel from 26/09/2014 to 28/09/2014, and is subject to booking and flight availability.
14. The Riverfire Prize winners and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of any Riverfire Prize. Components of the Riverfire Prize are subject to the standard terms and conditions of individual prize and service providers. The winners may be required to present their credit card at time of accommodation check in.
15. Any ancillary costs associated with redeeming the Myer Centre gift card are not included. Any unused balance of the Myer Centre gift card will not be awarded as cash. Redemption of the Myer Centre gift card is subject to any terms and conditions of the issuer including those specified on the Myer Centre gift card.
General
16. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
17. The Promoter’s decision is final and no correspondence will be entered into.
18. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and TFN) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
19. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
20. If for any reason a winner does not take a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
21. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
22. Total prize pool value is up to $17,467.
23. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
26. Any cost associated with accessing a promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
27. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the 2014 Sunsuper Riverfire Dream Party event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking/use of and/or participation in a prize.
30. As a condition of accepting a Riverfire Prize, each winner (and the Riverfire Prize winners’ companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
31. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at
www.sunsuper.com.au/content/privacy.cfm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. In order to conduct this competition, the Promoter will not disclose entrant’s personal information to any entity outside of Australia. Generally, the Promoter may disclose member’s personal information to entities outside Australia only for the purposes and to the locations described in its Privacy Policy.
