TERMS AND CONDITIONS

“VOLKSWAGEN DAS AUTO TENNIS” PROMOTION


Participation
1. Information on how to enter and the prize(s) form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these
Terms and Conditions. All times indicated in these Terms and Conditions will
be based on either Sydney, Melbourne or Brisbane local time as context
requires.

2. Entry is only open to Australian residents aged 18 years or over. Employees
(and their immediate families) of the Promoter and agencies associated with
this promotion are ineligible to enter. Immediate family means any of the
following: spouse, ex-spouse, de-facto spouse, child or step-child (whether
natural or by adoption), parent, step-parent, grandparent, step-grandparent,
uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
cousin. Current and former professional tennis players are also prohibited
from entry into this promotion.

Entry
3. This promotion is comprised of three (3) “Baseline Challenges”, with one (1)
Baseline Challenge to be conducted at each of the three (3) following tennis
tournaments:

(a) Brisbane International presented by Suncorp
(“Brisbane International”) held at Queensland Tennis
Centre between 04/01/15 and 11/01/15;

(b) Apia International Sydney, (“Sydney International”)
held at the Sydney Olympic Park Tennis Centre
between 11/01/15 and 17/01/15; and

(c) Priceline Pharmacy Classic, Kooyong (“Kooyong
Classic”), held at the Kooyong Lawn Tennis Club
between 13/01/15 and 16/01/15.

4. To be eligible to enter a Baseline Challenge, individuals must attend one (1)
of the following sessions at any of the above tennis tournaments as follows.

5. For the sake of clarity, Kooyong Classic sessions are listed twice as there will
be two (2) separate opportunities to be selected (as set out in clause 9) for
each session.3

6. Alternatively, if an individual has purchased tickets to any of the above
sessions, they can visit

10:00am 18/12/14 and 10:00am on 07/01/14 (or 10:00am 02/01/15 for
individuals attending the Brisbane International), follow the prompts to the
competition entry page, input all requested details including first name, last
name, postcode, State/Territory of residence, email address, mobile phone
number, date of birth, tournament attending and session attending, and
submit the fully completed entry form to pre-register for the chance to be preselected
for early inclusion. This process can only be undertaken once per
person.

Early Inclusion Pre-Registration Draw

7. All individuals who pre-register an entry in accordance with clause 6 above
will be entered into a pre-selection draw for the opportunity to receive early
inclusion into the Qualifying Round (as defined in clause 12) that corresponds
to the session they are attending. There will be one (1) early inclusion preselection
conducted for each session outlined in clause 4. Pre-selections for
each session will be conducted at Mango, Level 3, 46-52 Mountain Street,
Ultimo, NSW 2010 at 11am on 02/01/15 (for Brisbane International sessions)
and 11:00am on 07/01/15 (for all other sessions). Pre-selected entrants will
be notified via phone and in writing within two (2) business days.

8. The first valid entry pre-selected for each session will each be granted early
inclusion into the Qualifying Round corresponding to that session. Each preselected
entrant must attend the session corresponding to their Qualifying
Round. Entrants are responsible for their own travel to and from the session.
If an entrant does not attend the session at the correct time and location as
advised by the Promoter then their inclusion is forfeited and a replacement will
be selected in accordance with clause 9.

Participant Selection at Tournament

9. During each of the sessions outlined in the table in clause 4, representatives
of the Promoter will hit two (2) (or three (3) in the case an early inclusion
entrant has not attended the session and forfeited their participation in
accordance with clause Cool specially marked tennis balls from the surface of
the tennis court into random areas of the crowd stands. Each eligible
individual that catches a specially marked ball will be selected for participation
in the Qualifying Round of the Baseline Challenge for the session that they
are attending.

10. For the avoidance of doubt, there will be a total of three (3) individuals from
each session outlined in the table in clause 4 who will be selected for
participation in a Qualifying Round for that session. Each selected individual
will herein be referred to as a “Participant”.

11. All Participants must wear appropriate non-black sole marking shoes. All
Participants are responsible for providing their own footwear. If suitable4
footwear, as defined by the Promoter cannot be worn the Participant will
forfeit their place and another Participant will need to be chosen.

