TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents (excluding SA residents) aged 18 years or over who are the parent/guardian of a child (or children) under 18 years of age (as at the time of entry). Employees (and their immediate families) of the Promoter, participating Monkey Mania Children’s Play Centres and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. Promotion commences on 01/12/2014 and ends at 5:00pm AEST on 26/04/2015 (“Promotional Period”).
4. To be eligible to enter, the parent/guardian of an eligible child/children must complete the following steps during the Promotional Period:
a) purchase any casual entry that is valued at a minimum of $6, for their eligible child, to any Monkey Mania Children’s Play Centre in NSW, ACT or VIC. The parent/guardian will be provided with a unique code at the point of purchase. It is the responsibility of the individual to ensure that they obtain a unique code; and
b) use the handheld device provided at the time of purchase to access the promotion entry page, input the requested details including their full name, valid email address and mobile telephone number, the full name of their child and the unique code, select their child’s preferred ‘monkey name’ from the options listed and submit the fully completed entry form.
For the removal of doubt, any child or their parent/guardian who are only attending a party at a Monkey Mania Children’s Play Centre are not permitted to enter this promotion.
5. At the end of the Promotional Period, the Promoter will tally all “monkey name” selections submitted in each entry and deem the “monkey name” that receives the highest number of selections as the winning “monkey name”. In the unlikely event that two (2) or more “monkey names” receive the same highest number of selections, then each of those “monkey names” will be deemed to be a winning “monkey name” for the purposes of this promotion. Only the entrants who selected a winning “monkey name” will receive an entry into the draw. Any individuals who select a non-winning “monkey name” will not be entered into the draw.
6. The Promoter reserves the right, at any time, to verify the validity of entries, entrants and their children (including an entrant/child’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
7. Incomplete or indecipherable entries will be deemed invalid.
8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per eligible casual entry purchased; (b) each entry must be submitted separately and in accordance with entry requirements; (c) only one (1) unique code per entry is permitted; (d) the same unique code cannot be used more than once; and (e) unrecognised codes will be deemed invalid. For the avoidance of doubt, if an entrant purchases more than one (1) eligible casual entry, he/she will be provided with a unique code and will be eligible to receive an entry for each eligible casual pass purchased.
9. If there is a dispute as to the identity of an entrant and/or their child, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant and/or their child.
10. One (1) prize draw will be conducted from all entries that submitted the winning “monkey name”.. The draw will take place at Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250 on 29/04/2015 at 11:00am AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing within two (2) business days of the draw and the winners’ names (of prizes valued at over $250) will be published on
www.monkeymania.com.au/name-the-monkey from 06/05/2015.
11. The Promoter’s decision is final and no correspondence will be entered into.
12. The first valid entry drawn will win $10,000, awarded in the form of a cheque made payable to the winner or the winner’s child (as determined by the winner, in their absolute discretion). The major prize winner will be required to attend either the Monkey Mania Children’s Play Centre where their winning entry was submitted (in the case of a winner who resides in NSW, VIC or ACT) or at a location to be determined by the Promoter in agreement with the major prize winner (if the major prize winner is from WA, QLD, NT or TAS), to have the major prize awarded to them. The date and time of the event is to be determined by the Promoter in agreement with the major prize winner. In the event that agreement in relation to the date, time or location cannot be reached, the Promoter reserves the right to determine the location, date and time of the event.
13. The next thirty (30) valid entries drawn will each win a Gorilla party for up to ten (10) children valued at $338, at the Monkey Mania Children’s Play Centre in NSW, VIC or ACT of the winner’s choice. The Gorilla party must be held by 29/04/2016 and is subject to booking availability. Gorilla party cannot be held on a public holiday and must be held within normal operating hours of the Monkey Mania Children’s Play Centre selected. Additional children can be added for normal additional party child fee, which will be the sole responsibility of the winner. Once the Gorilla party is booked, no changes can be made except for changes made three (3) weeks prior to the date of the booked Gorilla party, however, all changes are subject to approval and administration fees will apply to any changes made. The Gorilla party prizes are subject to the standard terms and conditions of Monkey Mania Children’s Play Centre.
14. The next eighty (80) valid entries drawn will each win a Monkey Mania Children’s Play Centre family pass (for two (2) adults and two (2) children aged under 18 years) valued at $29. Pass is redeemable at any Monkey Mania Children’s Play Centre in NSW, VIC and ACT.
15. The next one-hundred and sixty (160) valid entries drawn will each win a Monkey Mania Children’s Play Centre free pass (for one (1) child aged under 18 years) valued at $10.50. Pass is redeemable at any Monkey Mania Children’s Play Centre in NSW, VIC and ACT.
16. Any ancillary costs associated with redeeming a Monkey Mania Children’s Play Centre pass are not included. Any unused balance of the Monkey Mania Children’s Play Centre pass will not be awarded as cash. Redemption of the Monkey Mania Children’s Play Centre pass is subject to any terms and conditions of the issuer including those specified on the Monkey Mania Children’s Play Centre pass.
17. All prizes will be awarded to the winner, who can transfer them to or redeem them for their eligible child/children (as appropriate). Winners are responsible for all costs associated with taking, using or redeeming a prize, including but not limited to all costs associated with travel to and from the selected Monkey Mania Children’s Play Centres.
18. If for any reason a winner does not redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
19. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
20. Total prize pool value is $24,140.
21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
22. A draw for any unclaimed prizes may take place on 29/07/2015 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their names (for prizes valued at over $250) will be published on

23. Entrants consent to the Promoter using their and their child’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/taking of or participation in a prize.
27. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at
www.monkeymania.com.au. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
