AAPC LIMITED’S THE GREATEST AUSTRALIAN ONLINE TEST
CONDITIONS OF ENTRY
Information on how to enter the “The Greatest Australian Online Test” (“Promotion”) forms part of these terms and conditions. Entries not made in accordance with these terms and conditions will be disqualified.
Promoter: AAPC Limited (ABN 87 009 175 820) of Level 30, Angel Place, 123 Pitt Street, Sydney, NSW, 2000.
Promotion: The Greatest Australian Online Test (“Test”) is a game of chance online competition in which participants are asked to submit correct answers to 15 questions found at
http://www.thegreatestaustralian.com. Participants will be awarded one entry in the applicable Weekly Draw and Grand Prize Draw for each submission.
Promotional Period: The Competition commences for entry submissions at 00.01am AEST on 4th May 2015. Entries close at 24.00 AEST on 31 July 2015 (“Promotional Period”). No later entries will be accepted. To enter, entrants must, during the Promotional Period, answer all questions in the Test and complete the contact information requested: name, email address, phone number, state & country of origin to verify eligibility and for the purpose of notifying the winner.
Entries must be submitted online by 24.00 (midnight) on Friday 31st July 2015.
There will be thirteen (13) prizes awarded in total.
Eligibility: Entry is open to all Australian residents over the age of 18 at 00.01am AEST on 4th May 2015.
Entrants are not eligible to enter the Promotion or win any Prize if they are a director or manager, an employee or immediate family member of an employee, director or manager of the Promoter or its subsidiaries, or an employee of any hotel owned, managed or to the owner of whom the Promoter or any of its subsidiary has granted a franchise, or an employee of agencies.
How to Enter: (1) Visit
http://www.thegreatestaustralian.com during the Promotional Period (2) Answer all questions (3) Submit details via the entry form by providing the information requested in clause 2. By submitting the entry form, entrants confirm that all information provided on the form is complete and accurate. No changes may be made to an entry once it has been submitted. Incomplete entries will be disqualified. Each entrant may submit multiple entries. Entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of the entry. Only entries submitted electronically through the Test webpage in accordance with these Conditions of Entry will be eligible for consideration. All entries become the exclusive property of the Promoter and will not be acknowledged or returned.
Prizes: The total maximum prize pool is valued at $3,200. One (1) Grand Prize of $2,000 worth of Accor Gift cards will be awarded to an entrant at random from all eligible entries received during the Promotional Period after the final week. One (1) Weekly Prize of a $100 Accor Gift card will be awarded to entrants at random each week for twelve weeks, starting from a first draw on 18 May 2015. All eligible entries received from 00.01 AEST to 23.59 during each Weekly Period thereafter will be entered in the applicable Weekly Draw.as outlined in the table below:

Prizes are transferable to an individual that is 18 years or over. Cash will not be awarded in lieu of a prize, but Promoter reserves the right to substitute a prize of equal or greater value in its sole discretion. Accor Gift card can only be redeemed in Australian hotels and resorts in accordance with the terms of the Accor Gift card. Prizes must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Winners shall bear sole responsibility for fulfilling any tax obligations associated with receipt and/or use of prize.
Agreement to the Conditions of Entry: By submitting an entry form, each entrant fully and unconditionally agrees to and accepts these Conditions of Entry and the decisions of the Promoter, which are final and binding in all matters relating to the test. Winning a prize is contingent upon fulfilling all requirements set forth within these Conditions of Entry. Entrants represent that they meet all requirements for eligibility to participate in the Test. Any entrant found to be acting in violation of these Conditions of Entry may, in Promoter’s sole discretion, be disqualified. In the event of a dispute regarding the identity of an entrant, the entry will be declared made by the individual named in the submission of the entry form. Entrants shall indemnify the Promoter, against any and all claim, losses, costs, damages, liability and expenses arising out of the entrant’s breach of any of these Conditions of Entry.