Baseline Challenge

12. Each Baseline Challenge is divided into four rounds as follows:
(a) Round 1 – Qualifying Round
(b) Round 2 – Lucky Loser Draw (if required)
(c) Round 3 – Preliminary Final
(d) Round 4 – Grand Final
Round 1 – Qualifying Rounds

13. Each Qualifying Round of each Baseline Challenge will take place at the main
court of each tournament, at a time to be advised by the Promoter. For the
sake of clarity the main court of each tournament is as follows:
(a) Brisbane International – Pat Rafter Arena
(b) Apia International – Ken Roswell Arena
(c) Kooyong Classic – Kooyong Centre Court.
This location is subject to change by the Promoter and will be notified to all
Participants.

14. To participate in a Qualifying Round, each Participant will be required to
attend the specified meeting point of the tournament they are attending at a
specified time as advised by the Promoter. No warm up or access to their
courts or tennis equipment will be permitted prior to entering the main court.
Participants will each be given three (3) attempts to hit a tennis ball over the
main court net and into a target. The target will be either the boot of a vehicle
parked at the opposite end of the court, or a cardboard cut-out of the same, or
any other receptacle nominated by the Promoter as the target. To be counted
as a successful shot into the target, the ball must clear the net and bounce
once only before landing directly in the target, without rebounding off any
other part of the target. A shot that bounces more than once or does not
bounce at all before landing in the target will not be counted as a successful
shot, however, a ball that bounces once and then lands in the target, only to
bounce out again, will be counted as a successful shot. Any form of tennis
shot, either underarm or overarm, will be permitted. Each Participant must
complete all three (3) attempts within one (1) minute. Any attempts not
completed in this time are forfeited. If any Participant attempts to hit a shot
that is not intended to land in the target, such as any shots deliberately
targeted at the crowd or intended to cause damage to any property, they will
be immediately disqualified.

15. The Participant that successfully hits the highest number of balls from their
three (3) attempts in each Qualifying Round will be deemed the winner of that
Qualifying Round and will progress to the Preliminary Final. In the event no
Participants in a particular Qualifying Round complete any successful shots, 5
there will be no winner for that Qualifying Round. In the event of a tie between
two (2) or more Participants in a Qualifying Round, each tied Participant must
compete in a “sudden death” round whereby each Participant continues to hit
balls toward the target in accordance with clause 14 and as instructed by the
Promoter until the tie is broken and a clear winner is determined. However, in
the event of a tie continuing after three (3) attempts by each tied Participant,
the Promoter may, in its absolute discretion, determine the winner in a coin
toss.
Round 2 – Lucky Loser Draw

16. In the event that less than three (3) Participants qualify for the Preliminary
Final for a particular tournament, all non-winning Participants from all
Qualifying Rounds (subject to their consent and provision of personal details
to the Promoter when requested) from that tournament will be entered into a
Lucky Loser Draw. If required, a draw for each tournament will take place at
Queensland Tennis Centre at 8:00pm on 10/01/15 (for Brisbane
International), at the Kooyong Lawn Tennis Club at 6:00pm 15/01/15 (for
Kooyong Classic) and at the Sydney Olympic Tennis Centre at 8:00pm
16/01/15 (for Sydney International). The Promoter will draw the number of
entries required for each tournament (being a minimum of 1 and maximum of
3, as required) to ensure a minimum of three (3) Participants for each
Preliminary Final. All selected Participants will be notified first by phone and
then confirmed in writing.

17. All Round 1 and Round 2 winners as determined in accordance with clauses
15 and 16 will be provided with two (2) tickets to the day of tournament that
the Preliminary Final will be held on, depending on the tournament they
initially attended. All other travel to and from any Preliminary Final will be the
responsibility of the Participant. The Preliminary Finals will be held on
11/01/15 (for Brisbane International), 16/01/15 (for Kooyong Classic) and
17/01/15 (for Sydney International).

