Terms and Conditions – Gallipoli DVD Promotion

1.Information on How to Enter and prize information form part of these Conditions of Entry (Conditions of Entry). Entry into this Promotion is deemed acceptance of these Conditions of Entry. The promoter is Roadshow Films Pty Limited ABN 57 08018 5593 of Level 1, 500 Chapel Street, South Yarra, VIC 3141 (the Promoter).

2.Entry in the Promotion is open to Australian residents aged 18 years and over, (Entrants) excluding those who are:
(a)Management, employees, directors and contractors of the Promoter, its related entities, agencies, or companies associated with the Promotion;
(b)a spouse, de-facto spouse, parent, guardian, child or sibling of the entrant;

Any cost associated with accessing the competition website is the responsibility of the entrant and is dependent upon the internet service provider used.

3.The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding. No correspondence will be entered into.

4.The Promotion commences at 12:00 AM AEST on Wed 25 Mar 2015 and ends at 23:59 AEST on Monday 27 April 2015 (Promotion Period).

5.To be eligible to win this Promotion, entrants must, during the Promotion Period complete and submit the Entry Form at: www.news.com.au/gallipoli/WIN for one chance in the draw. (Eligible Entrant). Entry is free. One entry per household.

Anyone found intentionally creating multiple Registrations to generate entries (whether using an alias, false name or abbreviated name) will be immediately disqualified from the Promotion. This includes registrations generated on-behalf of members of competition websites.

6.This Promotion is a game of chance. The random Prize draw will be conducted at 2pm on Friday 1 May 2015, at MDSA, 15 Grosvenor Street, Neutral Bay, NSW 2089. The first Eligible entry drawn at random will be the winner of the Promotion and will be notified by phone, by email, and announced in The Australian newspaper on Wednesday 6 May 2015 (the Winner).

7.The Grand Prize is a trip for 2 to Istanbul and a tour of the Anzac Battlefields at Gallipoli (Conditions apply), and includes:

    2 return economy airfares for the winner and their travel companion, from the Winner’s nearest Australian Capital City, flying with an Airline provided by the Prize Partner, to Istanbul, Turkey, including airline taxes.
    Return Airport transfers in Instanbul.
    3 night’s twin share accommodation at a 4 Star Hotel selected by the Prize Partner, with breakfasts for each day.
    A half day City Tour of Istanbul..
    Return transfers between Istanbul and Gallipoli.
    A fully escorted 2 day tour of the Anzac Battlefields at Gallipoli.
    One night’s twin share accommodation at a 4 Star Hotel, selected by the Prize Partner, in Gallipoli, with breakfasts.

Total maximum retail value of the Major Prize is $10,000 including GST, which is correct at the time of publication.
The Promoter takes no responsibility for any variation in any element of the Prize.

8.Travel must be completed by 1 May 2016 is subject to the availability of each Prize element. Air tickets are for economy travel on regular scheduled services of the airline selected by the Prize Partner and is subject to seasonal embargos & availabilities. Flight itineraries may need to be adjusted depending on the Winners’ departure city and current airline flight schedules. Travel must coincide with the dates specified in these terms and conditions. The Prize or any elements of the Prize cannot be refunded for cash, exchanged or transferred, and cannot be used in conjunction with any Frequent Flyer or Loyalty Programme.

9.A credit card imprint or cash deposit may be required from the Winner upon at check-in at the hotels included in the Prize, which may be used for incidental charges, not included in the Clause 7. Once accommodation is booked, changes are not permitted. Hotel Booking Terms & Conditions apply.

10.All components of the Prize must be taken together. Travel restrictions may apply. The Prize Winner and their travel companion must travel together. Meals, (other than specified, or included), tips, insurances, transfer costs domestic travel to and from the departure point, room service, telephone charges and any other personal expenses, are the responsibility of the Winner and their travel companion. If for any reason, the winner is unable to accept the Prize, or any element of the Prize, as stated in Clause 7. The winner will forfeit the Prize, or any element of the Prize and no compensation will be given in lieu. Changes and cancellations to any element of the Prize may be subject to fees payable by the Winner.

11.Any travel or entry documentation (Passports, Visas & any Insurances) will be the responsibility of the Winner and their travel companion. It is the Winner’s responsibility to check with all government travel advisory and immigration authorities regarding travel requirements and eligibility. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements are the sole responsibility of the Winner and their travel companion.

12.If any portion of the Prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize, or any element of the Prize, for an element of similar theme and of equal value, subject to State regulation and subsequent approval. The Promoter is not responsible for any cancellation, postponement, delay or rescheduling of any element of any element of the Prize. Any costs, without limitation, incurred, will be the sole responsibility of the Prize Winner. In the event that for any reason whatsoever a Winner does not claim, use or accept the Prize at or within the time stipulated by the Promoter, the Prize will be forfeited by the Winner.

