Terms and Conditions
1. Information on how to enter forms part of the terms of entry. Entry into the Evergreen Tours
Vancouver Cruise Giveaway 3 (“Competition”) is deemed acceptance of these terms and
conditions.
Eligibility to Enter
2. Entry is open to all residents of Australia who are 18 years of age or over. However, employees
and the immediate families of Network Ten Pty Limited (the “Promoter”) and their associated
agencies and companies or any organisation or individual associated with the provision of the
prize(s) are not eligible to enter.
Competition Period
3. The competition commences on Friday 1 May 2015 at 09:00 AEST and closes on Wednesday 20
May 2015 at 12:00 noon AEST (“Competition Period”).
4. The Competition will be advertised on, but not limited to, Network TEN and
www.tenplay.com.auHow to Enter
5. To participate in the Competition entrants must log on to tenplay.com.au and register their
details including (but not limited to) name, address, phone number, email address, gender and
interest, to become a TENPlay member.
6. It is free to become a TENPlay member, however, the cost of accessing the promotional website
is dependent on the entrant’s individual service provider. These Terms and Conditions apply in
conjunction with the TEN Members rules.
7. A limit of one entry per person per day applies to this Competition.
8. Entries must be received by Wednesday 20 May 2015 at 12:00 noon AEST to be included in the
Prize Draw. Each valid entry received over the duration of the Competition Period will be
entered into the Prize Draw.
9. The time of entry will in each case be the time the online entry is received by the Promoter’s
database. The Promoter accepts no responsibility for any late, lost or misdirected entries due
to technical disruptions, network congestion or for any other reason.
10. The Finalist Draw will be held on Wednesday 20 May 2015 at 13:00 AEST at Mercury Mobility
Pty Ltd, Level 1, 16 Anster Street, Adelaide SA 5000. The Major Prize Winner will be determined
in program, Studio 10, on Friday 22 May 2015.
11. Six (6) potential finalists will be drawn in the Finalist Draw, and initial contacts will be made to
select Four (4) official finalists to participate in the on-air selection of the Major Prize Winner.

The first four (4) finalists that are drawn will be the initial finalists, should any of the initial four
(4) finalists be unable to participate in the on-air Major Prize Winner Draw finalists five (5) and
six (6) will be contacted.
12. To be eligible to participate in the on-air Major Prize Winner Draw, a finalist must have
confirmed their ability to participate in the on-air Major Prize Winner Draw by phone either in
the initial call made by the Promoter, or have returned the call to confirm the ability to
participate by 09:30 AEST on Thursday 21 May 2015.
13. The Major Prize Winner will be determined in program, Studio 10, on Friday 22 May 2015, at
Network TEN, 1 Saunders St, Pyrmont, NSW, 2009. The winner will also be notified in writing of
their prize. The winner’s details will be published on the TENPlay website at tenplay.com.au
from Friday 22 May 2015.
14. The Major Prize Winner will be selected as follows:
On Friday 22 May 2015, Four (4) Studio 10 panellists will draw a finalist’s name out of a hat
and will represent that finalist in the Game of Chance.
Four (4) suitcases will be on set, with one (1) suitcase containing a winner notification or
the winning travel tickets (facsimile or otherwise)
The Four (4) finalists must be available to participate via phone from 09:00 AEST. The
Studio 10 panellists will, in turn, select a suitcase to open on behalf of their finalist. If the
suitcase contains the Major Prize winner notification or travel tickets (facsimile or
otherwise) the finalist will win the Major Prize. If the suitcase does not contain the Major
Prize winner notification or travel tickets (facsimile or otherwise), the next Studio 10
Panellist will select a suitcase to open. This process will continue until the Major Prize is
awarded.
15. Prizes will be awarded to the person named in the entry. However, in a dispute, will be
awarded to the account holder of the entry mechanism used to submit their entry (ie mobile
phone account holder, landline account holder).
16. Should an entrant’s contact details change during the promotional period, it is the entrant’s
responsibility to notify the Promoter. A request to access or modify any information provided
in an entry should be directed to the Promoter.
17. If required, an unclaimed prize draw will be held on Friday 21 August 2015 at 11:00 AEST at
Mercury Mobility, L1, 16 Anster Street, Adelaide, SA 5000. The Winner of the Unclaimed Prize
draw will be notified by telephone and in writing within 2 days of the Unclaimed Prize draw and
their details will be published on
www.tenplay.com.au from Friday 21 August 2015.
18. An entry that is made on behalf of an Entrant by a third party will be invalid.
19. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose
at its absolute discretion, including promotional, marketing and publicity purposes without any
further reference or payment or other compensation to the entrant.
20. The Promoter reserves the right, at any time, to verify the validity of entries and entrants
(including an entrant’s identity, age and place of residence) and to disqualify any entrant who
submits an entry that is not in accordance with these Terms and Conditions or who tampers
with the entry process. Error and omissions will be accepted at the Promoter’s discretion.

Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of
those rights.

21. One (1) Major Prize Winner who will receive the Evergreen Tours prize detailed below:

22. The total Prize Pool is valued at $14,590.00 (including GST). The Promoter accepts no
responsibility for change in prize values between now and the ultimate prize redemption date.
23. Any ancillary costs associated with redeeming the prize/s are not included. These are the
responsibility of the winner.
24. Prizes are strictly non-transferrable and non-negotiable, and may not be replaced or refunded.