Bonus Draw
18. There will also be a “Bonus Draw” conducted in order to determine an
additional “Bonus Participant” in the Preliminary Final held at Sydney
International. Entry into this Bonus Draw will be available via visiting
http://volkswagenaustralia.com.au/Sponsorship/Home/Tennis between
10:00am 18/12/14 and 10:00am on 07/01/15, following the prompts to the
competition entry page, inputting all requested details including first name,
last name, postcode, State/Territory of residence, email address, mobile
phone number and date of birth, and submitting the fully completed entry
form. Only one (1) entry into the Bonus Draw permitted per person. All entries
received via the above will be entered into the Bonus Draw, which will take
place at Mango, Level 3, 46-52 Mountain Street, Ultimo, NSW 2010 at
11:00am on 07/01/15.

19. The first valid entry drawn will be determined as the Bonus Participant and will
win the prize set out in clause 24. 6

20. The next two (2) valid entries drawn will each win a pair of tickets to the
Brisbane International for a date and time specified by the Promoter, valued at
$154.90 per ticket. The next four (4) valid entries drawn will each win a pair of
tickets for the Kooyong Classic on a date and time specified by the Promoter,
valued at $85 per ticket. The next four (4) valid entries drawn will each win a
pair of tickets for the Sydney International for a date and time specified by the
Promoter, valued at $80 per ticket.

21. Winners of tickets prizes will be responsible for their own travel and
accommodation to attend the tournaments on the times and dates specified.

22. The name of the Bonus Participant drawn will be published on
http://volkswagenaustralia.com.au/Sponsorship/Home/Tennis from 08/01/15.

23. All non-winning entries will then be entered into a second Bonus Draw, which
will take place at the same place as the Bonus Draw at 10am on 13/02/15.
Entry into this second Bonus Draw will also be available to other eligible
individuals via visiting
http://volkswagenaustralia.com.au/Sponsorship/Home/Tennis between
10:01am 07/01/15 and 9:59am on 13/02/15. The first three (3) valid entries
drawn in the second Bonus Draw will each win $250 worth of Wilson products.
All winners will be notified in writing within two (2) business days of each
draw.

24. The Bonus Participant will receive two (2) tickets to the Sydney International
on 17/01/15. If the Bonus Participant resides within NSW then they will be
responsible for their own travel to and from the Sydney International. If the
Bonus Participant resides outside of NSW then they will also receive return
economy airfares for two (2) people from their nearest capital city to Sydney,
NSW, and one (1) nights accommodation (minimum 3 stars) in Sydney, NSW.
Total prize value of the Bonus Draw is up to $3,000 depending on point of
departure. Spending money, meals, taxes (excluding airline and airport
taxes), insurance, transport to and from departure point, transfers, items of a
personal nature, in-room charges and all other ancillary costs are not
included. Prize is subject to booking and flight availability. The Bonus
Participant and their companion must depart from and return to the same
departure point and travel together. Itinerary to be determined by the
Promoter in its absolute discretion. Frequent flyer points will not form part of
the prize. Prize is subject to the standard terms and conditions of individual
prize and service providers. The Bonus Participant may be required to present
their credit card at time of accommodation check in.

25. In the event the Bonus Participant cannot be contacted by 10:00am on
09/01/15 or otherwise confirms by this time that they cannot attend the
Preliminary Final at Sydney International the Promoter will conduct an
unclaimed prize draw at the same time and place as the original draw on
09/01/15 in order to award the unclaimed prizes. 7

26. If any other winners in the first Bonus Draw cannot be contacted by 10:00am
on 08/01/15 or otherwise confirms by this time that they cannot attend the
tournament applicable to their awarded tickets, the Promoter will conduct an
unclaimed prize draw at the same time and place as the original draw on
08/01/15 in order to award the unclaimed prizes.

27. Winners, if any, will be notified in writing within two (2) business days of the
draw and the name of the Bonus Participant, if determined, will be published
on http://volkswagenaustralia.com.au/Sponsorship/Home/Tennis from
14/01/15.