13.Travel insurance is not included in the Prize and the Promoter highly recommends that the Winner take out travel insurance to protect against any additional costs which may be incurred in the event of unforeseen circumstances. In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Promoter, the Promoter reserves the right to either provide an alternative travel destination to the same value as the original Prize or, subject to any applicable laws or written directions made under applicable legislation, or to cancel, terminate, modify or suspend the promotion.

14.The Promoter and any associated Companies involved in the Promotion, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the Winner and their travel companion, to first check with all government travel advisory information regarding the safety and situation at the Prize destination. International travel advice can be obtained from various sources, including the Australian Government, any local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

15.The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

16.The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these Terms and Conditions, or forfeiting or not claiming the Prize. The Promoter will use all reasonable efforts to contact the winner using the contact details provided in their entry, however the Prize will be considered forfeited if the winner still cannot be contacted by Wednesday 16 September 2015. If the Prize remains unclaimed or forfeited (through ineligibility or otherwise, the Promoter will instruct MDSA to conduct such further random redraw at 12 noon (AEST) on Thursday 17 September 2015 at the same place as the original draw as necessary to award the unclaimed Prize, subject to any written direction given under applicable law. The unclaimed Prize Winner will be notified by phone, by email, and announced in The Australian newspaper and published on: www.news.com.au/gallipoli/WIN on Wednesday 23 September 2015.

17.In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Promoter, the Promoter reserves the right to either provide an alternative travel destination to the same value as the original Prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion. The Promoter and the associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the Winner and guest to first check with all government travel advisory information regarding the safety and situation of the destination of their chosen destination/event.

18.The Promoter accepts no responsibility for any entries not received for any reason, during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries.

19.If, for any reason, the Promotion is not capable of being run as planned, including due to tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to States and Territories regulations, including cancelling, terminating, modifying or suspending the Promotion.

20.Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry or draw mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.

21.The Promoter, Promoter’s Management, employees, Directors and contractors, its related entities, agencies, or companies associated with the Promotion shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the Grand Prize or the Major Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).

22.The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of any Prize.

23.All entries become the property of the Promoter.  Entries not completed in accordance with the conditions of entry or received after the closing date will not be considered.  Indecipherable or incomplete entries will be disregarded.  No responsibility is taken for any late or misdirected email.

24.The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any elements included in the Prize. To the extent permitted by law, the Promoter, its employees and agents are not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the Winner and, where applicable, to any persons accompanying the Winner.  This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law.

25.The Promoter reserves the right to announce or publish the winner’s name for publicity purposes.  This information may be disclosed to State departments and published as required by the relevant legislation regulating trade promotions.

26.The information Entrants provide (Entry Information) will be used by the Promoter for the purpose of conducting this Promotion and for the purposes set out in this clause, as well as clauses 27 & 28. By entering this Promotion, entrants consent to the storage of their entry information on the databases of the Promoter.

27.All entries become the property of the Promoter. By ticking the opt-in box, entrants agree to receive information on Promotions from the Promoter and the Partners involved in this Promotion who include: Roadshow Films Pty Limited (ABN 57 08018 5593), Cohort Digital (ABN 13 562 062 502), Reader's Digest (Australia) Pty Limited (ABN 81 000 565 471), Edge Loyalty Systems ABN 96 138 299 288, Mat McLaughlan Battlefields Tours, a Division of Travel & Living Pty Ltd (ABN 51 105 498 066), News Life Media (ABN 57 088 923 906) & Access Digital Entertainment Pty Ltd (ABN 71 160 754 736).  The Promoter and its related bodies and/or Partners may use this information for future promotional and marketing purposes regarding their products and services, including contacting entrants via any contact details (eMail, mail, phone or SMS) provided by the entrant without further reference or compensation to the entrant, for an indefinite period, or until the entrant opts out from the Promoter’s or any Partner’s communications involved with this Promotion. (The eMail platform of some Partners may be housed outside Australia).  The Promoter and any Partner will only use and disclose an Entrant’s personal information in accordance with its privacy policy and, if applicable, collection statement, which can be accessed by an Entrant on the entry page of the Promotion prior to entry into this competition.

If entrants wish to stop receiving this information, they may unsubscribe by clicking on the unsubscribe link within any future emails they receive. Entrant’s details will then be removed from that database.

28.The Promoter also collects entrant’s information so that entrants can participate in the Promotion. If entrants do not give the Promoter the information, entrants cannot participate. In addition to the rights set out in this clause 28, the Promoter may use this information for the purposes of the conduct of the Promotion. The Promoter will only use and disclose an Entrant’s personal information in accordance with its privacy policy and, if applicable, collection statement, which can be accessed by an Entrant on the entry page of the Promotion prior to entry into this competition. The Promoter may disclose this information to third parties who provide the Promoter with services relating to the fulfilment of the Prize.
