1.This OPTIMUM promotion comprises five separate, but concurrent, competitions (each a "Competition"), one in each of NSW (including ACT), VIC, SA, WA and QLD.
2.The Competitions are conducted by Mars Australia Pty Ltd, trading as Mars Petcare Australia ABN 48 008 454 313, 1 Petcare Place, Wodonga, Victoria 3690 ("Promoter").
3.Information on how to enter and prizes form part of these Conditions. Any entry not complying with these Conditions is invalid.
4.The Competitions are only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 13 years or older (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; (iii) is not an employee of Metcash or any Metcash banner store (including Foodland); and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee. Eligible Entrants aged 13 years or older and less than 18 years of age require parental consent to enter this Competition and may be required to provide evidence of such parental consent at any time by the Promoter.
5.Entry into each Competition opens at 12.01am AEDT on Wednesday, 25th February 2015 and closes at 11.59pm AEST on Tuesday, 7th April 2015 ("Entry Period").
6.Subject to the other conditions, an Eligible Entrant may enter once for every Qualifying Purchase that they make during the Entry Period. The same Qualifying Purchase cannot be used to enter more than once.
7.A "Qualifying Purchase" is the purchase in one transaction, of any two, or more, OPTIMUM cat or dog food products (both the same, or different) from a store trading under the Metcash banner (including Foodland in SA) that is promoting a Competition in-store. IMPORTANT: If more than two OPTIMUM cat or dog food products are purchased in the same transaction, there is still only ONE Qualifying Purchase. Accordingly only ONE entry may be submitted based on that purchase transaction.
8.A Qualifying Purchase that comprises a mixture of OPTIMUM dog and cat products, all OPTIMUM cat products or all OPTIMUM dog products, may be used to enter to win a Cat Food Prize or a Dog Food Prize (see below).
9.An Eligible Entrant may only enter the Competition for the State in which the store in which they made their Qualifying Purchase is located. (For example, an Eligible Entrant who lives in NSW, but makes their Qualifying Purchase from a store in Victoria, can only enter the Victorian Competition.)
10.The NSW, VIC, WA, SA and QLD Competitions can only be entered, as directed, via online entry at the Optimum website only at
www.optimumpet.com.au ["Competition website"]. There are no postal entries for this Competition.
11.To enter the Competition by Internet, an Eligible Entrant must use a compatible browser to visit Competition Website and follow the "Win with Optimum" link and the entry instructions. For each entry, the entrant must provide: (a) the last 6 digits of the bar code on the two OPTIMUM products being used to enter; (b) the number of the receipt or invoice issued for the purchase of the two OPTIMUM products; (c) the State in which the store of purchase is located (ie NSW, VIC, SA, WA or QLD); (d) the word "Cat" or "Dog" to indicate whether the entrant wishes to win a Cat Food Prize or Dog Food Prize; (e) all other details required at the Competition Website, including the entrant's first and last names, postal address and e-mail address.
12.For the two OPTIMUM Products that an entrant uses to submit an internet entry, the entrant MUST retain: (i) the bar codes from the OPTIMUM Products; and (ii) either (a) the original receipt (or a photocopy of it) from the purchase of those OPTIMUM Products that: (I) is issued during the Entry Period by the Metcash store from which the OPTIMUM Products were purchased; and (II) identifies the Promotion Products as items purchased, or (b) the invoice that details the purchase of those OPTIMUM Products.
13.An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the items which condition 12 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
14.(i)Major Prizes: There are 3 Cat Food Prizes and 3 Dog Food Prizes to be won in each Competition (each a "Prize"). Each Cat Food Prize comprises 9 x 3kg bags of dry food together valued at $234.36 recommended retail price ("RRP") (sufficient to feed a healthy 5kg cat for one year). Each Dog Food Prize comprises 8 x 7kg bags of dry food and 365 x 700g cans together valued at $1,379.33 recommended retail price ("RRP") (sufficient to feed a healthy 25kg dog for one year). The winner of a Cat Food Prize may choose which variety of OPTIMUM cat food they wish to receive. The winner of a Dog Food Prize may choose which variety of OPTIMUM dog food they wish to receive.
