An “Eligible Entrant” for the purpose of participating in this competition is a resident of Australia who has registered for the Homegrown campaign. Either an individual or a family may enter. If the individual is under 15 years of age, the Eligible Entrant must be either the parent or guardian of that individual. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
Registration is open from 9.00am Australian Eastern Standard Time (“AEST”) on Thursday 28th May 2015 and close at 11:59pm on 30th August 2015. The actual competition starts at 12.00am AEST on Monday 29th June 2015 and closes at 11.59pm AEST on Sunday 30th August 2015, being a total of 9 weeks (“Competition Period”).
To participate in the competition follow these steps: a. Register –your participation by completing the registration form at
www.uncletobys.com.au/pinchme including your full name, address, email and if you are entering as a family, the names of your family members including the number of children in your family and their ages. These details will only be used for the purposes for this competition. Upload – during the Competition Period, upload a photo or video showing the growth progress of the oat seeds, tagged with the hashtag #homegrownoats, to your preferred social media channel from Facebook, Twitter and Instagram. For Facebook, post to the UNCLE TOBYS Facebook page at
www.facebook.com/uncletobys and include the hashtag #homegrownoats. For Twitter or Instagram, post as normal and include the hashtag #homegrownoats. b. Continue – to upload photos or videos throughout the Competition Period showing the progress of the seeds tagged with #homegrownoats (there is no limit to the number of photos/videos you may upload).
There is a limit of one registered entry per household.
A minimum of 1 photo or video must be uploaded to either the Uncle Tobys Facebook page, Instagram or Twitter and tagged with #homegrownoats in any week of the Competition Period to qualify for the minor prize for that week.
The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited making multiple entries or for submitting an entry which is not otherwise in accordance with these terms and conditions.
If the Promoter finds evidence of tampering by the entrant in the entry process or the verification process, in addition to declaring any or all entries made by the relevant entrant invalid, the Promoter may in its complete discretion preclude that entrant from participation in any or all future competitions of the Promoter.
This competition is a game of skill. Accordingly, chance plays no part in determining the identity of the prize winners. All valid entries received during the Competition Period will be judged on their merits and the level of participation. Criteria that the judges will use to decide both the weekly minor prize winners and the major prize winners are: imaginative, artistic and creative entries; the creativity of posted submissions based on the photography, video and/or accompanying story supplied; the level of engagement shown and the ongoing commitment to the competition displayed by several submissions over the Competition Period.
During the Competition Period, the 5 entries judged to be the best received each week (a week being from 12.00am AEST Monday until 11:59pm AEST Sunday) will win a minor prize, with a total of 45 minor prizes to be awarded. At the end of the Competition Period the entry judged to be the best overall will win the major prize. There is one major prize to be won.
The prizes are as follows: a) The major prize is a holiday valued at $5,000. The major prize will be awarded by providing pre-paid Flight Centre Travel Group Gift Cards totalling $5,000. The gift cards will be valid for 12 months from the date of issue. Any unused balance may be used against future purchases, but will not be refunded or credited when the gift card expires. There are a total of 45 minor prizes to be awarded (with 5 minor prizes being awarded each week during the Competition Period).
Judging will take place at the offices of the Promoter on the following dates: a. The weekly minor prize will be judged on each Monday from the preceding week’s entries during the Competition Period, starting on Monday 6th July 2015. b. The major prize will be judged on or before Monday 7th September 2015.
All winners will be notified by email within 48 hours of judging and all winners’ names and postcodes will be published at
www.nestle.com.au/winners by Thursday 10th September 2015.
The total prize pool is valued at approximately $11,750 RRP.
The prizes are not transferable and cannot be converted to cash.

The Promoter’s decision is final and no correspondence will be entered into.
Each winner should look to the manufacturer of products and provider of services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of a prize if the Promoter determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate.
By entering the competition and claiming a prize, each prize winner agrees that the Promoter may use their name, image and photograph/s for publicity and promotion purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.
Prizes will only be delivered in Australia and each winner should allow 28 days from the conclusion of judging for delivery of their prize.
If for any reason this competition is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the competition, the Promoter reserves the right in its sole discretion (subject to any written direction given by a relevant Regulatory Authority) to cancel, terminate, modify or suspend the competition.
Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this competition.
