TERMS AND CONDITIONS
1. This competition (“Competition”) is conducted by STANLEY BLACK & DECKER AUSTRALIA PTY LTD ABN 82 000 021 938 of Level 2, 810 Whitehorse Road Box Hill, VIC 3128 Australia (“Promoter”).
2. This Competition commences at 8am on 1st August 2016 (AEST) and ends at 5pm on 10th January 2017 (AEDST).
3. The sections on How to Enter, Draw and Winner Notification, Prizes and Miscellaneous Provisions form part of these Terms and Conditions.
4. This Competition is only open to individuals who:a. are Australian residents;b. are aged 16 years or older;c. entrants aged between 16 and 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. If the winner of the prize is aged under 18 years, the prize will be awarded to the winner’s parent or legal guardian, on the winner’s behalf.d. are not employees of the Promoter, or any of their agencies associated with this Competition; (are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee; ande. have not been discovered to have breached these Terms and Conditions.
5. Entry into this Competition is deemed to be acceptance of these Terms and Conditions. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of these Terms and Conditions generally.
6. Each entrant acknowledges that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of an entrant’s ineligibility to enter after the Promoter has awarded a Prize to the ineligible entrant. Return of a Prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.
HOW TO ENTER:
7. To enter, entrants must during the Promotion Period:
a. purchase any Sidchrome product from a participating stockist and receive 1 entry for each $1 incl. GST purchased.i. i.e. $50 incl. GST = 50 entries, $49.95 = 49 entries
b. Receive a receipt / invoice for each separate retail purchase
c. visit
www.winwithsidchrome.com.au (the “Website”) and fully complete the online entry form, including details of product purchase, corresponding retail invoice number and completing the requested personal details upon the online entry form so that it is received during the Promotional Period.
8. To verify each entry entrants must retain:
a. The original purchase receipt/ tax invoice(s).
9. The Promoter may require entrants to provide these and/or information regarding the circumstances of Product purchases to the Promoter or its agent as part of the entry verification process. Failure to provide these to the Promoter’s satisfaction will result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid).
10. Entries may only be submitted online and in the correct form as described on the promotional website and will not be accepted by the Promoter in any other form
11. Multiple entries are allowed, however, every entry must be a separate online entry and be one entry per receipt / invoice. If an entrant is unable to provide proof of purchase for all entries made, then all the entries of that entrant will be deemed invalid. Sharing receipt / invoice numbers is not allowed. If the Promoter reasonably believes that an entry has been made on this basis, the Promoter will invalidate all entries affected.
DRAW AND WINNER NOTIFICATION
12. The major prize draw will take place 12 noon AEDST 15th January 2017 at Flow Marketing 403 Pakington St Newtown VIC 3220.
13. The first (1) valid entry drawn will win the grand prize.
14. The winner will be notified by telephone and email within two business days of the date of the draw. Winners names will be published in the Australian on 18th January 2017 and on the website:

15. The winner must claim the prize by 5pm AEDST 15th March 2016 any prize that remains unclaimed will be forfeited by that winner and a new winner will be redrawn at 12 noon AEDST 12th April 2017 at Flow Marketing 1/403 Pakington St Newtown VIC 3220.
16. Any winner drawn as part of an unclaimed prize draw will be notified by telephone and email within two business days of the date of redraw and have their name published in the Australian on 14th April 2017 and on the website:
www.winwithsidchrome.com.au for a period of 28 days.
PRIZES
17. Major Prize– a 2016 Python Cobra (Hand Built Replica Sports Car) with a manual transmission. Total prize value is up to $126,000 and includes one year’s registration (registered in the winner’s State or Territory of residence), compulsory third party insurance, stamp duty, GST (if applicable) and delivery charges (which may vary State/Territory by State/Territory). The only warranty given by the Promoter with respect to the vehicle is that it is roadworthy when given to the winner. No extended warranty is given. Additional insurance including comprehensive insurance, options, petrol and all other ancillary costs are the responsibility of, and will be at the cost of, the winner. There is only one prize winner in this promotion.
18. Total prize pool value is up to $126,000.
19. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to equal value and/or specification, subject to any written directions from a regulatory authority.
20. Prizes or any component of the prize are not transferable, saleable or exchangeable and cannot be taken or redeemed as cash or equivalent.
21. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purposes of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee.
22. The winner must provide the Promoter with certified copies of all documentation as required by the Promoter before the car is awarded. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity.
MISCELLANEOUS PROVISIONS
23. All entries must be submitted by a person and any automated entries, fraudulent entries or entries by persons using an alias shall be invalid.
24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25. If for any reason this Competition is not capable of running as planned, including without limitation due to, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition or the reputation of this Competition or that of the Promoter, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, or to cancel, terminate, modify or suspend this Competition, subject to regulatory approval, if required.
26. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including their eligibility to enter) and to disqualify any entrant whose entry is not in accordance with these Terms and Conditions or who otherwise tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
27. Incomplete, indecipherable, or illegible entries will be deemed invalid. If there is a dispute as to the identity or details of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity or details of the entrant.
28. Except for any liability that cannot be excluded by law, the Promoter (including their officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity, loss of business or loss of goodwill or loss of profits); whether direct, indirect, special or consequential, arising in any way out of this Competition, including without limitation, where arising out of the following: any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);any theft, unauthorised access or third party interference; a. any entry or prize claim that is cancelled, delayed, interrupted, diverted, late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or otherwise);
b. any variation in prize value or specification to that stated or referred to in these Terms and Conditions;
c. any tax liability or similar charge incurred by a Winner or the entrant; ord. the use or attempted use of a prize by a Winner or any other third party.
29. The laws of Australia apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
30. The Promoter’s decisions in relation to this Competition are final and no correspondence or communication will be entered into in relation any aspect of this Competition.
31. Entrant personal information ("PI") will be collected to enable the Promoter to administer and promote this Competition. The PI of entrants will be provided to the Promoter’s staff, contractors and third parties assisting in the administration and fulfilment of the Competition, including prize suppliers and deliverers. If an entrant opts-in to receive information from the Promoter, the Promoter will use that entrant’s information for that purpose.