25. The Major Prize winner and their companion are responsible for all other expenses including
spending money (unless specified), meals (unless specified), drinks, transfers (unless specified),
laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any
other flight associated taxes included within the prize), energy surcharges, gratuities, services
charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended
to protect against the additional costs incurred in the event of unforeseen circumstances.
26. The Major Prize winner’s travelling companion must also be 18 years or older.
27. The Major Prize winner and their travelling companion must travel at the same time, must
depart from the same capital city and are responsible for transport from their residence to their
nearest capital city (Sydney, Melbourne, Perth, Adelaide or Brisbane) for flight departure. It is
the winners’ responsibility to organise transfers to and from the winner and their travelling
companion’s residence and nearest capital city.
28. The Promoter and Evergreen Tours are not responsible for any additional or incurred costs
while the winner and their travelling companion are travelling.
29. The Prize cannot be used towards flights only, travel insurance, items of a personal nature,
meals (other than featured in the itinerary), laundry, telephone calls, additional nights or
upgrades.
30. The Prize can only be used towards new bookings. The Prize is for one (1) twin share or double
room, to be used for travel in April, August or September 2016.
31. Accepting the Prize is subject to any prevailing Terms and Conditions of Evergreen Tours.
Please refer to the brochure of your travelling destination for more details.
32. The initial Winner and their travelling companion must advise Evergreen Tours of their
preferred travel dates by Monday 29 June 2015.
33. Travel blackout periods may apply for the travel prize.
34. The prize must be taken by Thursday 1 October 2016.
35. Network TEN makes no representation as to the safety conditions or other issues that may exist
at any destination.
36. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute
the prize for a prize of equal or greater value, subject to any directions given under State
Regulation.
37. Prizes must be taken as offered. Any prize, or any unused portion of any prize, are not
exchangeable or cannot be redeemed as cash. Prizes cannot be used in conjunction with any
other special offer. Prize values are in Australian dollars. The Promoter accepts no
responsibility for any variation in the prize values. Prize winners are advised that tax
implications may arise from their prize winnings and they should seek independent financial
advice prior to acceptance of their prize.

38. It is the responsibility of the winner (and their travelling companion) to obtain all relevant
vaccinations and passports, with at least 6 months validity from the date of return, and visas if
required.
39. Where applicable, names as per passport and dates of birth for all travellers are required at the
time of reservation.
40. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs
associated with the prize which are the entire responsibility of the winner.
41. The Promoter is neither responsible nor liable for any prize damaged in transit in the delivery of
their prize.
42. If for any reason this Competition is not capable of running as planned, including due to
infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical
failures or any causes beyond the control of the Promoter, which corrupt or affect the
administration, security, fairness or integrity or proper conduct of this promotion, the Promoter
reserves the right in its sole discretion to disqualify any individual who tampers with the entry
process, take any action that may be available, and subject to any written directions from a
regulatory authority, to cancel, terminate, modify or suspend the Competition.
43. If your entry is selected as a winning entry, validation of your circumstances, the validity of your
entry will be undertaken by the Promoter. Method of validation (without limitation) will be
determined by the Promoter in its complete discretion. If the winning entry is deemed to be a
winner, the winner will be notified as per the terms and conditions herein. In the event that the
Promoter requests the entrant to sign any legal documents relating to the verification of their
medical circumstance, the legal documents will take the form determined by the Promoter. It is
a condition of accepting the prize the winner signs any such legal documentation.
44. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude
or modify the statutory consumer guarantees as provided under the Competition and
Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer
protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except
for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the
Promoters (including its respective officers, employees and agents) excludes all liability
(including negligence), for any personal injury; or loss or damage (including loss of opportunity);
whether direct, indirect, special or consequential, arising in any way out of the promotion.
45. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoters (including its respective officers, employees and agents) is not
responsible for an excludes all liability (including negligence), for any personal injury; or any loss
or damage (including loss of opportunity); whether direct, indirect, special or consequential ,
arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or
not under the Promoter’s control); (b) any theft, unauthorised access or third party
interference: (c) any entry or prize claim that is late, lost, altered, damaged or misdirected
(whether or not after their receipt by the Promoters)due to any reason beyond the reasonable
control of the Promoter; (d) any variation in prize value to that stated in these Terms and
Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

46. If this promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the
Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to
disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to
modify, suspend, terminate or cancel the promotion, as appropriate.
47. All entries become the property of the Promoter. The Promoter collects personal information
about you to enable you to participate in this promotion but no further use of this information
will be made without prior consent.
48. With your express consent to do so, Evergreen Tours will collect your personal information in
accordance with their privacy policy which can be viewed at
http://www.evergreentours.com.au/Content/PDF/ETAU_Privacy_Policy.pdf. Evergreen Tours
privacy policy may change over time and it is the responsibility of the entrant to keep
themselves informed of these changes. If an entrant wishes to check the personal details held
by Evergreen Tours, or be removed from the opt-in database they should contact Evergreen
Tours by emailing
customer.care@evergreentours.com.
49. You consent to The Promoter collecting your personal information for the purpose of
conducting and promoting this Competition (including but not limited to determining and
notifying the winner and prize fulfilment). Your personal information may be disclosed to third
party service providers for this purpose. Your personal information may be disclosed to State
and Territory lottery departments and winners’ names published as required under the relevant
lottery legislation. For purposes of public statements and advertisements The Promoter will
only publish the winner’s surname, initial and State. A request to access, update or correct any
information should be directed to the Promoter. If you are not willing for this to occur you
cannot participate in the promotion.
50. The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth)
and by entering the Competition, you (the entrant) are taken to consent to Network Ten Pty
Limited’s privacy policy which contains information, amongst other things, about how you may
access personal information that is held by Network Ten Pty Limited about you and seek
correction of such information. See
