By entering this Competition, participants consent to receiving any messages regarding the Competition distributed electronically and other messages distributed electronically which inform the participant of other marketing, promotions or publications of the Promoter and its related parties or associated third parties. Participant's entries become the property of the Promoter and the Promoter may anonymously share a participant's “Pet Care Pledge” with any party as part of marketing campaigns for an unlimited period of time, without remuneration and for the purpose of promoting this Competition (including any outcome of this Competition). The Promoter will share the anonymous results of the winning participant's pledge with media and other customers as part of ongoing marketing campaigns. The Promoter may also contact a participant for their consent to use a participant's "Pet Care Pledge" as a case study to share in marketing
 
 1.Promoter
The promoter of the Competition is Best Friends Retail Pty Ltd ACN 159 053 399 of Level 1, 2-6 Sloane Street, Maribyrnong, Victoria 3032 (Promoter).
2.Terms and Conditions
2.1By participating in the Competition, participants agree to be bound by these terms and conditions (Terms and Conditions). Information on how to participate and the prizes form part of these Terms and Conditions.
2.2The Promoter reserves the right in its sole and absolute discretion and to the extent permitted by law to amend any aspect of this Competition at any time (including these Terms and Conditions) without prior notification. Participants are encouraged to regularly check www.bestfriendspets.com.au (Website) for any amendments to these Terms and Conditions or to the Competition.
3.Eligibility
To be eligible to enter the Competition, each participant must, during the Promotional Period (as defined below):
be an Australian resident aged 18 years or older;
not be an employee or contractor of the Promoter or any of its related corporations or any of their agents, retailers and suppliers associated with the Competition (Excluded Employees); and
not be a person who is a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of an Excluded Employee.
4.Term
The Competition commences at 9:00 am on 29 December 2014 and closes at 5:30 pm on 2 February 2015 (Promotional Period). Entries received outside of the Promotional Period will not be accepted by the Promoter. The time of entry will be deemed to be when the Promoter receives a valid Entry Form (as defined below) from the participant in accordance with clause 5.5.
5.How to enter
5.1Participants who wish to enter the Competition must comply with all applicable requirements during the Promotion Period and complete a "Pledge Your Pet Care Resolution for 2015" entry form (Entry Form) and submit the Entry Form on the Promoter's Website during the Promotional Period.
5.2When submitting the Entry Form, the participant must:
state their personal contact details (including their name, postal address, email address and telephone number); and
pledge in 25 words or less their pet care resolution for 2015. Once submitted, no changes to, or withdrawal of, any entry will be permitted.
5.3Entries must not contain any content that infringes the rights (including, without limitation, intellectual property rights) of any person, is unlawful or, in the opinion of the Promoter, is obscene, offensive, potentially defamatory, discriminatory, hateful, racially or ethnically offensive, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving excessive violence, malice or swearing).
5.4Entries must be submitted in accordance with the entry instructions above and will not be accepted in any other form. No responsibility is accepted by the Promoter for late, lost, misdirected, illegible or incomprehensive entries. Incomplete entries and those that breach these Terms and Conditions as determined by the Promoter in its sole discretion or any other content guidelines notified by the Promoter during the Promotional Period, will be deemed invalid.
5.5By submitting the Entry Form in accordance with this clause 5, the participant will be entered into the Competition. A participant is entitled to enter the Competition once.
6.Participation Vouchers
6.1In addition to being entitled to win the Competition, every participant who validly enters the Competition will receive the following vouchers from the Promoter to the value of $50.00 (Vouchers):
$10.00 discount on Hills Science Diet 2-3kg varieties;
$20.00 discount on Advocate 6 pack varieties;
$10.00 discount on Ezy Dog collars and leads; and
a $10.00 Best Friends voucher to spend in any retail store operated by the Promoter (Best Friends Pets Store). This voucher cannot be used to purchase gift cards at a Best Friends Pets Store or with Our Vet Pty Ltd ACN 126 436 628 (Our Vet).
6.2The Vouchers will be emailed to the email address nominated by the participant on their Entry Form.
6.3The participant must use the full amount of each Voucher in the one transaction. If the full amount of each Voucher is not claimed in the one transaction, the unused portion of that Voucher will be forfeited by the participant.
6.4Each Voucher is valid until 1 March 2015.
6.5It is the sole responsibility of each participant to claim their Vouchers. Each Voucher is not transferrable or exchangeable and cannot be taken as cash, unless otherwise specified. Stolen, onsold, transferred or copied Vouchers will be deemed invalid. A decision by the Promoter in relation to the validity of the Vouchers is final and binding.
