– Terms and Conditions of Entry –
Information on how to enter and prizes form part of these conditions of entry. Submission of an Entry is deemed acceptance of these conditions of entry.
Entry is only open to Australian residents aged 18 years or over who reside in Queensland or are temporarily visiting Queensland (Eligible Entrants).
Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter.
How to Enter
To enter, Eligible Entrants must, during the Promotional Period:
visit a Participating Retailer at the Gasworks Plaza;
spend a minimum of AUD$10.00 (Minimum Amount) with any one Participating
Retailer. The Minimum Amount must be spent in one transaction and will not include any amount spent on products or services excluded by a Participating Retailer (Excluded Products). The value of multiple transactions with different Participating Retailers cannot be combined to reach the Minimum Amount;
show a Participating Retailer the proof of purchase detailing the Minimum Amount in order to receive an official entry form;
complete all details requested on the official entry form provided by a Participating Retailer;
submit the completed entry form into an entry box in a Participating Retailer’s store.

Excluded Products
Terry White Chemists is the only Participating Retailer that has Excluded Products. The Excluded Products for Terry White Chemists are prescriptions, scheduled medicines and health services.
Promotional Period
Promotion commences 7am AEST on 1 May 2015. Entries close and must be received by 9pm AEST 31 May 2015 (Promotional Period).
Prizes
There will be two (2) prizes. There will be one major prize (Major Prize) and one minor prize (Minor Prize).
The Major Prize will consist of a two night romantic getaway at Spicers Hidden Vale Retreat, Grandchester, Queensland, including two (2) nights in a luxury or heritage suite, a gourmet breakfast daily, romantic welcome gift on arrival, 3 course dinner at Homage Restaurant for two people on one night, 60 minute massage or facial for two people at Spa Anise and a gourmet picnic basket for two on one of the days. The Major Prize is valid until 1 June 2016 and the booking is subject to availability and not valid on public holidays or block out dates (Major Prize Dates). Major Prize value is $1,459 RRP. The Major Prize winner must be available to use the Major Prize on the Major Prize Dates.
Unless expressly stated within these conditions of entry regarding the Major Prize, all other expenses are the responsibility of the Major Prize winner.
The Minor Prize will consist of a Gasworks Experience to the value of $1,229 RRP (Minor Prize). The Minor Prize includes a $200 voucher from Buzz Gasworks, a $100 voucher from Reef Seafood + Sushi, a $100 voucher from Hatch & Co, a $69 Karen Walker ring from oki & oro, a $50 accessory voucher from Yes Optus, a $200 hamper from The Standard Market Co, two bottles of French Champagne from The Wine Emporium valued at $100, five (5) $10 vouchers from YoFlo Yoghurt + Fruit Bar, a Campos Coffee Hamper valued at $40, a $40 Peng You China Kitchen & Bar voucher, a gift pack from Jimmy Rods Barber Shop valued at $50, two Missoni towels from Ollie & Lloyd by Olive Home valued at $180, and a $50 Max Brenner Chocolate Bar voucher. Total prize pool value is $2,688.00 RRP.
Draw
The first valid Entry drawn from the entry barrel will win the Major Prize. The second valid Entry drawn from the entry barrel will win the Minor Prize. The draw for both the Major Prize and Minor Prize will take place at Spicers Retreats Offices located at 168 Knapp Street, Fortitude Valley Queensland 4006 on 2 June 2015 at 3pm AEST (Prize Draw).
The Major Prize winner will be notified by telephone within two days of the Prize Draw. The Major Prize winner’s details will be published in the Gasworks Plaza’s June Electronic Newsletter and on Gasworks Plaza’s social media page at @gasworksplaza within 7 days of the Prize Draw. Coupons for redemption of the Major Prize will be delivered via Australia Post, to the Major Prize winner’s residence in Australia, being the address specified on the Entry by the Major Prize winner, within 14 days of the Prize Draw.