Each entrant grants the right to reproduce, publish, transmit or otherwise communicate to the public their entry, in whole or in part, in or using any media for any purpose without permission or payment. By entering the Promotion it is agreed that winners may take part in any Public Relations or other promotions as requested by the Promoter without additional compensation or permission, unless prohibited by law.
Selection and Notification of Winners: The draw will take place at 14.00 AEST every Monday, starting on the second (2nd) Monday of the promotional period for the duration of the promotional period at MDSA, Ground Floor, 15 Grosvenor Street, Neutral Bay NSW 2089. The first valid entry drawn will receive a prize. This is a game of chance. All eligible entrants will not be eligible to win more than one weekly prize but are still eligible for the grand prize subject to entry as outlined in condition 4. The winner’s names will be published on Accor’s social media pages on the dates outlined in the table in condition 4.
All winners will be notified by email and by phone within 2 business days of the applicable draw; a current and valid email address is required in order to claim the prize. Prizes must be claimed before 17th November 2015 or an alternate winner will be selected by Promoter. The decisions of Promoter shall be final and binding in all respects.
Redraw/s: Subject to applicable law, in the event that a Prize remains unclaimed, the Promoter will conduct a redraw/s, following the same procedure and format as set out under condition 7. The redraw will take place at 14.00 am on 17 November 2015. Redraw Winner/s: The Prize Winner/s from any redraw will be notified in writing on 19 November 2015.
Release: By participating in the Promotion, to the extent permissible by law, entrants hereby release Promoter from any and all claims, damages or liabilities arising from or relating to the acceptance of any prizes in connection with their participation in the Promotion or delivery, misdelivery, acceptance, possession, and use of, or inability to use, any prize, to the extent permitted by law. In no event will the Promoter be liable to a participant for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of, or in connection with the Promoter, whether or not the Promoter has been advised, had reason to know, or in fact knew the possibility of such damage. Promoter is not liable in the event that any portion of the Promotion is cancelled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a "Force Majeure Event").
Limitations of Liability: To the extent permitted by law, the Promoter shall not have any obligation, liability or responsibility with regard to (i) entries that contain incorrect or inaccurate information or do not comply with these Conditions of Entry, (ii) entries, prize claims or notifications that are lost, late, incomplete damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, technical or other error of any kind, (iii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties, (iv) any condition caused by events beyond the control of Promoter that may cause the Test to be disrupted or delayed, or (v) any damages or losses of any kind caused by any prize or resulting from participation in the Test, accessing, uploading or downloading data in connection with the Test, or acceptance, possession or use of any prize. Promoter does not guarantee that Test will not contain IT faults, or that faults identified will be remedied; nor can they guarantee that Test and/or sites to which Test operates do not contain viruses or other components which may cause damage to players’ computer equipment and/or data. Promoter does not guarantee continuous, uninterrupted or secure access to Test. Numerous factors outside of the control of Promoter may interfere with the operation of Test. To the extent permissible by law, Promoter excludes all implied warranties, conditions and other implied terms. Promoter, in its sole discretion, reserves the right to disqualify any entrant tampering with the entry process or the operation of the Test website or otherwise violating these Conditions of Entry. Promoter, in its sole discretion, further reserves the right to shorten, defer, alter, cancel, terminate, suspend or modify the Test and the Promotion (including without limitation the prizes offered) if the Test cannot be completed as planned because of infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, and to select a winner from among eligible entries unaffected by such event, if any; it cannot be held liable for this on any grounds whatsoever.
Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Conditions of Entry, or the rights and obligations of the entrant and Promoter in connection with the Test, shall be governed by, and construed in accordance with, the laws of Australia, without giving effect to its conflicts of law principles.
Right to Use Entries: By entering the Promotion, entrants grant Promoter a non-exclusive, irrevocable, royalty-free, perpetual, worldwide right and license to reproduce, publish, display, edit and otherwise use the submitted Entries, and entrant’s full name and city and state/province/country of residence, online and in print or any other media for purposes of editorials, exhibition, advertising, publicity and promotion of the Test, the Promotion, and Promoter’s publications and products, without additional compensation or permission, unless prohibited by law.
