1.   Information on how to enter forms part of the terms of entry. Entry into the Serengeti & Outback Floatplane Adventures Competition (“Competition”) is deemed acceptance of these terms and conditions.

2.   The promoter of the Competition is NGC Network (Australia) Pty Ltd of Level 3, 4-16 Yurong Street, Darlinghurst, New South Wales 2010, Australia (“Promoter”).

3.   All entrants in this competition must be 18 years or older at the time of entry.

4.   Entry is open to residents of Australia only.

5.   Entry is not open to:

a)   employees of the Promoter, AUSTAR, FOXTEL, FETCH TV, Optus TV featuring FOXTEL, FOXTEL from Telstra, Telstra Clear Cable TV, Neighbourhood Cable and TransACT, or an employee of these companies’ related corporations or agencies or any other company associated with the Promoter and/or the Competition; or

b)   a spouse, de facto spouse, parent, child or sibling (whether natural or by adoption) of such an employee.

6.   The Competition commences on Monday November 24, 2014 at 00:01 (AEDT) and concludes on Sunday December 21 2014 at 23:59 (AEDT).

7.   Entrants are required to (i) provide the following details: contact name, email address, contact telephone, and (ii) answer the 25 words or less question. One complete and valid online registration will provide the entrant one entry in the Competition.

8.   Each entrant can enter as many times as they wish, but each entry must include a different answer to the 25 words or less question. Incomplete and incomprehensible entries will be deemed invalid.

9.   The Promoter reserves the right to request winners to provide proof of identity. Proof of identification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

10.   The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. This includes entries conducted by automated online software applications designed to create more than one entry for a single entrant by falsifying and or manipulating entrants’ details such as creating false e-mail addresses. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

11.   Entries must be received by 23:59 (AEDT) on Sunday December 21 2014.  The time of entry will in each case be the time the entry is received by the Promoter and not at the time of submission. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.

12.   Major Prize details: 1 x Trip for 2 to Darwin to experience Matt Wright’s Outback Float Plane Adventures trip; return airfares from a capital city to Darwin; 2 night’s accommodation in Darwin, valued up to AUD$4,000 (including GST).

13.   Runner Up Prize details: 5 x pairs of Serengeti sunglasses valued up to AUD$400 (including GST) per pair from the current Australian collection.

14.   Total prize pool value = AUD$6,000 (including GST)

15.   The major prize is subject to the following terms and conditions imposed by the operator of the Outback Floatplane Adventures tour:

a.   Weight restrictions prevent us from taking passengers over 120kg

b.   Children under 4 years of age require prior management approval

c.   We will always try our very best to cater for all dietary requirements if notified at time of booking

d.   Outback Floatplane Adventures reserves the right to alter the tour specifications if operationally required

e.   We operate in a remote area and whilst every care is taken for the safety and wellbeing of our passengers, we strongly recommend that all passengers arrange their own travel insurance.

16.   The winner of the major prize will need to sign and return an indemnity form which acknowledges the following:

a.   Outback Floatplane Adventures have a duty of care to all our passengers, however it is each individual’s responsibility to ensure they have their own travel insurance suitable to the activities to be undertaken on our tours

b.   We request that each and every passenger acknowledges by way of their signature, that they have been made aware of an element of risk; and that we will take all precautions to ensure their safety.

c.   The elements of risk include, but are not limited to; Exposure to Machinery, Remote Location, On Water Activities, Wildlife including Crocodiles.

d.   All passengers are reminded that activities are over water and as such, they should keep all personal items secured, such as; cameras, mobile phones, sunglasses etc.  Outback Floatplane Adventures is not responsible for any loss or damage to any such personal items.

e.   To help us reduce your exposure to risk, we request at all times passengers listen to and obey the commands of Outback Floatplane Adventures – this includes any visible signage, or any verbal instruction given by staff members of the Outback Floatplane Adventures.

17.   The major prize is valid to be taken during the period from April 2015 through to November 2015 on dates tour is operational, subject to availability and weather permitting).

18.   The prizes are not transferable, available for sale or redeemable for cash. The major prize must be redeemed within the validity period or the major prize will be forfeited.

19.   If any prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

20.   In the event that for any reason whatsoever a winner does not take an element of the major prize at the time stipulated by the Promoter then that element of the major prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the major prize.

21.   Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

22.   Independent financial advice should be sought as tax implications may arise as a result of accepting a prize.

23.   Each entrant acknowledges that the major prize incorporated elements provided by third parties over whom the Promoter has no control.

24.   Each valid entrant who has entered the competition over the duration of the promotional period will be entered into the competition.  1 valid entrant per prize will be chosen, based on their answer. The judging will take place at the Promoter’s premises as set out above, on Tuesday December 23 2014 at 17:00 (AEDT).

25.   This is a game of skill and chance plays no part in determining the winner.  Each entry will be individually judged based on the creative merit of the answer provided to the 25 words or less question.

26.   The winners will be notified by email.

27.   Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

28.   The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.

29.   It is a condition of accepting the major prize that the winner must comply with all the conditions of use of the major prize and the major prize supplier’s requirements.

30.   In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

31.   The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or by any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

32.   The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

33.   The Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

34.   If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any direction given under State Regulation.

35.   All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this Competition.  AUTOMATIC OPT-IN: By entering the Competition, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. 36.   Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