(ii) Gift: The first 200 Eligible Entrants who submit a valid entry across all five Competitions, are entitled to an Optimum Frisbee. Frisbees will be posted to the address supplied by the Eligible Entrant in their entry within 30 days of the entry being received Each Frisbee is valued at an approximate recommended retail prize of $8.
15.The total value of all Prizes in each Competition is $4,841.08. The total maximum value of all Gifts available to be claimed across all Competitions is $1600.
16.All random electronic prize draws will be conducted at Prime Focus, 403/62 Beach Street, Port Melbourne, VIC 3207 ("Draw Location"). A prize draw will be conducted for each Competition at 12 noon AEST on Wednesday, 8th April 2015 from all valid entries received in the respective Competition and the first three (3) Eligible Entrants with a valid entry drawn which nominated "Cat" will win a Cat Food Prize and the first three (3) Eligible Entrants with a valid entry drawn which nominated "Dog" will win a Dog Food Prize ("Prize Draws").
17.The winners, whenever determined, will be notified in writing and may also be notified by telephone. So far as practicable, the notification will be sent within two days of the determination. The notification will include instructions as to how the winner is to claim their Prize and establish the winner's entitlement to it.
18.The names of the Major Prize winners will be published at
www.optimumpet.com.au from Wednesday, 22nd April 2015 until Friday 22nd May 2015.
19.The Prizes are not exchangeable or transferable and cannot be taken as cash. If, for whatever reason, a specified prize is unavailable, the Promoter reserves the right to award a prize of equal, or greater, value. If a prize is won Eligible Entrant aged under 18 years, the prize will be awarded to the winner's parent/guardian on the winner's behalf.
20.Subject, where relevant, to any directions given under the legislation regulating a Competition, if a Major Prize in a Competition is not claimed by a winner within three (3) months of the Prize Draw, the prize will be awarded to another Eligible Entrant in a redraw commencing at 12 noon AEST on Monday, 27th July 2015 at the Draw Location from all remaining valid entries received in that Competition. If there is a redraw, the name of the winner(s) in the redraw will be published at
www.optimumpet.com.au from Wednesday, 12 August 2015 until Thursday, 10 September 2014.
21.Prizes are valued as at 22/10/14. The Promoter accepts no responsibility for any variations in the value of any prizes. No responsibility is accepted for any tax obligations that may arise for the prize winner. The Promoter recommends that independent financial advice be sought.
22.If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
23.To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competitions or Prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant's rights under the Competition and Consumer Act 2010.
24.Each entry becomes the property of the Promoter. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competitions and publicise their winners. The personal information of the winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize. The Promoter (Mars, we, us or our) collects your personal information via this entry form when you submit an entry to this promotion (Promotion). If we do not collect the personal information you have provided in the entry form, you may not be able to submit a valid entry into the Promotion and may not be able to receive communications about our brands, products and services which may be of interest to you. We may disclose your personal information to our family of companies and to our vendors or service providers. These companies may be based overseas, including in Hong Kong, Singapore and the United States. We require these companies to comply with the Australian privacy laws that apply to your personal information.

25.The Promoter reserves the right to disqualify entries that do not meet these terms and conditions and/or any person who tampers or attempts to tamper with the entry process as outlined in these terms and conditions. By providing your entry you consent to the Promoter using your personal information to determine whether any tampering or attempted tampering with the entry process has occurred.
26.The Promoter is not responsible for any technical problems or other malfunctions which may occur in relation to internet, network or network congestion, including problems with the transmission of entries or injury or damage to a participant or their computer related to entry in this competition.
27.The Promoter does not accept responsibility for late, lost or misdirected entries or entries not received by the Promoter.
28.If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
29.The Promoter's decisions are final and no correspondence will be entered into.