7.Major Prize
7.1There will be one (1) major prize determination (Major Prize) from all valid entries received during the Promotional Period. The Major Prize will be judged by the Campaign Manager and Head of Marketing of the Promoter between the period of 3 February 2015 and 5 February 2015 at the Best Friends Support Centre, 2-6 Sloane Street, Maribyrnong Victoria 3032.
7.2All valid entries will be judged on their creativity, literary merit and originality. This Competition is a game of skill, and chance will play no part in determining the winner of this Competition.
7.3The Major Prize includes:
two (2) standard consultations with Our Vet (with a combined value of up to $138.00);
four (4) grooming appointments at Best Friends Pets Stores (with a combined value of up to $440.00 based on dog breed, size and condition);
an Ezy Dog Prize Pack comprising one Ezy Dog Leash Road Runner 25 (choice of colour, subject to availability), one Ezy Dog Acc. SnakPak (choice of colour, subject to availability), one Ezy Dog DooBag in black, one Ezy Dog Fold-A-Bowl in size small and in black and one Ezy Dog Harness CP (choice of colour, subject to availability) (with an aggregate value of up to $170.00);
one year's supply of Advocate Flea and Worming Treatments (2 x 6 packs Advocate with a combined value of up to $287.66). One years' supply will be determined by the Promoter in its sole discretion based solely on one type of pet as nominated by the winner of the Major Prize;
one year's supply of Hill's Science Diet premium cat or dog food (up to 15 bags of Hill's Science Diet 15kg with a maximum value of $2,000.00). One year's supply will be determined by the Promoter in its sole discretion based solely on one type of pet as nominated by the winner of the Major Prize; and
$5,000.00 cash (which will be paid to the winner by way of cheque in accordance with clause Cool.
7.4The total prize pool value for the Major Prize is up to $8,035.66.
7.5Each component of the Major Prize is valid until 31 December 2015 unless stated otherwise in these Terms and Conditions.
7.6The prize values included in the Major Prize are based upon the recommended retail prices at the time of printing these Terms and Conditions. The Promoter accepts no responsibility for any variation in the value of any of the items in the Major Prize.
7.7If the Major Prize, or any part of the Major Prize, is unavailable for any reason, the Promoter, in its sole discretion, reserves the right to substitute the Major Prize (or an element of it) with a prize to the equal value or specification.
7.8The Major Prize, or any unused portion of the Major Prize, is not transferrable or exchangeable and cannot be taken as cash, unless otherwise specified.
7.9If for any reasons whatsoever, the winner does not use all components of the Major Prize within the time frames stipulated by the Promoter, then that component of the Major Prize not used will be forfeited by the winner and cash will not be awarded in lieu of the forfeited component.
7.10The Promoter's decision in relation to the winner of the Competition will be final and no correspondence will be entered into by the Promoter regarding the result of the Competition.
8.Prize Collection
8.1The results of the Major Prize winner will be published on the Promoter's Facebook page (www.facebook.com/BestFriendsPetSuperCentre). By entering into this Competition, the winner consents to their first name, surname, suburb and state being published on the Promoter's Facebook page.
8.2The winner will be separately notified by 10 February 2015 by email, telephone or by any other such method of communication that the Promoter deems appropriate based on the details contained in the winner's Entry Form. All reasonable steps will be made to contact the winner.
8.3The Major Prize will be sent to the postal address nominated by the winner on their Entry Form via Australia Post within 30 days of announcing the winner. If the Promoter does not hold a valid postal address for the winner, the Promoter will request a valid postal address from the winner when it notifies the winner of its prize. The Promoter is not responsible for the loss of any Vouchers or the Major Prize due to incorrect or imprecise delivery details provided by a participant. The Promoter takes no responsibility if the Vouchers (or any part thereof) or the Major Prize (or any part thereof) are damaged, delayed or lost in transit by Australia Post or any other logistics provider.
8.4It is the sole responsibility of the winner to claim the Major Prize. If the Major Prize remains unclaimed 2 months after the Promoter has notified the participant that they have won the Major Prize, the next best entry as determined by the Promoter will be deemed to be the winner of the Major Prize and the Major Prize will be awarded to them in the same manner as if they were the original winner.
8.5If a participant's contact details change during the Promotional Period, it is the participant's responsibility to notify the Promoter of that change.