The Minor Prize winner will be notified by telephone within two days of the draw on 2 June 2015. The Minor Prize can be collected by the Minor Prize winner at Gasworks Plaza, 76 Skyring Terrace, Newstead, within 14 days of the Prize Draw at a date and time to be organised with the Promoter. If the Minor Prize winner does not collect the Minor Prize within 14 days of the Prize Draw the Minor Prize will be delivered via Australia Post, to the Minor Prize winner’s residence in Australia, being the address specified on the Entry by the Minor Prize winner, within one (1) month of the Prize Draw.
Unclaimed Prize Draw
If the Major Prize is not claimed or an Entry is deemed by the Promoter to be ineligible, an unclaimed prize draw for the Major Prize will take place at the Promoter’s premises located at 76 Skyring Terrace Newstead Queensland 4006 on 3 September 2015 at 2pm AEST subject to any directions from a regulatory authority. The same notification, publication and delivery method will apply as specified in clause 13 for the original Major Prize Draw.
If the Minor Prize is not claimed or an Entry is deemed by the Promoter to be ineligible, an unclaimed prize draw for the Minor Prize will take place at the Promoter’s premises located at 76 Skyring Terrace Newstead Queensland 4006 on 3 September 2015 at 2.30pm AEST subject to any directions from a regulatory authority. The same notification, publication and delivery method will apply as specified in clause 14 for the original Minor Prize Draw.
General Conditions
The Promoter reserves the right to verify the validity of Entries and Eligible Entrants (including an Eligible Entrant’s identity, age and address) and to disqualify any Eligible Entrant who submits an Entry that is not in accordance with these conditions of entry or who tampers with the Entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Multiple Entries per person are permitted, but each Entry must comply with these terms and conditions. Only one Entry permitted per proof of purchase for a Minimum Amount. Incomplete, indecipherable or illegible Entries will be deemed invalid. Any incorrect details submitted may render the corresponding Entry invalid. Photocopied Entry forms will not be accepted. The Promoter accepts no responsibility for any late, lost or misdirected Entries or for instances where Eligible Entrants are not entered into the Promotion due to forces beyond the Promoter’s control.
If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
The Promoter’s decision is final and no correspondence will be entered into.
Subject to the unclaimed prize draw clause, if for any reason whatsoever a Major Prize winner or Minor Prize winner does not take a Major Prize or Minor Prize by the time stipulated by the Promoter, then the Major Prize or Minor Prize will be forfeited by the Major Prize winner or Minor Prize winner and cash will not be awarded in lieu.
If the Major Prize or Minor Prize is unavailable, and subject to any written directions from a regulatory authority, the Promoter, in its sole discretion, reserves the right to substitute the Major Prize or Minor Prize with an alternative Major Prize or Minor Prize to the equal or greater value and/or specification, unless to do so would be prohibited by law.
If for any reason whatsoever beyond the reasonable control of the Promoter, the Promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any Eligible Entrant; and/or (b) subject to any written directions from a regulatory authority, to suspend, modify, terminate or cancel the Promotion.
Prizes are not transferable or exchangeable and are not redeemable for cash.
Nothing in these conditions of entry limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these conditions of entry would contravene any statute or cause any part of these conditions of entry to be void (Non-Excludable Guarantees). Subject to the limitations in the preceding sentence, the Promoter excludes from these conditions of entry all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in reward value to that stated in these conditions of entry; (f) any tax liability incurred by an Eligible Entrant and/or (g) a prize or use of a prize.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, Major Prize or Minor Prize suppliers and for any purpose required under Australian lottery legislation or any other regulatory authority. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes and the Promoter may also share this information with their partner for this Promotion, Spicers Retreats, who may use the information for promotional, marketing and publicity purposes. Eligible Entrants may opt out of receiving any direct marketing material. The Promoter’s Privacy Policy contains information about how an individual may request access to or the correction of personal information held about them or to make a complaint about a breach of the Australian Privacy Principles. Eligible Entrants consent to the Promoter using the Eligible Entrant’s name, likeness, image and/or voice in the event they are a Major Prize winner or Minor Prize winner (incl. photograph, film and/or recording of the same) in any media including Facebook for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