28. In the event any of the prizes in the second Bonus Draw remain unclaimed,
they will be awarded in an unclaimed prize draw to be held on 13/05/15 at the
same time and place as the original Bonus Draw, subject to any directions
from a regulatory authority. Winners (if any) will be notified in writing within
two (2) business days of the draw.
Round 3 – Preliminary Final

29. To participate in a Preliminary Final, each Participant (or the Bonus
Participant, as applicable) must attend the relevant tournament on the day
allocated to the Preliminary Final and meet with a representative of the
Promoter at the time advised to them by the Promoter. In the event a
Participant is more than five (5) minutes late for this meeting, or otherwise
advises that they cannot attend the Preliminary Final, the Promoter will
appoint a proxy in their place to participate in the Preliminary Final on the
Participant’s behalf. In the event the proxy reaches the Grand Final (below),
they will also be permitted to participate on behalf of the Participant in the
Grand Final.

30. In each Preliminary Final, each Participant will be given thirty (30) seconds to
hit as many balls as they can into the target. The target and the rules
surrounding shots will be the same as per the Qualifying Rounds. The number
of successful shots by each Participant will be recorded by a representative of
the Promoter, whose decision is final.

31. The Participant at each Preliminary Final that hits the highest number of balls
into the target will be deemed the winner of the Preliminary Final. Each winner
will receive $250 worth of Wilson tennis equipment and will progress to the
Grand Final. In the event of a tie between two (2) or more Participants in a
Preliminary Final, each tied Participant must compete in a “sudden death”
round whereby each Participant continues to hit balls toward the target in
accordance with any instructions given by the Promoter until the tie is broken
and a clear winner is determined. However, in the event of a tie continuing the
Promoter may, in its absolute discretion, determined the winner in a coin toss.
Round 4 – Grand Final

32. The Grand Final for each tournament will occur after the conclusion of each
Preliminary Final during the same session. The Participant in each Grand 8
Final must follow the instructions given to them by the Promoter immediately
prior to the start of the Grand Final, which will involve hitting multiple balls into
the target (“Grand Final Target”). The rules for the Grand Final will be
explained to the Participant prior to their participation in the Grand Final.

33. If the Participant is able to satisfy the criteria of the Promoter for the Grand
Final and achieve the Grand Final Target, the Participant will win the Grand
Prize (as defined below). If the Participant fails to achieve the Grand Final
target the Grand Prize will not be awarded for the Baseline Challenge.

34. The “Grand Prize” is a Volkswagen Polo 66TSI Trendline 7 Speed DSG
valued at up to $21,954.82 including registration, compulsory third party
insurance, stamp duty and dealer delivery charges (which may vary State by
State). Additional insurance, options, petrol and all other ancillary costs are
the responsibility of the winner. The Promoter may, in its absolute discretion,
accommodate the winner’s colour preference (excluding metallic options),
subject to availability. Each winner must collect the prize from their nearest
authorised Volkswagen dealership as determined by the Promoter.

35. Total prize pool value is up to $72,304.06.

36. By participating in any Baseline Challenge, the Participant agrees to do so at
their own risk and accept responsibility for their own safety and personal
possessions.

37. The Participant acknowledges and agrees that they are aware and accept any
and all risks that may be involved in or may arise from participation in any
element of any Baseline Challenge and, to the maximum extent permitted by
law:

a) release and forever discharge the Promoter, and their directors,
officers, servants and agents or any of them; and

b) indemnify and hold the Promoter, and their directors, officers,
servants and agents or any of them harmless,
against all actions, claims and demands relating to or in connection with any
damage, injuries or costs including legal costs, suffered or incurred by the
Participant arising out of or resulting from the Participants' involvement in any
element of any Baseline Challenge.

General Terms

38. The Promoter reserves the right, at any time, to verify the validity of entries
and entrants (including an entrant’s identity, age and place of residence) and
reserves the right, in its sole discretion, to disqualify any individual who the
Promoter has reason to believe has breached any of these Terms and
Conditions, tampered with the entry process or engaged in any unlawful or
other improper misconduct calculated to jeopardise fair and proper conduct of
the promotion. Errors and omissions may be accepted at the Promoter's 9
discretion. Failure by the Promoter to enforce any of its rights at any stage
does not constitute a waiver of those rights. The Promoter's legal rights to
recover damages or other compensation from such an offender are reserved.

39. If there is a dispute as to the identity of an entrant, the Promoter reserves the
right, in its sole discretion, to determine the identity of the entrant.

40. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion,
reserves the right to substitute the prize (or that part of the prize) with a prize
to the equal value and/or specification, subject to any written directions from a
regulatory authority.

41. Prizes, or any unused portion of a prize, are not transferable or exchangeable
and cannot be taken as cash, unless otherwise specified.

42. Entrants consent to the Promoter and the Tennis Promoters (defined in clause
47) using their name, likeness, image and/or voice in the event they are a
Participant (including photograph, film and/or recording of the same) in any
media for an unlimited period without remuneration for the purpose of
promoting this promotion (including any outcome), the Promoter’s
sponsorship and promoting any products manufactured, distributed and/or
supplied by the Promoter or the Tennis Promoters.

43. If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, including but not limited to technical
difficulties, unauthorised intervention or fraud, the Promoter reserves the right,
in its sole discretion, to the fullest extent permitted by law (a) to disqualify any
entrant; or (b) subject to any written directions from a regulatory authority, to
modify, suspend, terminate or cancel the promotion, as appropriate.

44. Any cost associated with accessing any promotional website is the entrant’s
responsibility and is dependent on the Internet service provider used.

45. Nothing in these Terms and Conditions limits, excludes or modifies or
purports to limit, exclude or modify the statutory consumer guarantees as
provided under the Competition and Consumer Act, as well as any other
implied warranties under the ASIC Act or similar consumer protection laws in
the States and Territories of Australia (“Non-Excludable Guarantees”). Except
for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and
agents) excludes all liability (including negligence), for any personal injury; or
any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the promotion.

46. Except for any liability that cannot by law be excluded, including the NonExcludable
Guarantees, the Promoter (including its respective officers,
employees and agents) is not responsible for and excludes all liability
(including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or 10
consequential, arising in any way out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any
theft, unauthorised access or third party interference; (c) any entry or prize
claim that is late, lost, altered, damaged or misdirected (whether or not after
their receipt by the Promoter) due to any reason beyond the reasonable
control of the Promoter; (d) any variation in prize value to that stated in these
Terms and Conditions; (e) if any tennis tournament is delayed, postponed or
cancelled for any reason beyond the reasonable control of the Promoter; (f)
any tax liability incurred by a winner or entrant; or (g) use of a prize.

47. Tennis Australia Limited is the promoter of the Sydney International and
Brisbane International, and International Management Group of America Pty
Limited is the promoter of the Kooyong Classic (collectively referred to as
“Tennis Promoters”). Entry into any tennis tournament is subject to the
conditions of entry for each event. To the full extent permitted by law each
Tennis Promoter excludes liability for any loss, damage or injury whatsoever
suffered or sustained (including, but not limited to direct, indirect, special or
consequential loss or damage, loss of opportunity revenue or profit) arising
directly or indirectly out of or in connection with this promotion including
attendance at tournament venues set in clause 3.

48. The Promoter collects personal information ("PI") in order to conduct the
promotion and may, for this purpose, disclose such PI to third parties,
including but not limited to the Tennis Promoters, agents, contractors, service
providers, prize suppliers and, as required, to Australian regulatory
authorities. Entry is conditional on providing this PI. The Promoter will also
use and handle PI as set out in its Privacy Policy, which can be viewed
athttps://www.volkswagen.com.au/en/tools/navigation/footer/privacy.html.
Tennis Australia Ltd will use and handle PI as set out in its Privacy Policy,
which can be viewed at http://www.tennis.com.au/privacy. International
Management Group of America Pty Limited will use and handle PI as set out
in its Privacy Policy, which can be viewed
at.http://www.kooyongclassic.com.au/Portals/2/IMG%20Privacy%20Policy%2
0March%202014%20FINAL.pdf. In addition to any use that may be outlined in
the above Privacy Policies, the Promoter and Tennis Promoters may, for an
indefinite period, unless otherwise advised, use the PI for promotional,
marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning the entrant. Each Privacy Policy also
contains information about how entrants may opt out, access, update or
correct their PI, how entrants may complain about a breach of the Australian
Privacy Principles or any other applicable law and how those complaints will
be dealt with. All entries become the property of the Promoter. The Promoter
will not disclose entrant’s personal information to any entity outside of
Australia.