9.Time, Currency and Tax Implications
All references to time and dates are to time and dates in Melbourne, which may be Australian Eastern Standard Time (AEST) or Australian Eastern Daylight Time (AEDT) depending on the date.
The Vouchers and the Major Prize are valued in Australian dollars. All monetary amounts expressed in these Terms and Conditions include GST (as that term is defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth)).
The winner of the Major Prize is advised that tax implications may arise from winning the Major Prize and they should seek independent financial and tax advice before accepting the relevant prize.
10.Limits on claiming prizes
Unless otherwise indicated, a prize awarded in connection with the Competition may not be used in conjunction with any other special offers, discounts or promotions conducted by the Promoter.
11.Promoter's rights
At the Promoter's absolute discretion, the Promoter reserves the right, at any time, to:
verify the validity of entries and participants (including a participant's identity, age and place of residence); and
disqualify any participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Any decision made by the Promoter will be final and binding.
Despite anything to the contrary contained in these Terms and Conditions, errors and omissions may be accepted at the Promoter's absolute discretion.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
12.General
12.1 Release
It is a condition of acceptance of the Major Prize that the winner may be required to sign a legal release document or other documents of consent in respect of the relevant prize. These documents will be provided in a form to be determined by the Promoter.
12.2 Promoter not responsible
The Promoter is not responsible for any problems or technological malfunctions of any telephone network or lines, computer systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination including, but not limited to, any injury or damage to participants or any other person's computer related to or resulting from participation in or downloading any materials in respect of this Competition.
Any costs associated with accessing the promotional website in respect of the Competition is the participant's responsibility and is dependent on the internet service provider used.
The Promoter will not be liable for any Vouchers or any part of the Major Prize which is awarded in the form of, or comprises, a ticket, pass, voucher or letter, that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the ticket, pass, voucher or letter, is subject to these Terms and Conditions. In the event that the winner is requested to provide proof of age or any other form of consent, redemption of the ticket, pass, voucher or letter will be subject to presentation of such proof of age. What constitutes identification and/or proof of consent is at the complete discretion of the Promoter or any other service providers.
If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion and to the fullest extent permitted by law to:
disqualify any participant; or
modify, suspend, terminate or cancel the Competition, as appropriate in the circumstances.
12.3Promoter not liable
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, agents and related parties (as that term is defined in the Corporations Act 2001 (Cth) in relation to a 'public company' and as extended to bodies corporate generally)) is not liable for, and each participant must not bring any claim for, any personal injury, or any loss or damage whatsoever (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to:
any negligence of the Promoter (including its officers, employees, agents and related parties);
technical difficulties or equipment malfunction (whether or not under the Promoter's control);
any theft, unauthorised access or third party interference;
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
any tax liability incurred by the winner; and
the redemption or taking of the Vouchers or the Major Prize.
12.4Ownership of entries
All entries submitted (including any rights to the intellectual property contained in such entries) are assigned to, and become the property of, the Promoter.
The Promoter is entitled to use any of the entries submitted for any purpose at its sole and absolute discretion, including (but not limited to) for any future promotion, marketing and publicity purposes.
The participant consents to the Promoter using the entry anonymously in any manner the Promoter wishes including modifying, adapting or publishing the entry, whether in original or modified form, in whole or in part, by way of sharing with media and customers as part of ongoing marketing campaigns, sharing on social media and use of the results of any survey undertaken in respect of the Competition as case studies to share in marketing communications, for an unlimited period without payment to the participant of royalties, compensation or otherwise.
Entries will not be returned to any participant.
By entering this Competition each participant warrants to the Promoter that each entry submitted does not contain any material which would infringe the rights of any third party, including any copyright, trademark or other third party intellectual property rights.
The participant agrees to indemnify the Promoter, and keep the Promoter indemnified, against all claims and costs by third parties arising from a breach of the warranty set out in this clause.
12.5Communications

12.6Privacy
The collection, use and disclosure of personal information provided in connection with this Competition is governed by the Privacy Policy which is available at www.bestfriendspets.com.au.
12.7Jurisdiction
These Terms and Conditions are governed by, and are to be construed in accordance with, the laws enforceable in Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia and any court hearing appeals from those courts.
12.8Whole agreement
These Terms and Conditions (and any information on how to participate in this Competition) embody the entire agreement between the Promoter and each participant with respect to this Competition.
12.9Validity
Any provision in these Terms and Conditions which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these Terms and Conditions or affecting the validity or enforceability of that provision in any other jurisdiction.
